Opening note

Preamble

  1. IN exercise of the powers conferred by section 13 and paragraph 63(f) of the Sabah Renewable Energy Enactment 2024, the Minister makes the following regulations: Citation and commencement
(1)

These regulations may be cited as the Sabah Renewable Energy (Manner of Appeal) Regulations 2024.

(2)

These Regulations come into operation on 3 January 2024.

Manner of appeal

(1)

A person who is aggrieved by the decision of the Commission in refusing an application for a feed-in approval under section 9 of the Enactment, in imposing any additional conditions or in varying or revoking any conditions imposed on a feed-in approval under section 11 of the Enactment or in revoking a feed-in approval under section 12 of the Enactment may, within thirty days of the decision being notified to him, appeal to the Minister by serving a notice of appeal on the Minister.

(2)

The notice of appeal under subregulation (1) shall —

(a)

be made in writing in the national language and may be accompanied by a translation in the English language;

(b)

be accompanied by a copy of the decision appealed against;

(d)

contain an address where any notice or document relating to the appeal may be served upon the appellant; and

(3)

The appellant shall also serve a copy of the notice of appeal on the Commission.

Grounds of decision

Upon receipt of a copy of the notice of appeal served under subregulation 2(3), the Commission shall submit a statement of the grounds of its decision to the

Minister within fourteen days from the date of receipt of the copy of notice of appeal.

Decision of Minister on appeal

(1)

The Minister shall, after considering the grounds of appeal stated by the appellant under paragraph 2(2)(c) and the statement of the grounds of decision submitted by the Commission under regulation 3, decide on the appeal.

(2)

The decision of the Minister on the appeal shall be communicated to the appellant by the Commission through a written notice within seven days from the date the Commission is notified of such decision.
