TOURISM INDUSTRY (COMPOUNDING OF OFFENCES)
(AMENDMENT) REGULATIONS 2025
IN exercise of the powers conferred by section 34
of the Tourism Industry Act 1992 [Act 482], the Minister makes the following regulations:
Citation and commencement 1.
(1)
These regulations may be cited as the
Tourism
Industry
(Compounding of Offences) (Amendment) Regulations 2025.
(2)
Except for regulation 4, these Regulations come into operation on 10 October 2025.
(3)
Regulation 4 of these Regulations is deemed to have come into operation on 1 July 2025.
Substitution of regulation 2 2.
The
Tourism
Industry (Compounding of Offences) Regulations 1992
[P.U. (A) 267/1992], which are referred to as the “principal Regulations” in these
Regulations, are amended by substituting for regulation 2 the following regulation:

(1)
The offences specified in the First Schedule are prescribed to be compoundable offences.
(2)
The compoundable offences may be compounded with the written consent of the Public Prosecutor in Form 1
of the Second Schedule.”.

New regulations 2A and 2B
3.
The principal Regulations are amended by inserting after regulation 2
the following regulation:
2A.
(1)
Upon receipt of any information or complaint that a compoundable offence has been committed, the Commissioner may, with the written consent of the Public Prosecutor, issue an offer to compound the offence in Form 2 of the
Second Schedule.
(2)
An offer to compound an offence shall be valid for a period of twenty-one days starting from the date the offer is received by the person to whom the offer is made or such extended period as the Commissioner may grant in writing, and if full payment of the sum offered is made on or before the expiry of the period of twenty-one days or such extended period granted, no further proceedings shall be taken against the person who committed such offence.
2B.
A person who accepts an offer to compound a compoundable offence shall accept the offer in Form 3 of the Second Schedule and return the Form 3 to the Commissioner.”.
Substitution of regulation 3 4.
(1)
The principal Regulations are amended by substituting for regulation 3
the following regulation:

If an offer to compound an offence is accepted by the person to whom the offer is made, the person shall pay the compound by—

(a)
cash, money order, postal order or bank draft crossed with the words “Account Payee Only”
payable to the Commissioner or any officer authorized in writing by the Commissioner and shall be delivered personally by hand or sent by prepaid registered post to the Commissioner or any officer authorized in writing by the Commissioner to the address Tourism Licensing and Enforcement
Division, Ministry of Tourism, Arts and Culture,
Level 1, No. 2, Tower 1, Jalan P5/6, Precinct 5,
Federal Government Administrative Centre,
62200 Putrajaya; or
(b)
credit card, debit card, charge card or any other forms of electronic fund transfer payable into the account of the
Commissioner.
(2)
The Commissioner or any officer authorized in writing by the Commissioner shall issue an official receipt for every payment received under subregulation (1) to the person to whom the offer to compound an offence is made.
(3)
An official receipt issued under subregulation (2)
shall include any electronic receipt if the payment is made through an electronic fund transfer as specified in paragraph (1)(b).”.

New regulation 3A
5.
The principal Regulations are amended by inserting after regulation 3
the following regulation:
3A.
If no payment of the compound offered is made within the period specified in subregulation 2A(2), prosecution may be instituted without further notice.”.
Deletion of regulation 4 6.
The principal Regulations are amended by deleting regulation 4.
Substitution of Schedule 7.
The principal Regulations are amended by substituting for the Schedule the following schedules:
