Preamble

  1. PADA menjalankan kuasa yang diberikan oleh perenggan 67(2)(b) Akta Penjara 1995 [Akta 537], Menteri membuat kaedah-kaedah yang berikut: Nama

Seksyen 2

Kaedah-Kaedah Lokap, 1953 [L.N. 328/1953], yang disebut “Kaedah-Kaedah ibu”

dalam Kaedah-Kaedah ini, dipinda dalam kaedah 1 dengan menggantikan perkataan

“Lockup Rules 1953” dengan perkataan “Lock-up Rules 1953”.

Pindaan am

Seksyen 3

Kaedah-Kaedah ibu dipinda—

(a)

dengan menggantikan perkataan “lockup” di mana-mana jua terdapat dengan perkataan “lock-up”;

(b)

dengan menggantikan perkataan “lockups” di mana-mana jua terdapat dengan perkataan “lock-ups”;

(c)

dengan menggantikan perkataan

“Officer-in-Charge”

di mana-mana jua terdapat dengan perkataan “Officer in Charge”; dan

(d)

dengan menggantikan perkataan “Deputy-Officer-in-Charge” di mana-mana jua terdapat dengan perkataan “Deputy Officer in Charge”.

Seksyen 8

Kaedah-Kaedah ibu dipinda dengan memasukkan selepas kaedah 13

“Clothing, footwear and other necessities.

Seksyen 13A

Every prisoner shall be supplied with clothing, footwear and other necessities as determined by the Officer in Charge.”.

Kaedah 14 Kaedah-Kaedah ibu dipinda dengan menggantikan perkataan

“Notices in English, Romanised Malay, Chinese and Tamil” dengan perkataan

“Notices in the national language and the English language”.

Seksyen 12

Kaedah 18 Kaedah-Kaedah ibu dipinda dengan menggantikan perkataan

“shall so far as practicable” dengan perkataan “may”.

Seksyen 13

Penggantian kaedah 19

Kaedah-Kaedah ibu dipinda dengan menggantikan kaedah 19 dengan kaedah yang berikut:

“Unauthorised article.

Seksyen 19

(2)

No person shall without authority—

(a)

convey or throw into, or deposit in, a lock-up; or

(b)

convey to any prisoner, or deposit with a view to its coming into the possession of any prisoner, any unauthorised article which includes money, clothing, food, drinks, tobacco, letter, paper, books or tools.

(3)

Any unauthorised article conveyed, thrown or deposited to any prisoner in subrule (2)

may be confiscated by the Officer in Charge.’’.

Seksyen 17

Penggantian kaedah 36

Kaedah-Kaedah ibu dipinda dengan menggantikan kaedah 36 dengan kaedah yang berikut:

“Notification of illness, injury or mental disorder.

Seksyen 36

A police officer shall without delay report to the Officer in Charge or Deputy Officer in Charge any case of apparent illness, injury or mental disorder of any prisoner, which the Officer in Charge or Deputy Officer in Charge shall then report to the Medical Officer.”.

Seksyen 18

Kaedah-Kaedah ibu dipinda dengan memasukkan selepas kaedah 36 kaedah yang berikut:

“Infectious or contagious disease.

Seksyen 36A

The Officer in Charge shall without delay, if any prisoner is found to be suffering from or have, any infectious or contagious disease, or is in a verminous condition—

(a)

take all necessary measures to prevent the spread of the disease or condition to other prisoners; and

(b)

refer the prisoner to the Medical Officer.”.

Pindaan kaedah 40

Seksyen 19

Kaedah 40 Kaedah-Kaedah ibu dipinda—

(a)

dengan menggantikan perkataan “the President of a Sessions Court”

dengan perkataan “a Sessions Court Judge”; dan

(b)

dengan memotong perkataan “for transmission to the Mentri Besar of the State or the Resident Commissioner of the Settlement”.

Seksyen 20

Kaedah 47 Kaedah-Kaedah ibu dipinda—

(b)

dengan menomborkan semula subkaedah 47(1) sedia ada sebagai kaedah 47.

PRISON ACT 1995

LOCK-UP (AMENDMENT) RULES 2025

Opening note

Preamble

  1. IN exercise of the powers conferred by paragraph 67(2)(b) of the Prison Act 1995 [Act 537], the Minister makes the following rules: Citation 1. These rules may be cited as the Lock-up (Amendment) Rules 2025. Amendment of rule 1 2. The Lockup Rules, 1953 [L.N. 328/1953], which are referred to as the “principal Rules” in these Rules, are amended in rule 1 by substituting for the words “Lockup Rules 1953” the words “Lock-up Rules 1953”. General amendment 3. The principal Rules are amended—

(a)

by substituting for the word “lockup” wherever appearing the words

“lock-up”;

(b)

by substituting for the word “lockups” wherever appearing the words

“lock-ups”;

(c)

by substituting for the words “Officer-in-Charge” wherever appearing the words “Officer in Charge”; and

(d)

by substituting for the words “Deputy-Officer-in-Charge” wherever appearing the words “Deputy Officer in Charge”.

Amendment of rule 9 4.

Rule 9 of principal Rules is amended by substituting for the word “shall”

the word “may”.

Amendment of rule 9A

Seksyen 5

Rule 9A of the principal Rules is amended by substituting for the word “shall”

the word “may”.

Amendment of rule 12 6.

Rule 12 of the principal Rules is amended by substituting for the words

“the preceding day” the words “the same date”.

Substitution of rule 13 7.

The principal Rules are amended by substituting for rule 13 the following rule:

“Bedding.

Seksyen 13

Every prisoner may be supplied with bedding which shall be changed and washed as often as may be necessary.”.

New rule 13A

Seksyen 8

The principal Rules are amended by inserting after rule 13 the following rule:

“Clothing, footwear and other necessities.

Seksyen 13A

Every prisoner shall be supplied with clothing, footwear and other necessities as determined by the Officer in Charge.”.

Amendment of rule 14 9.

Rule 14 of the principal Rules is amended by substituting for the words

“Notices in

English,

Romanised

Malay,

Chinese and

Tamil”

the words

Amendment of rule 15

Seksyen 10

Rule 15 of the principal Rules is amended by substituting for the words

Deletion of rule 17

The principal Rules are amended by deleting rule 17.

Amendment of rule 18

Seksyen 12

Rule 18 of the principal Rules is amended by substituting for the words

Seksyen 13

Substitution of rule 19

The principal Rules are amended by substituting for rule 19 the following rule:

“Unauthorised article.

Seksyen 19

(1)

No prisoner shall have in his possession any unauthorised article and any such article found in his possession shall be confiscated by the Officer in Charge.

(2)

No person shall without authority—

(a)

convey or throw into, or deposit in, a lock-up; or

(b)

convey to any prisoner, or deposit with a view to its coming into the possession of any prisoner, any unauthorised article which includes money, clothing, food, drinks, tobacco, letter, paper, books or tools.

(3)

Deletion of rules 26, 27 and 28

Seksyen 14

The principal Rules are amended by deleting rules 26, 27 and 28.

Amendment of rule 30

Seksyen 15

Rule 30 of the principal Rules is amended by deleting the words

“on restricted diet”.

Seksyen 16

Deletion of rule 31

The principal Rules are amended by deleting rule 31.

Seksyen 17

Substitution of rule 36

The principal Rules are amended by substituting for rule 36 the following rule:

“Notification of illness, injury or mental disorder.

A police officer shall without delay report to the Officer in Charge or Deputy Officer in Charge any case of apparent illness, injury or mental disorder of any prisoner, which the Officer in Charge or Deputy Officer in Charge shall then report to the Medical Officer.”.

New rule 36A

Seksyen 18

The principal Rules are amended by inserting after rule 36 the following rule:

Seksyen 19

Amendment of rule 47

Seksyen 20
