Simpanan Pekerja (Pengubahsuaian kepada Maksud Pengeluaran di bawah

Subseksyen 54(6)) 2022.

Perintah ini mula berkuat kuasa pada 1 Julai 2022.

Pengubahsuaian kepada maksud pengeluaran di bawah subseksyen 54(6)

dengan memasukkan perkataan “dan” di hujung perenggan (i);

dengan menggantikan koma bernoktah di hujung perenggan (j)

dengan noktah; dan

dengan memotong perenggan (k), (l), (m) dan (n).

Kecualian

Apa-apa notis pengeluaran yang dibuat berhubung dengan perenggan 54(6)(k), (l), (m) atau (n) Akta pada atau sebelum 31 Mac 2021, 30 Jun 2021,

30 September 2021 atau 30 April 2022, masing-masing, yang belum selesai sebelum tarikh permulaan kuat kuasa Perintah ini hendaklah, pada tarikh permulaan kuat kuasa

Perintah ini, diuruskan mengikut peruntukan Akta seolah-olah Akta tidak diubah suai oleh Perintah ini.

Apa-apa kebenaran, arahan, keputusan atau tindakan pentadbiran lain yang dibuat, diberikan atau dilakukan berhubung dengan perenggan 54(6)(k), (l), (m)

atau (n) Akta sebelum tarikh permulaan kuat kuasa Perintah ini hendaklah, pada tarikh permulaan kuat kuasa Perintah ini, terus berkuat kuasa dan berkesan sepenuhnya berhubung dengan ahli Kumpulan Wang yang baginya kebenaran, arahan, keputusan atau tindakan pentadbiran lain itu terpakai sehingga dipinda, dimansuhkan, dihapuskan, dibatalkan atau digantikan.

Apa-apa penyiasatan atau prosiding undang-undang yang dimulakan berhubung dengan perenggan 54(6)(k), (l), (m) atau (n) Akta yang belum selesai sebelum tarikh permulaan kuat kuasa Perintah ini hendaklah, pada tarikh permulaan kuat kuasa

Perintah ini, diteruskan mengikut peruntukan Akta seolah-olah Akta tidak diubah suai oleh Perintah ini.

Apa-apa sebutan kepada perenggan 54(6)(l), (m) atau (n) Akta dalam subperaturan 5A(2A) atau (2B) Peraturan-Peraturan Kumpulan Wang

Simpanan Pekerja 2001 [P.U. (A) 409/2001] hendaklah, pada tarikh permulaan kuat kuasa Perintah ini, terus berkuat kuasa dan berkesan sepenuhnya seolah-olah

Akta tidak diubah suai oleh Perintah ini.

EMPLOYEES PROVIDENT FUND ACT 1991

EMPLOYEES PROVIDENT FUND (MODIFICATION TO THE PURPOSES FOR

WITHDRAWAL UNDER SUBSECTION 54(6)) ORDER 2022

by inserting the word “and” at the end of paragraph (i);

by substituting for the semi colon at the end of paragraph (j) a full stop; and

by deleting paragraphs (k), (l), (m) and (n).

Savings 3.

Any notice of withdrawal made in relation to paragraph 54(6)(k), (l), (m)

or (n) of the Act on or before 31 March 2021, 30 June 2021, 30 September 2021

or 30 April 2022, respectively, which is pending before the date of coming into operation of this Order shall, on the date of coming into operation of this Order, be dealt with in accordance with the provisions of the Act as if the Act had not been modified by this Order.

Any authorization, direction, decision or other executive acts made, given or done in relation to paragraph 54(6)(k), (l), (m) or (n) of the Act before

the date of coming into operation of this Order shall, on the date of coming into operation of this Order, continue in full force and effect in relation to the member of the

Fund to whom the authorization, direction, decision or other executive acts applied until amended, repealed, rescinded, revoked or replaced.

Any investigation or legal proceedings instituted in relation to paragraph 54(6)(k), (l), (m) or (n) of the Act which is pending before the date of coming into operation of this Order shall, on the date of coming into operation of this Order, be continued in accordance with the provisions of the Act as if the Act had not been modified by this Order.

Any reference to paragraph 54(6)(l), (m) or (n) of the Act in subregulation 5A(2A) or (2B) of the Employees Provident Fund Regulations 2001

[P.U. (A) 409/2001] shall, on the date of coming into operation of this Order, continue in full force and effect as if the Act had not been modified by this Order.
