JOHOR PORT AUTHORITY (PASIR GUDANG PORT) (SCALE OF CHARGES)
(AMENDMENT) BY-LAWS 2025
IN exercise of the powers conferred by sections 16 and 29 of the Port Authorities
Act 1963 [Act 488], the Johor Port Authority, with the approval of the Minister, makes the following by-laws:
Citation and commencement 1.
(1)
These by-laws may be cited as the Johor Port Authority (Pasir Gudang
Port) (Scale of Charges) (Amendment) By-laws 2025.
(2)
These By-laws come into operation on 29 October 2025.
Amendment of by-law 2 2.
The Johor Port Authority (Pasir Gudang Port) (Scale of Charges) By-laws 2011
[P.U. (A) 175/2011], which are referred to as the “principal By-laws” in these By-laws, are amended in by-law 2—
(a)
by deleting the definition of “EMC”; and
(b)
by inserting after the definition of “Authority’s wharf” the following definition:
‘ “BBBT” means the bulk and break bulk terminal within the port premises;’.
Amendment of by-law 3 3.
The principal By-laws are amended in by-law 3—
(a)
in subparagraph (r), by deleting the word “and” at the end of the subparagraph;

in subparagraph (s), by substituting for the full stop at the end of the subparagraph the words “; and”; and
(c)
by inserting after subparagraph (s) the following subparagraph:

Amendment of by-law 19 4.

New by-law 21B
5.
The principal By-laws are amended by inserting after by-law 21A the following by-law:
“Lifting charge for containers received via rail or road 21B.
A port user shall pay the lifting charge for containers to the Authority for the lifting of any container received via rail or road at the rate as specified in Part 33 of the First Schedule.”.
Substitution of by-law 28 6.
The principal By-laws are amended by substituting for by-law 28 the following by-law:
“Handling charge for dry bulk cargo, break bulk cargo and liquid bulk cargo 28.
A port user shall pay the handling charge to the Authority for the use of bulk cargo handling equipment in handling dry bulk cargo, break bulk cargo and liquid bulk cargo at the rate as specified in Part 14 of the Second Schedule.”.
Amendment of by-law 29 7.
The principal By-laws are amended in by-law 29—
(a)
by substituting for subparagraph (a) the following subparagraph:
“(a)
weighbridge charge;”;
(b)
in subparagraph (p), by deleting the word “and” at the end of the subparagraph;
(c)
in subparagraph (q), by substituting for the full stop at the end of the subparagraph a semicolon; and

by inserting after subparagraph (q) the following subparagraphs:

Amendment of by-law 30 8.
The principal By-laws are amended in by-law 30—

in the shoulder note, by deleting the words “and weighing”; and
(b)
by deleting the words “and weighing”.
Amendment of by-law 32 9.
The principal By-laws are amended in by-law 32—
(a)
by substituting for subparagraph (1)(a) the following subparagraph:
“(a)
the import, export or transhipment of laden normal containers containing non-dangerous goods or dangerous goods Group III or empty normal containers at the rate as specified in item 1 of
Part 4 of the Third Schedule;"; and
(b)
in subparagraph (1)(b), by substituting for the words “the OOG containers and damaged containers” the words “the OOG containers or damaged containers”.
Amendment of by-law 33 10.
The principal By-laws are amended in by-law 33 by inserting after the words
“the reefer container services charge” the words “which includes connecting or disconnecting of electricity supply and inspecting or monitoring of the reefer container”.

The principal By-laws are amended in by-law 46—
(a)
in subparagraph (d), by deleting the word “and” at the end of the subparagraph;
(b)
in subparagraph (e), by substituting for the full stop at the end of the subparagraph a semicolon; and

by inserting after subparagraph (e) the following subparagraphs:
“(f)
the charge for correcting, updating or amending the information of the type of cargo of a container, incorrect temperature of the reefer container, ISO code, final destination of a container, shipper or consignee of a container, seal number of a container or any other information relating to a container at the rate as specified in item 6 of Part 21 of the Third Schedule;
(g)
the charge for inter terminal movement of a container within the port premises at the rate as specified in item 7 of Part 21 of the Third Schedule; and
(h)
the charge for a bathtub trailer at the rate as specified in item 8
of Part 21 of the Third Schedule.”.
New by-laws 46A, 46B and 46C
12.
The principal By-laws are amended by inserting after by-law 46 the following by-laws:
“BBBT services charge 46A.
A port user shall pay the BBBT services charge to the Authority for the following services:

supply of shovel and excavator for vessel operation or non-vessel operation at the rate as specified in Part 22 of the Third Schedule;
(b)
supply of transport service for indirect handling of cargo at the rate as specified in Part 23 of the Third Schedule;
(c)
supply of mobile shore crane at the rate as specified in item 1 of
Part 24 of the Third Schedule;
(d)
supply of forklift at the rate as specified in item 2 of Part 24 of the Third Schedule;
(e)
supply of manpower at the rate as specified in Part 25 of the Third Schedule; and
(f)
supply of handling gears at the rate as specified in Part 26 of the Third Schedule.
Security and emergency services charge 46B.
A port user shall pay the security and emergency services charge to the
Authority for the following services:
(a)
security services at the rate as specified in item 1 of Part 27 of the Third Schedule;
(b)
fire officer or fire assistant services at the rate as specified in item 2 of Part 27 of the Third Schedule;
(c)
ambulance services at the rate as specified in item 3 of Part 27
of the Third Schedule;

(d)
fire fighting equipment and materials at the rate as specified in item 4 of Part 27 of the Third Schedule; and
(e)
fire officer or fire assistant for the purposes of stand-by, surveillance and patrolling services for containerized dangerous goods Group I or Group II at the rate as specified in item 5
of Part 27 of the Third Schedule.
Ancillary services charge 46C.
A port user shall pay the ancillary services charge to the Authority for the following services:
(a)
supply of clean water at the rate as specified in item 1 of Part 28
of the Third Schedule;
(b)
wildlife response at the rate as specified in item 2 of Part 28 of the Third Schedule;
(c)
permit to work at the rate as specified in item 3 of Part 28 of the Third Schedule; and
(d)
safety induction program at the rate as specified in item 4 of
Part 28 of the Third Schedule.”.
