Section 40
—
(1)
The Ombudsman or any authorized officer, may, with the consent in writing of the Public Prosecutor or any person appointed by him under section 376(3) of the Criminal Procedure Code [Act 593], accept from any person who has committed an offence under this
Ordinance or any rules made thereunder, a sum not exceeding one half of the maximum amount of the fine provided for the offence has been committed.
(2)
All sums of money received under this section shall be credited to the State Consolidated Fund.
(3)
Any power vested in an authorized officer may, at any time, be withdrawn by the Chief Ombudsman, by notification in the Gazette.
