FACTORIES AND MACHINERY ACT 1967

FACTORIES AND MACHINERY

(EXEMPTION OF CERTIFICATE OF FITNESS FOR HOISTING MACHINE) ORDER 2015

IN exercise of the powers conferred by subsection 55(3) of the Factories and Machinery

Act 1967 [Act 139], the Minister makes the following order:

Citation 1.

This order may be cited as the

Factories and

Machinery

(Exemption of Certificate of Fitness for Hoisting Machine) Order 2015.

Exemption 2.

All hoisting machines specified in the Schedule are exempted from the certificate of fitness required under subsection 19(1) of the Act and regulation 10 of the

Factories and Machinery (Notification, Certificate of Fitness and Inspection)

Regulations 1970 [P.U. (A) 43/1970].

Condition of exemption 3.

The exemption under paragraph 2 is subject to the following conditions:

(a)

the occupier of any factory or owner of any hoisting machine shall obtain the written approval of the Inspector under paragraph 36(1)(a) of the Act before installing any hoisting machine except a winch (towing vehicle only) and tail lift;

(b)

the employer shall so far as is practicable—

(i)

conduct hazard identification, risk assessment and risk control for the hoisting machines;

(ii)

ensure safe operating procedures for the hoisting machines are provided as guideline to the employees;

(iii)

conduct regular inspection and maintenance of the hoisting machines in accordance with the manufacturer’s instructions to ensure that the hoisting machines are safe to operate without causing any risk to safety and health;

(iv)

ensure that every person who is involved in the installation, operation and maintenance of the hoisting machines is adequately trained;

(v)

conduct effective supervision to ensure that all employees comply with the safe operating procedures provided under subsubparagraph (ii); and

(vi)

keep and maintain all relevant records relating to subsubparagraphs (i) to (v) for inspection by the occupational safety and health officer; and

(c)

all hoisting machines replacement parts shall conform to the manufacturer’s specification.
