Public servants
All members, officers and employees of the Board or any committee, or any officer, employee, or agent of the Board, while performing their functions or discharging their duties under this
Ordinance shall be deemed to be “public servants” within the meaning of the Penal Code [Act 574].
Delegation of powers and functions 16.—
The Board may, subject to such conditions or restrictions as it deems fit, delegate to any committee appointed under section 9, or to the General Manager or any officer of the Board, or any company incorporated by the Board and its subsidiaries, all or any of the powers and functions vested in the Board by this Ordinance, (other than the power to delegate conferred by this section).
(2)
Notwithstanding the delegation of powers or functions under this section, the Board may continue to perform any of its functions or exercise any powers conferred upon it under this
Ordinance.
Public Authorities Protection Act 1948 17.
The Public Authorities Protection Act 1948 [Act 198]
shall apply to any action, suit, prosecution, or proceedings against the
Board or against any member, officer, employee or agent of the Board in respect of any act, neglect or default done or committed by him in such capacity.
Obligation of secrecy 18.―(1) Except for the purpose of this Ordinance or of any criminal proceedings under this Ordinance, no member, officer or employee of the Board shall disclose any information which has been obtained by him in the course of his duties and which has not been published in pursuance of this Ordinance.
(2)
Any person contravening the provisions of subsection (1)
shall be guilty of an offence and shall, on conviction, be liable to a fine not exceeding fifty thousand ringgit or imprisonment for a term not exceeding three years or to both.
