(BANK PEMBANGUNAN MALAYSIA BERHAD) (EXEMPTION) ORDER 2025

Opening note

Preamble

IN exercise of the powers conferred by section 122 of the Development Financial Institutions Act 2002 [Act 618], the Minister, on the recommendation of the Bank, makes the following order: Citation and commencement 1.

This order may be cited as the Development Financial Institutions

(Bank Pembangunan Malaysia Berhad) (Exemption) Order 2025.

(2)

This Order is deemed to have come into operation on 12 August 2024.

Exemption 2.

The Minister exempts Bank Pembangunan Malaysia Berhad (Company

Registration Number: 16562-K), a company incorporated under the Companies Act 2016

[Act 777] and having its registered office at Level 30, Menara Bank Pembangunan,

Plaza Conlay, Jalan Conlay, 50450 Kuala Lumpur, from the application of subsection 28(3A) of the Act for the purpose of granting a Tawarruq Financing for Fixed Working Capital (Account Number: 00153300022) for a period of five years and a Bank Guarantee-i (Account Number: 00180100129) for a period of six years to Lumut Naval Shipyard Sdn. Bhd. (Company Registration Number: 199001007732

(199302-K)), a company incorporated under the Companies Act 2016 whose shares are wholly owned indirectly by a member of Bank Pembangunan Malaysia Berhad who is the Minister of Finance (“Corporation”) incorporated under subsection 3(1)

of the Minister of Finance (Incorporation) Act 1957 [Act 375].
