rumah ibadat ertinya mana-mana bangunan yang diluluskan oleh kerajaan di bawah mana-mana undang-undang bertulis atau pengoperasiannya diluluskan oleh badan keagamaan yang berkaitan yang diiktiraf oleh kerajaan untuk memberikan kelulusan bagi rumah ibadat dan termasuklah bangunan lain yang berkaitan dalam pembangunan rumah ibadat itu;

Akta Pendidikan 1996 [Akta 550] dan termasuklah mana-mana sekolah yang menyediakan pendidikan menggunakan

sekolah khas ertinya sekolah yang menyediakan pendidikan khas untuk murid berkeperluan pendidikan khas dan ditubuhkan di bawah perenggan 34(1)(b) Akta Pendidikan 1996;

bangunan komuniti ertinya mana-mana bangunan yang dibina oleh atau dibina dan diserahkan kepada Kerajaan Persekutuan, Kerajaan Negeri atau mana-mana pihak berkuasa tempatan untuk kegunaan anggota masyarakat bagi maksud sosial, pendidikan atau rekreasi;

  1. IN exercise of the powers conferred by subsection 172(2) and paragraph 179(c) of the Water Services Industry Act 2006 [Act 655], the Minister makes the following regulations: Citation and commencement 1.

(1)

These regulations may be cited as the Water Services Industry

(Sewerage Capital Contribution Fund) (Amendment) Regulations 2025.

Regulations 2011 [P.U. (A) 1/2011], which are referred to as the “principal Regulations”

in these Regulations, are amended in regulation 2—

by inserting after the words “government-aided school,” the words

in paragraph (b), by inserting after the semi colon at the end of the paragraph the word “or”; and

“(c)

residential building which is intended for sale and has been sold, excluding specific buildings, the sale and purchase agreement to which it relates cannot be submitted by the developer, means the highest selling price of that particular unit that has been submitted to the Controller for the application of an advertisement and sale permit under the Housing Development (Control and Licensing)

Regulations 1989;”;

in paragraph (a), by deleting the word “or” at the end of the paragraph;

in paragraph (b), by substituting for the comma at the end of the paragraph the words “; or”;

residential building which is intended for sale but has not been sold, excluding specific buildings, the construction of which is not subject to the requirement for an advertisement and sale permit under the Housing Development (Control and Licensing)

by substituting for the words “three months” the words

“six months”; and

(v)

in the national language text, by inserting before the words

in the definition of “government project”, by inserting after the words

“local authority” the words “, including the project partially financed by the Federal Government, State Government, statutory body or local authority for the public interest or public use, and a utility project which is developed by the government-owned companies”.

Amendment of regulation 4 3.

Regulation 4 of the principal Regulations is amended—

Substitution of regulation 6 4.

The principal Regulations are amended by substituting for regulation 6

the following regulation:

“Mode of payment 6.

A contribution to the Fund shall be made to the Commission—

by a cashier’s order, banker’s order or bank draft in the name of “Suruhanjaya Perkhidmatan Air Negara

(SPAN) – KWSMP” and crossed with the words

“Account Payee Only”, and shall be delivered personally

or sent by registered post to the address of the

Commission; or

(b)

through an online fund transfer to the

Commission’s account.

An official receipt may be issued by the Commission to the developer or the person who makes the contribution to the Fund on receipt of payment of the contribution.”.

The principal Regulations are amended by substituting for the First Schedule the following schedule:

[Act 550] and includes any school that provides an education using the National Curriculum as prescribed by the Ministry of Education; or

a government-aided school means a school in receipt of capital grant and full grant-in-aid, but does not include international schools and expatriate schools;

a special school means a school that provides a special education for pupil with special educational needs and established under paragraph 34(1)(b)

of the Education Act 1996;

a community building means any building constructed by or constructed by and handed over to the Federal Government,

State Government or any local authority for the use of members of community for social, educational or recreational purposes;

(f)

charitable building means any building constructed solely for charitable purposes—

and is not based on profit-making and granted with a tax exemption by the Inland Revenue Board of Malaysia; or

(ii)

and is recognized by the Federal Government or the State

Government under any written law to carry out charitable works.”.
