(1)

Mana-mana orang yang membekalkan atau menawarkan untuk membekal suatu pelitup muka bukan perubatan hendaklah memohon kepada pihak berkuasa yang berwibawa bagi perakuan suatu pelitup muka bukan perubatan.

Pelitup muka yang disebut dalam subperenggan (1) hendaklah—

(a)

diperakukan oleh pihak berkuasa yang berwibawa mengikut mana-mana standard yang dinyatakan dalam ruang (2) Jadual;

ditandakan dengan logo yang dinyatakan dalam ruang (1)

Mana-mana orang yang tidak mematuhi mana-mana peruntukan Perintah ini, melakukan kesalahan dan boleh, apabila disabitkan—

(a)

jika orang itu ialah suatu pertubuhan perbadanan, didenda tidak melebihi dua ratus ribu ringgit, dan bagi kesalahan yang kedua atau yang berikutnya, didenda tidak melebihi lima ratus ribu ringgit; atau

jika orang itu bukan suatu pertubuhan perbadanan, didenda tidak melebihi satu ratus ribu ringgit atau dipenjarakan selama tempoh tidak melebihi tiga tahun atau kedua-duanya, dan bagi kesalahan yang kedua atau yang berikutnya, didenda tidak melebihi dua ratus lima puluh ribu ringgit atau dipenjarakan selama tempoh tidak melebihi lima tahun atau kedua-duanya.

TRADE DESCRIPTIONS

(CERTIFICATION AND MARKING OF NON-MEDICAL FACE MASK) ORDER 2022

IN exercise of the powers conferred by section 29 of the Trade Descriptions Act 2011

[Act 730], the Minister makes the following order:

Citation and commencement 1.

(1)

This order may be cited as the Trade Descriptions (Certification and

Marking of Non-Medical Face Mask) Order 2022.

(2)

This Order comes into operation on 4 July 2022.

Interpretation 2.

In this Order, “non-medical face mask” means any face mask which covers mouth and nose other than medical face mask regulated under the Medical Device Act 2012 [Act 737].

Competent authority 3.

For the purpose of this Order, SIRIM QAS International Sdn. Bhd. (410334-X)

shall be the competent authority referred to in subsection 29(3) of the Act to certify a non-medical face mask.

Application for certification, marking, etc.

4.

(1)

Any person who supplies or offers to supply a non-medical face mask shall apply to the competent authorities for the certification of a non-medical face mask.

(2)

The non-medical face mask referred to in subparagraph (1) shall be—

(a)

certified by the competent authorities in accordance with any of the standard specified in column (2) of the Schedule;

(b)

marked with the logo specified in column (1) of the Schedule; and

(c)

accompanied with the information relating to the standard of the certification of the non-medical face mask on the box or the packaging of the non-medical face mask.

Offence 5.

Any person who fails to comply with any provision of this Order, commits an offence and shall, on conviction, be liable—

(a)

if such person is a body corporate, to a fine not exceeding two hundred thousand ringgit, and for a second or subsequent offence, to a fine not exceeding five hundred thousand ringgit; or

(b)

if such person is not a body corporate, to a fine not exceeding one hundred thousand ringgit or to imprisonment for a term not exceeding three years or to both, and for a second or subsequent offence, to a fine not exceeding two hundred and fifty thousand ringgit or to imprisonment for a term not exceeding five years or to both.
