Suatu permohonan untuk mendaftar sebagai majikan di bawah subseksyen 41(1) Akta hendaklah dibuat dengan mengemukakan kepada

Lembaga suatu notis sebagaimana yang ditentukan oleh Lembaga.

Lembaga hendaklah mendaftarkan majikan itu dengan—

(a)

memberikan suatu nombor rujukan kepada majikan itu;

Setiap majikan yang berdaftar di bawah kaedah ini hendaklah memaklumkan kepada Lembaga mengenai apa-apa perubahan maklumat dalam tempoh empat belas hari dari tarikh perubahan maklumat itu.”.

Kaedah-Kaedah ibu dipinda dengan menggantikan kaedah 11 dengan kaedah yang berikut:

“Pembayaran caruman oleh majikan 11.

(1)

Apa-apa caruman yang kena dibayar oleh majikan di bawah

Akta berkenaan dengan semua pekerjanya hendaklah dikemukakan kepada

Lembaga dalam tempoh yang ditetapkan bersama-sama dengan suatu notis pembayaran sebagaimana yang ditentukan oleh Lembaga.

Lembaga boleh menolak pembayaran caruman di bawah subkaedah (1) jika:

(a)

amaun caruman yang dibayar adalah kurang daripada amaun yang dinyatakan dalam notis pembayaran itu;

maklumat yang dinyatakan dalam notis pembayaran itu adalah tidak lengkap atau tidak teratur; atau

(c)

Lembaga mendapati terdapat keadaan yang dipertimbangkan wajar atau perlu untuk menolak pembayaran itu.

Lembaga hendaklah mengkreditkan caruman yang diterima ke dalam akaun pekerja yang berkenaan dan memberikan kepada majikan suatu penyata yang berhubungan dengan pengkreditan caruman itu.

Jika seseorang majikan mendapati terdapatnya apa-apa kesilapan dalam penyata yang diberikan oleh Lembaga di bawah subkaedah (3), majikan itu hendaklah, dalam tempoh satu bulan dari tarikh penerimaan penyata itu, memaklumkan Lembaga secara bertulis berhubung dengan kesilapan itu.

Lembaga tidak akan bertanggungan terhadap apa-apa kesilapan dalam penyata yang diberikan oleh Lembaga di bawah subkaedah (3)

jika tiada pemakluman dibuat mengikut subkaedah (4).

Walau apa pun subkaedah (4), jika pemakluman yang berhubungan dengan apa-apa kesilapan dikemukakan selepas tamatnya tempoh yang dinyatakan dalam subkaedah (4), Lembaga boleh membuat penyelarasan terhadap akaun pekerja yang berkenaan sebagaimana yang difikirkannya sesuai.”.

EMPLOYEES PROVIDENT FUND (AMENDMENT) RULES 2025

  1. IN exercise of the powers conferred by section 73 of the Employees Provident Fund Act 1991 [Act 452], the Board makes the following rules: Citation and commencement 1.

(1)

These rules may be cited as the Employees Provident Fund

(Amendment) Rules 2025.

These Rules come into operation on 1 October 2025.

Amendment of rule 2 2.

The Employees Provident Fund Rules 1991 [P.U. (A) 493/1991], which are referred to as the “principal Rules” in these Rules, are amended in rule 2—

(a)

by inserting after the definition of “approved bank” the following definition:

‘ “identification document” means—

an identity card issued under the National Registration Act 1959

[Act 78]; or

(b)

a passport or any form of valid document of identity issued by any government for the purpose of travel across international boundaries;’;

by deleting the definition of “identity card”;

in the national language text, by substituting for the full stop at the end of the definition of “spouse” a semicolon; and

Substitution of rule 9 5.

The principal Rules are amended by substituting for rule 9 the following rule:

“Registration as employer 9.

(1)

An application to register as an employer under subsection 41(1)

of the Act shall be made by submitting to the Board a notice as determined by the Board.

After receiving the application under subrule (1), the Board shall register such employer by—

(b)

issuing a certificate of registration to such employer; and

(c)

establishing an account with the Fund in respect of such employer.

(3)

Every employer registered under this rule shall notify the Board of any change of information within the period of fourteen days from the date of such change of information.”.

Substitution of rule 11 6.

The principal Rules are amended by substituting for rule 11 the following rule:

“Payment of contributions by the employer 11.

(1)

Any contributions which is due by an employer under the Act in respect of all his employees shall be submitted to the Board within the prescribed period together with a notice of payment as determined by the Board.

(2)

The Board may refuse the payment of contributions under subrule (1) if:

(a)

the amount of contributions paid is less than the amount stated in the notice of payment;

(b)

the information stated in the notice of payment is incomplete or not in order; or

Suggest a correction

(c)

the Board discovers that there is a situation in which it is considered expedient or necessary to refuse the payment.

(3)

The Board shall credit the contributions received into the account of the respective employee and provide the employer with a statement relating to the crediting of the contributions.

(4)

If an employer discovers any error in the statement provided by the Board under subrule (3), the employer shall, within a period of one month from the date of receipt of the statement, notify the Board in writing in relation to the error.

(5)

The Board shall not be liable for any error in the statement provided by the Board under subrule (3) if no notification is made in accordance with subrule (4).

(6)

Notwithstanding subrule (4), where a notification relating to any error is submitted after the expiry of the period specified in subrule (4), the Board may make adjustments to the account of the respective employee as it deems fit.”.

The principal Rules are amended by substituting for rule 12 the following rule:

“Registration of member of the Fund 12.

The registration as a member of the Fund may be made by—

(c)

any person not being an employer to a person not being an employee, whether or not within the meaning of the Act; or

(d)

any person who intends to become a member of the Fund, by submitting to the Board a notice as determined by the Board.

(2)

The Board may, without any application being made under subrule (1), register any employee or person as a member of the Fund.”.

The principal Rules are amended by substituting for rule 13 the following rule:

“Verification of identity of member of the Fund 13.

(1)

For the purpose of registration under subrule 12(1), a person shall—

(b)

affix his thumb impression in the manner as determined by the Board or provide any other form of self-identification as the Board thinks appropriate.

(2)

For the purpose of registration under subrule 12(2), the Board may accept any document, information or any form of self-identification as the

Board thinks appropriate to verify the identity of such person.”.

The principal Rules are amended by substituting for rule 14 the following rule:

“Duty to provide particulars and documents 14.

(1)

Any employee or person who is being registered under rule 12

shall provide all particulars and documents required for the purpose of completing his registration as a member of the Fund.

Any employee or person who—

(a)

fails to provide any particular or document as required under subrule (1);

(b)

refuses to produce his identification document as required under paragraph 13(1)(a);

refuses to affix his thumb impression or provide other form of self-identification as required under paragraph 13(1)(b); or

(d)

refuses to provide any document, information or any form of self-identification, shall be guilty of an offence and shall, on conviction, be liable to a fine not exceeding two hundred and fifty ringgit.”.

The principal Rules are amended by substituting for rule 18 the following rule:

“Incomplete or inaccurate record of member of the Fund

(1)

If in the opinion of the Board the record of the member of the

Fund referred to in rules 12 and 13 is incomplete or inaccurate or the thumb impression or other form of self-identification is insufficiently clear to identify the employee, the Board may notify the employer and the employer shall obtain, complete and submit to the Board, the record of the member of the

Fund containing the information which has been updated within the period of fourteen days from the date of notification made by the Board to the employer.

Any employer who fails to comply with subrule (1) shall be guilty of an offence.”.

The principal Rules are amended by substituting for rule 23 the following rule:

“Statement of wages 23.

A statement of wages prepared and furnished to each employee pursuant to subsection 42(1) of the Act shall contain the following information—

amount deducted for the Fund’s contributions;

full name of employer or employer’s representative, his signature and date of issuance of the statement of wages; and

in the case of an employee who is not a Malaysian citizen, work permit number.”.

The principal Rules are amended by substituting for rule 24 the following rule:

“Duty of employer to prepare and keep register of employees 24.

(1)

A register of employees prepared and kept pursuant to subsection 42(2) of the Act shall contain the following information—

Employees Provident Fund’s membership number;

identification document type and number and, in the case of an employee who is not a Malaysian citizen, includes the date of expiry;

amount deducted for the Fund’s contributions;

in the case of an employee who is not a Malaysian citizen, work permit type, number and the date of expiry.

(2)

In any legal proceedings, the register of employees provided under subrule (1) shall be prima facie evidence of the existence and truth of contents of the registration of such employee.”.

The principal Rules are amended by deleting rule 25.

Substitution of rule 27 14.

The principal Rules are amended by substituting for rule 27 the following rule:

“Payments of contributions or money into the Fund 27.

Any payment of contributions or money by any person into the Fund shall be submitted together with a notice as determined by the Board—

(i)

to any of the Board’s office or at any other place as determined by the Board; or

in any other manner as determined by the Board.”.

The principal Rules are amended by substituting for rule 28 the following rule:

“Employer who fails to make payment within the prescribed period 28.

Where any employer fails to pay any contributions either wholly or partially within the prescribed period and the Inspector has assessed the

contributions due from the employer, the employer shall submit to the Board an arrears remittance statement in a notice as determined by the Board together with any outstanding contributions.”.

The principal Rules are amended by substituting for rule 35 the following rule:

“Particulars of nomination 35.

Any member of the Fund who makes a nomination pursuant to rule 34

shall submit to the Board a notice relating to the nomination containing the following information:

full name of person or name of institution nominated;

the share in respect of the person or institution nominated; and

Rule 41 of the principal Rules are amended by substituting for subrule (7)

Where a notice of withdrawal is made on the ground that a member of the Fund who is not a Malaysian citizen is about to leave Malaysia under paragraph 54(1)(e) or 70C(1)(c) of the Act,

“Member of the Fund who is not a Malaysian citizen and is about to leave Malaysia.

such member of the Fund shall submit to the Board a notice of withdrawal together with any document as determined by the Board.”.
