PADA menjalankan kuasa yang diberikan oleh subseksyen 77(1) Akta Peranti Perubatan 2012 [Akta 737], Menteri, demi kepentingan kesihatan dan keselamatan awam, membuat perintah yang berikut: Nama dan permulaan kuat kuasa

Perintah ini bolehlah dinamakan

Perintah Peranti Perubatan

(Pengecualian) 2015.

(2)

Perintah ini mula berkuat kuasa pada 1 Julai 2015.

Seksyen 2

(1)

Menteri mengecualikan mana-mana orang yang telah mengemukakan permohonan bagi pendaftaran peranti perubatan antara 1 Julai 2015 hingga 30 Jun 2016 daripada kehendak seksyen 5 Akta.

(2)

Orang yang diberikan pengecualian di bawah subperenggan (1) boleh terus mengimport, mengeksport atau meletakkan dalam pasaran peranti perubatan itu sementara menunggu keputusan permohonan bagi pendaftaran.

MEDICAL DEVICE (EXEMPTION) ORDER 2015

Opening note

Preamble

IN exercise of the powers conferred by subsection 77(1) of the Medical Device Act 2012 [Act 737], the Minister, in the interest of public health and safety, makes the following order: Citation and commencement 1.

(1)

This order may be cited as the Medical Device (Exemption)

Order 2015.

(2)

This Order comes into operation on 1 July 2015.

Exemption 2.

(1)

The Minister exempts any person who has submitted an application for registration of a medical device between 1 July 2015 until 30 June 2016 from the requirement of section 5 of the Act.

(2)

The person exempted under subparagraph (1) may continue to import, export or place in the market the medical device pending determination of the application for registration.
