PADA menjalankan kuasa yang diberikan oleh seksyen 81 Akta Hakmilik Strata 1985 [Akta 318], sebagaimana yang diubah suai melalui Perintah Wilayah Persekutuan Labuan (Pemerluasan dan Ubah Suaian Akta Hakmilik Strata) 2009 [P.U.(A) 458/2009], Menteri membuat kaedah-kaedah yang berikut: Nama, permulaan kuat kuasa dan pemakaian

Dalam Kaedah-Kaedah ini “formula unit syer” ertinya formula yang digunakan untuk mengira unit syer sebagaimana yang dinyatakan dalam Jadual 2.

Permohonan bagi Sijil Formula Unit Syer

Mana-mana pemilik asal hendaklah, sebelum membuat suatu permohonan bagi pecah bahagi bangunan atau tanah di bawah seksyen 9 Akta, membuat permohonan bagi Sijil Formula Unit Syer dalam Borang A Jadual 1.

Permohonan di bawah subkaedah (1) hendaklah―

(a)

menggunakan pengiraan formula unit syer sebagaimana yang dinyatakan dalam Jadual 2;

mematuhi apa-apa syarat sebagaimana yang ditentukan oleh Pengarah; dan 3

(c)

disertakan dengan fi sebagaimana yang dinyatakan dalam Jadual 3.

Jika pemilik asal tidak dapat mengemukakan apa-apa dokumen atau maklumat yang dikehendaki untuk dikemukakan dalam Borang A Jadual 1, Pengarah boleh, selepas berpuas hati bahawa pemilik asal telah memberikan alasan yang mencukupi, mengecualikan pengemukaan dokumen atau maklumat itu.

Apabila berpuas hati bahawa kehendak di bawah kaedah ini telah dipatuhi,

Pengarah boleh meluluskan permohonan dan mengeluarkan Sijil Formula Unit Syer sebagaimana yang dinyatakan dalam Jadual 4 kepada pemilik asal.

Walau apa pun perenggan (2)(a), jika Pengarah mendapati bahawa pengiraan formula unit syer akan menyebabkan unit syer yang dicadangkan atau kuantum unit syer sementara yang diperuntukkan kepada petak atau blok sementara, mengikut mana-mana yang berkenaan, adalah tidak saksama, Pengarah boleh mengguna pakai formula unit syer lain yang saksama bagi permohonan itu.

Jika terdapat apa-apa perubahan pada pelan bangunan yang telah diluluskan oleh Perbadanan Labuan, atau pada unit syer, atau kedua-duanya, selepas

Sijil Formula Unit Syer dikeluarkan, pemilik asal hendaklah membuat permohonan bagi suatu Sijil Formula Unit Syer yang baharu di bawah kaedah 3 kepada Pengarah dan kehendak di bawah subkaedah 3(1) dan (2) hendaklah terpakai.

Jika mana-mana pemilik asal berhasrat untuk mengubah apa-apa maklumat dalam Sijil Formula Unit Syer selain maklumat yang berhubungan dengan pelan bangunan dan unit syer yang disebut dalam subkaedah (1), pemilik asal hendaklah membuat permohonan untuk mengubah maklumat itu kepada Pengarah mengikut cara sebagaimana yang ditentukan oleh Pengarah bersama dengan bayaran fi sebagaimana yang dinyatakan dalam Jadual 3.

Bagi maksud subkaedah (2), perubahan maklumat hanya akan dibuat kepada Sijil Formula Unit Syer yang asal tanpa pengeluaran Sijil Formula Unit Syer yang baharu.

Mana-mana pemilik yang membuat permohonan pecah bahagi bangunan yang melibatkan blok sementara di bawah seksyen 9A Akta hendaklah membayar deposit yang disebut dalam subperenggan 10(2)(c)(ii) Akta sebagaimana yang dinyatakan dalam butiran 6 Jadual 3.

Bagi maksud subkaedah (1), Pengarah hendaklah mengeluarkan notis kepada pemilik untuk meminta bayaran deposit dengan menggunakan Borang B

Bayaran deposit di bawah subkaedah (1) hendaklah disertakan dengan suatu pernyataan bertulis yang disebut dalam subperenggan 10(2)(c)(ii) sebagaimana yang dinyatakan dalam Borang C Jadual 1.

Permohonan untuk mengklasifikasikan bangunan sebagai bangunan kos rendah 6.

Mana-mana pemilik tanah beri hakmilik yang membuat permohonan mengklasifikasikan bangunan sebagai bangunan kos rendah di bawah seksyen 9B Akta hendaklah memohon kepada Menteri yang berkenaan dalam Borang D Jadual 1.

Permohonan di bawah subkaedah (1) hendaklah disertakan dengan fi sebagaimana yang dinyatakan dalam Jadual 3.

(3)

Apabila Menteri yang berkenaan berpuas hati bahawa syarat-syarat telah dipatuhi, Menteri yang berkenaan boleh meluluskan permohonan tersebut dan mengklasifikasikan bangunan sebagai bangunan kos rendah.

Setelah mengklasifikasikan bangunan sebagai bangunan kos rendah,

Menteri yang berkenaan hendaklah mengeluarkan Perakuan Bangunan Kos Rendah sebagaimana yang dinyatakan dalam Jadual 5 kepada pemilik tanah beri hakmilik .

Permohonan untuk mengklasifikasikan bangunan sebagai bangunan khas 7.

Mana-mana pemilik asal boleh membuat permohonan untuk mengklasifikasikan mana-mana bangunan yang diduduki sebelum Januari 2020 sebagai bangunan khas kepada Menteri yang berkenaan dalam Borang E Jadual 1.

(2)

Menteri yang berkenaan boleh mengklasifikasikan bangunan yang disebut dalam subkaedah (1) sebagai bangunan khas dengan syarat bahawa―

(a)

bangunan itu telah digunakan bagi maksud kediaman, perdagangan atau industri;

(b)

bangunan itu telah digunakan bagi maksud perdagangan dan kediaman; atau

(c)

bangunan itu telah digunakan bagi apa-apa maksud lain yang difikirkan Menteri yang berkenaan layak untuk diklasifikasikan sebagai bangunan khas.

Permohonan di bawah subkaedah (1) hendaklah disertakan dengan fi sebagaimana yang dinyatakan dalam Jadual 3.

Apabila berpuas hati bahawa kehendak di bawah kaedah ini telah dipatuhi,

Menteri yang berkenaan boleh meluluskan permohonan itu dan mengeluarkan

Perakuan Bangunan Khas sebagaimana yang dinyatakan dalam Jadual 6 kepada pemilik asal itu.

Penggantian sijil 8.

Jika perakuan yang memperakui penubuhan perbadanan pengurusan atau perakuan perbadanan pengurusan subsidiari yang dikeluarkan di bawah Akta atau

Sijil Formula Unit Syer yang dikeluarkan di bawah Kaedah-Kaedah ini, oleh Pengarah, hilang, rosak atau termusnah, Pengarah boleh, apabila permohonan bagi penggantian diterima, dan atas bayaran fi sebagaimana yang dinyatakan dalam Jadual 3, mengeluarkan penggantian perakuan yang memperakui penubuhan perbadanan pengurusan, perakuan perbadanan pengurusan subsidiari atau Sijil Formula Unit Syer itu kepada pemohon.

Fi 9.

(1)

Fi yang kena dibayar bagi apa-apa permohonan dan tindakan di bawah

Akta dan Kaedah-Kaedah ini hendaklah sebagaimana yang ditetapkan dalam Jadual 3.

(2)

Walau apa pun subkaedah (1), tiada fi kena dibayar berkenaan dengan—

(a)

permohonan oleh Perbadanan Labuan atau Kerajaan Persekutuan untuk memecah bahagi bangunan kos rendah; atau

(b)

permohonan oleh Perbadanan Labuan atau Kerajaan Persekutuan untuk mengklasifikasikan mana-mana bangunan sebagai suatu bangunan kos rendah.

Menteri yang berkenaan boleh mengenepikan, secara keseluruhan atau sebahagian, fi yang dinyatakan dalam Jadual 3 tertakluk kepada apa-apa kriteria dan syarat sebagaimana yang ditentukan oleh Menteri itu.

FORMULA UNIT SYER

Unit syer bagi petak adalah keluasan petak itu didarabkan dengan faktor pemberat bagi jenis petak dan faktor pemberat bagi keseluruhan petak lantai. Jika terdapat mana-mana petak aksesori, keluasan petak aksesori itu didarabkan dengan faktor pemberat bagi petak aksesori itu.

Jika terdapat lebih daripada satu petak aksesori, formula bagi pengiraan hendaklah terpakai bagi setiap petak aksesori dan kemudiannya hendaklah ditambahkan sewajarnya. Kedua-dua nilai bagi petak dan petak aksesori hendaklah ditambahkan bagi menentukan jumlah unit syer.

Formula pengiraan adalah seperti yang berikut:

Unit syer bagi petak = (A x F1 x F2) + (B x F3)

Unit syer bagi petak tanah = (A x 0.8) + (B x F3)

iaitu,

F1 ialah pemberat bagi jenis petak seperti yang dinyatakan dalam Jadual A

IN exercise of the powers conferred by section 81 of the Strata Titles Act 1985

[Act 318], as modified by the Federal Territory of Labuan (Extension and Modification of

Strata Title Act) Order 2009 [P.U. (A) 458/2009], the Minister makes the following rules:

Citation, commencement and application 1.

(1)

These rules may be cited as the Strata Titles (Federal Territory of

Labuan) Rules 2019.

(2)

These Rules come into operation on 1 January 2020.

(3)

These Rules shall apply to the Federal Territory of Labuan.

Interpretation 2.

In the Rules “share unit formula” means the formula used to calculate a share unit as specified in Schedule 2.

Application for Certificate of Share Unit Formula 3.

(1)

Any original proprietor shall, before making an application for the subdivision of building or land under section 9 of the Act, make an application for

Certificate of Share Unit Formula in Form A of Schedule 1.

(2)

The application under subrule (1) shall―

(a)

apply the calculation for the share unit formula as specified in

Schedule 2;

(b)

comply with any conditions as may be determined by the Director;

and

(c)

be accompanied with the fee as specified in Schedule 3.

(3)

Where the original proprietor is unable to submit any of the documents or information required to be submitted in Form A of Schedule 1, the Director may, after being satisfied that the original proprietor has provided sufficient reason, exempt the submission of such documents or information.

(4)

Upon being satisfied that the requirements under this rule have been complied with, the Director may approve the application and issue the Certificate of Share

Unit Formula as specified in Schedule 4 to the original proprietor.

(5)

Notwithstanding paragraph (2)(a), if the Director found that the share unit formula calculation shall cause the proposed share unit or the quantum of provisional share units assigned to the parcels or provisional block, as the case may be, are inequitable, the Director may apply other share unit formula which is equitable for that application.

Changes in Certificate of Share Unit Formula 4.

(1)

Where there is any change to the building plan that has been approved by

Perbadanan Labuan, or to the share unit, or to both, after the Certificate of Share Unit

Formula has been issued, the original proprietor shall make an application for a new

Certificate of Share Unit Formula under rule 3 to the Director and the requirements under subrules 3(1) and (2) shall be applicable.

(2)

Where any original proprietor proposes to change any information in the

Certificate of Share Unit Formula other than the information relating to the building plan and share unit referred to in subrule (1), the original proprietor shall make an application to change such information to the Director in the manner as may be determined by the

Director together with the payment of the fee as specified in Schedule 3.

(3)

For the purpose of subrule (2), the changes of information shall only be made to the original Certificate of Share Unit Formula without the issuance of new

Certificate of Share Unit Formula.

Deposit for an application for the subdivision of building involving provisional block 5.

(1)

Any proprietor applying for the subdivision of building involving provisional block under section 9A of the Act shall pay the deposit referred to in subparagraph 10(2)(c)(ii) of the Act as specified in item 6 of Schedule 3.

(2)

For the purpose of subrule (1), the Director shall issue a notice to the proprietor to demand for the payment of deposit by using Form B of Schedule 1.

(3)

The payment of deposit under subrule (1) shall be accompanied by the written statement referred to in subparagraph 10(2)(c)(ii) of the Act as specified in

Form C of Schedule 1.

Application to classify a building as low-cost building 6.

(1)

Any proprietor of any alienated land applying to classify a building to be a low-cost building under section 9B of the Act shall apply to the respective Minister in

Form D of Schedule 1.

(2)

The application under subrule (1) shall be accompanied with the fee as prescribed in Schedule 3.

(3)

Where the respective Minister is satisfied that the conditions have been complied with, the respective Minister may approve the application and classify a building to be a low-cost building.

(4)

Upon classifying a building to be a low-cost building, the respective

Minister shall issue the Certificate for Low-Cost Building as specified in Schedule 5 to the proprietor of the alienated land.

Application to classify any building as special building 7.

(1)

Any original proprietor may make an application to classify any building occupied before January 2020 as a special building to the respective Minister in

Form E of Schedule 1.

(2)

The respective Minister may classify the building referred to in subrule (1)

as a special building provided that—

(a)

the building has been used for residential, commercial or industrial purpose;

(b)

the building has been used for commercial and residential purposes;

or;

(c)

the building has been used for any other purposes which the respective Minister thinks fit to be classified as a special building.

(3)

The application under subrule (1) shall be accompanied by the fee as specified in Schedule 3.

(4)

Upon being satisfied that the requirements under this rule have been complied with, the respective Minister may approve the application and issue the

Certificate of Special Building as specified in Schedule 6 to the original proprietor.

Replacement of certificate 8.

If the certificate certifying the establishment of the management corporation or certificate of subsidiary management corporation issued under the Act or the

Certificate of Share Unit Formula issued under these Rules, by the Director, is lost, defaced or destroyed, the Director may, upon receipt of an application for replacement and upon payment of the fee as specified in Schedule 3, issue a replacement of the certificate certifying the establishment of the management corporation, certificate of subsidiary management corporation or Certificate of Share Unit Formula to the applicant.

Fees 9.

(1)

The fees payable for any other applications and actions under the Act and these Rules shall be as prescribed in Schedule 3.

(2)

Notwithstanding subrule (1)), no fees shall be payable in respect of—

(a)

an application by Perbadanan Labuan or the Federal Government to subdivide a low-cost building; or

(b)

an application by Perbadanan Labuan or the Federal Government to classify any building to be a low-cost building.

(3)

The respective Minister may waive, in whole or in part, the fees prescribed in Schedule 3 subject to such criteria and conditions as the Minister may determine.

SHARE UNIT FORMULA

The share units of a parcel are the area of that parcel multiplied by the weightage factor for that type of parcel and the weightage factor for the entire floor parcel. If there is any accessory parcel, the area of that accessory parcel is multiplied by the weightage factor for that accessory parcel.

If there are more than one accessory parcels, the formula for calculation shall be applicable to each accessory parcel and it shall then be added accordingly. Both the value of the parcel and accessory parcel shall be added to determine the total share units.

The calculation formula is as follows:
