  1. An Ordinance to provide for the remuneration of the Members of the Public Service Commission and for other matters incidental thereto or connected therewith. [1st January, 1992] Enacted by the Legislature of Sarawak— Short title and commencement

Section 1

This Ordinance may be cited as the Public Service

Commission (Remuneration) Ordinance, 1993, and shall be deemed to have come into force on the 1st day of January, 1992.

The salary or fixed allowances of each Member of the

Public Service Commission shall—

(b)

be payable monthly on the last day of each month, or on such other day of the month as the State Financial Secretary may, from time to time, determine.

The sum required for the salaries, gratuities, allowances and other benefits payable under this Ordinance shall be charged on the State Consolidated Fund.

The Yang di-Pertua Negeri may, by Direction published in the Gazette, amend the Schedule.

Any Direction made under subsection (1) shall be laid before the Dewan Undangan Negeri, and, if not sooner revoked by the

Yang di-Pertua Negeri, shall cease to have effect if resolutions are passed by the Dewan Undangan Negeri annulling such Direction, but without prejudice to anything previously done by virtue thereof or to the power of the Yang di-Pertua Negeri to issue new Direction under subsection (1).

Ordinance, 1980 [Ord. No. 11/1980] (hereinafter referred to as “the said Ordinance”), and the gratuity, allowances and privileges made by the Majlis Mesyuarat Kerajaan Negeri pursuant to section 3 of the said

Ordinance are hereby repealed.

Nothing in this Ordinance shall be deemed to preclude the

Government from paying the remuneration and allowances, approved by the Majlis Mesyuarat Kerajaan Negeri under the said Ordinance during the period from the 1st day of January, 1992, to the 30th day of

April, 1993, to any Member of the Commission where such Member has become eligible for such remuneration and allowances.

2. ACTING ALLOWANCE

In the event of the Deputy Chairman or any other Member performing the functions of the Chairman or Deputy Chairman during a period exceeding twenty-eight days, he shall be entitled to an acting allowance equivalent to the difference between his salary and the salary of the position he is acting in.

3. GRATUITY

A gratuity at the rate of one month’s salary for each completed year of service shall be paid—

(a)

on the expiry of the term of appointment of the Member: Provided that where a Member is re-appointed for more than one term, he may opt either to be paid at the end of each term or until he has completed all the terms; or

(b)

to his dependants or if there are no dependants, to his personal representatives upon his death while holding office.

4.

OTHER ALLOWANCES, PRIVILEGES AND ENTITLEMENT

(which includes subsistence allowances, travelling allowances, hotel accommodation expenses, medical benefits, leave, official car, telephone, etc.)

The Chairman, Deputy Chairman and Members of the Commission shall be entitled to be same allowances, privileges and entitlement which are applicable to public officers in the State Civil Service on the following grades—

5. PASSAGES

A member whose home-town is not Kuching, on his appointment as a Member of the Commission, shall be eligible for Government paid passages (according to his entitlement) from his home-town to Kuching and on the expiry or termination of his appointment to Government paid passages (according to his entitlement) from

Kuching to his home-town, for himself, his spouse and children under the age of 18.

6. GOVERNMENT PUBLICATIONS

The Government will supply free of charge to each Member a copy of all current Sarawak Government Gazette.
