- PADA menjalankan kuasa yang diberikan oleh seksyen 59 Akta Racun Makhluk Perosak 1974 [Akta 149], Menteri membuat perintah yang berikut: Nama dan permulaan kuat kuasa

(a)
kehendak untuk mendaftarkan racun makhluk perosak itu di bawah seksyen 7 Akta;
(b)
larangan di bawah perenggan 13(1)(b) Akta bagi maksud pengimportan racun makhluk perosak itu; dan
(c)
kehendak untuk mendapatkan lesen menjual atau menyimpan untuk jualan racun makhluk perosak itu di bawah seksyen 17 Akta.

Syarat pengecualian
Seksyen 3
Tebuthiuron sebagai perawis aktifnya daripada—
(1)
Pengecualian di bawah perenggan 2 tertakluk kepada syarat yang berikut:
(a)
Ancom Crop Care Sdn. Bhd. dibenarkan untuk mengimport 300 tan racun makhluk perosak itu dan semua jumlah racun makhluk perosak itu hendaklah dieksport kemudiannya;
(b)
Ancom Crop Care Sdn. Bhd. hendaklah mengemukakan satu salinan pesanan pembelian racun makhluk perosak itu kepada Lembaga setiap kali sebelum pengimportan racun makhluk perosak itu dijalankan;
(c)
Ancom Crop Care Sdn. Bhd. hendaklah mengemukakan suatu laporan berkenaan dengan import dan eksport racun makhluk perosak itu kepada Lembaga pada setiap bulan; dan
(d)
laporan yang disebut dalam subsubperenggan (c) hendaklah mendedahkan amaun racun makhluk perosak itu yang telah diimport dan dieksport oleh Ancom Crop Care Sdn. Bhd..
(2)
Menteri boleh membatalkan pengecualian di bawah perenggan 2
jika mana-mana syarat di bawah subperenggan (1) tidak dipatuhi.

PESTICIDE (EXEMPTION) (NO. 2) ORDER 2025
Opening note
Preamble
- IN exercise of the power conferred by section 59 of the Pesticide Act 1974 [Act 149], the Minister makes the following order: Citation and commencement 1.

This Order has effect for the period from 13 May 2025 to 13 February 2026.
Exemption 2.
Subject to paragraph 3, the Minister exempts Ancom Crop Care Sdn. Bhd.
(Company Registration Number: 198501015714 (148170-X)) in relation to a pesticide containing Tebuthiuron as its active ingredient from—
(b)
the prohibition under paragraph 13(1)(b) of the Act for the purpose of importation of the pesticide; and
(c)
the requirement for a license to sell or store the pesticide for sale under section 17 of the Act.
Conditions of exemption 3.
(1)
The exemption under paragraph 2 is subject to the following conditions:
(a)
Ancom Crop Care Sdn. Bhd. is allowed to import 300 tonnes of the pesticide and all such amount of pesticide shall subsequently be exported;

(b)
Ancom Crop Care Sdn. Bhd. shall submit one copy of purchase order of the pesticide to the Board each time before the importation of the pesticide is carried out;
(c)
Ancom Crop Care Sdn. Bhd. shall submit a report in respect of the imports and exports of the pesticide to the Board every month; and
(d)
the report referred to in subsubparagraph (c) shall disclose the amount of the pesticide which has been imported and exported by Ancom Crop Care Sdn. Bhd..
(2)
The Minister may revoke the exemption under paragraph 2 if any condition under subparagraph (1) is not complied with.
