Section 53

―(1) The Board shall, as soon as reasonably practicable after its establishment, draw up and issue a written code of conduct and discipline which shall upon such code being approved by the Majlis

Mesyuarat Kerajaan Negeri, apply to the Chief Executive Officer, the

Secretary to the Board and all officers and employees appointed under section 52.

(2)

The Board may, from time to time, with the prior approval of the Majlis Mesyuarat Kerajaan Negeri, vary, amend or substitute the written code of conduct and discipline issued by it pursuant to sub-section (1), or any substitute code issued by it pursuant to this sub-section (2).

(3)

For the avoidance of doubt, the Statutory Bodies (Conduct and Discipline) Ordinance, 2004 [Cap. 57], shall not apply to the

Chief Executive Officer, the Secretary to the Board or any officers or employees of the Board appointed under section 52.

(4)

Without prejudice to subsection (1) above, every officer and employee of the Board in exercising his powers and discharging his responsibilities shall act―

(a)

in accordance with this Ordinance;

(b)

for a proper purpose;

(c)

in good faith in the best interests of the Fund; and

(d)

with the knowledge, skill and experience which may reasonably be expected of a person in the position of such officer or employee, and with any additional knowledge, skill and experience which that officer and employee in fact has.
