Section 1

This Enactment may be cited as the Public Service Commission (Remuneration)

Enactment, 1963 and shall be deemed to have come into operation on the thirty-first day of

August, 1963.

Interpretation.

Section 2

In this Enactment, unless the context otherwise requires-

“Chairman” and “Deputy Chairman” mean respectively the Chairman and any Deputy

Chairman of the Commission;

“the Commission” means the Public Service Commission of the State;

“the former Commission” means the Public Service Commission established by the

North Borneo (Public Service Commission) Order in Council, 1963;

“member” means any member of the Commission other than the Chairman.

Remuneration of Chairman.

The remuneration of the Chairman shall consist of such salary, allowances and privileges as the Cabinet may from time to time determine.

allowances as the Cabinet may from time to time determine.

Acting allowance.

Section 4A

Where, during any period, the Chairman has been granted leave of absence by the

Yang di-Pertua Negeri or is unable, owing to his absence from the State, illness or any other cause, to discharge his functions as Chairman, any person appointed to act as Chairman during that period shall be paid such sum as may be determined by the Cabinet:

Provided that the sum payable to such person shall not exceed the total remuneration payable to the Chairman during the period of his absence or in the case of a member, the sum shall be the difference between his actual remuneration as a member and that of the

Chairman during such period.

Members shall be entitled to the privileges specified in the Schedule to this Enactment as may be amended by the Cabinet by notification in the Gazette.

Provision for payment.

Section 7

All sums required for payments made under the provisions of this Enactment shall be charged on the Consolidated Fund.

Transitional.

Section 8

The Chairman and members of the Commission shall continue to receive the remuneration and allowances which they are currently receiving under the Principal

Enactment until such time as the Cabinet may determine under section 3 and 4.

 “Yang di-Pertua Negeri” substituted for “Yang di-Pertua Negara” by virtue of Enactment No. 17 of 1976.

Schedule

(Section 6)

1.

Government publications: Members shall be supplied free of charge with copies of the

Gazette and the State Estimates and other documents required for the purposes of the business of the Commission.

2.

Correspondence: Members are authorised to transmit free of charge within the State all correspondence relating to the business of the Commission.

3.

Medical facilities: Members shall be entitled to the same medical facilities, in respect of themselves and their families, as a Division I officer of the Government service.

4.

Telephone:

(a)

each member shall be entitled (if he is not already in possession of a telephone in his private residence) to the cost of the installation of a telephone in such residence as an individual subscriber.

(b)

Each member who has a telephone in his private residence as an individual subscriber may recover the cost of the rental thereof.

5.

Road travel: Members are entitled to-

(a)

mileage allowance, at such rate as may be in force from time to time in respect of Government officers, for mileage travelled in or on their own motor vehicles on the business of the Commission; or

(b)

if not travelling in or on their own motor vehicles, the actual cost of transport for the purpose of such business.

6.

Air, Sea and Rail travel: Members are entitled to recover the cost of any air, sea or rail tickets used by them on the business of the Commission.

7.

Rest House Accommodation: Members shall be entitled to Rest House accommodation as if they were Government officers.

8.

Car Loan: A member may be granted a loan to purchase a motor vehicle of such amount and subject to such conditions as the Yang di-Pertua Negeri may specify.
