PADA menjalankan kuasa yang diberikan oleh seksyen 73 Akta Kumpulan Wang Simpanan Pekerja 1991 [Akta 452], Lembaga membuat kaedah-kaedah yang berikut: Nama dan permulaan kuat kuasa

Kaedah-kaedah ini bolehlah dinamakan Kaedah-Kaedah Kumpulan

Wang Simpanan Pekerja (Pindaan) (No. 2) 2022.

EMPLOYEES PROVIDENT FUND (AMENDMENT) (NO. 2) RULES 2022

Opening note

Preamble

IN exercise of the powers conferred by section 73 of the Employees Provident Fund Act 1991 [Act 452], the Board makes the following rules: Citation and commencement 1.

(1)

These rules may be cited as the Employees Provident Fund

(Amendment) (No. 2) Rules 2022.

(2)

These Rules come into operation on 1 July 2022.

Amendment of rule 41 2.

The Employees Provident Fund Rules 1991 [P.U. (A) 493/1991], which are referred to as “the principal Rules” in these Rules, are amended in rule 41 by deleting subrules (10F), (10N), (10O), (10P), (10Q), (10R), (10S), (10T), (10ZB), (10ZC), (10ZD),

(10ZE), (10ZF), (10ZG), (10ZH), (10ZI), (10ZJ), (10ZK), (10ZL), (10ZM) and (10ZN).

Savings 3.

(1)

Any notice of withdrawal made under paragraph 54(6)(k), (l), (m) or (n) of the Act on or before 31 March 2021, 30 June 2021, 30 September 2021 or 30 April 2022, respectively, which is pending before the date of coming into operation of these Rules shall, on the date of coming into operation of these Rules, be dealt with in accordance with the provisions of the principal Rules as if the principal Rules had not been amended by these Rules.

Any authorization, direction, decision or other executive acts made, given or done in relation to subrule (10F), (10N), (10O), (10P), (10Q), (10R), (10S), (10T), (10ZB),

(10ZC), (10ZD), (10ZE), (10ZF), (10ZG), (10ZH), (10ZI), (10ZJ), (10ZK), (10ZL), (10ZM) or

(10ZN) before the date of coming into operation of these Rules shall, on the date of coming into operation of these Rules, continue in full force and effect in relation to

the member of the Fund to whom the authorization, direction, decision or other executive acts applied until amended, repealed, rescinded, revoked or replaced.

Any investigation or legal proceedings instituted in relation to subrule (10F), (10N), (10O), (10P), (10Q), (10R), (10S), (10T), (10ZB), (10ZC), (10ZD),

(10ZE), (10ZF), (10ZG), (10ZH), (10ZI), (10ZJ), (10ZK), (10ZL), (10ZM) or (10ZN) which is pending before the date of coming into operation of these Rules shall, on the date of coming into operation of these Rules, be continued in accordance with the provisions of the principal Rules as if the principal Rules had not been amended by these Rules.
