FISHERIES ACT 1985

ESTABLISHMENT OF MARINE PARKS MALAYSIA (AMENDMENT) ORDER 2022

IN exercise of the powers conferred by subsection 41(1) of the Fisheries Act 1985

[Act 317], the Minister makes the following order:

Citation and commencement 1.

(1)

This order may be cited as the Establishment of Marine Parks Malaysia

(Amendment) Order 2022.

(2)

This Order comes into operation on 1 January 2023.

Amendment of paragraph 2 2.

The

Order 1994

[P.U. (A) 401/1994], which is referred to as the “principal Order” in this Order, is amended in paragraph 2—

(a)

in subparagraph (1), by substituting for the words “and Second”

the words “, Second Schedule and Third Schedule”; and

(b)

by inserting after subparagraph (3) the following subparagraph:

“(4)

The limit of any area or part of an area established as a marine park shall be at a distance of three nautical miles seaward from the outermost points of the islands specified in column (1)

of the Third Schedule as measured at low water mark.”

Amendment of First Schedule 3.

The First Schedule of the principal Order is amended—

(a)

by deleting item 22 and the particulars relating to it; and

(b)

by deleting item 28 and the particulars relating to it.

New Third Schedule 4.

The principal Order is amended by inserting after the Second Schedule the following Schedule:
