An Enactment to make provision for the Civil List of the Yang di-Pertua Negeriand for the remuneration of any person appointed to exercise the functions of the Yang di-Pertua Negeri; and for matters incidental to the foregoing.

ENACTED by the Legislature of the State of Sabah as follows:

Short title and commencement.

1.

This Enactment may be cited as the Civil List Enactment, 1963, and shall be deemed to have come into operation on Malaysia Day.

Civil List of the Yang di-Pertua Negeri.

2.

(1)

There shall be paid for the Civil List of the Yang di-Pertua Negeri so long as he shall hold office the sums specified in the Schedule to this Enactment.

(2)

All payments in respect of the amount specified for Class I of the Schedule to this Enactment shall be made to the Yang di-Pertua Negeri.

(3)

All payments in respect of the amounts specified in the Schedule to this

Enactment other than the amount specified for Class I thereof shall be paid to the Private

Secretary to the Yang di-Pertua Negeri.

(4)

No payment in respect of the amount specified for Class I of the Schedule to this Enactment shall be made in respect of any period during which the office of Yang di-Pertua Negeri is vacant.

Remuneration of Deputy Yang di-Pertua Negeri.

There shall be paid to any person appointed, under clause (3) of Article 1 of the

Constitution, to exercise the functions of the Yang di-Pertua Negeri during any period in which he is so appointed such sums as may be agreed by the Cabinet either in addition to or in substitution for any sums that he may otherwise receive from public funds:

Enactment No. 17 of 1976.

Provided that the total of the emoluments payable shall not exceed the total which would be payable to the Yang di-Pertua Negeri during such period under this Enactment.

Charge on Consolidated Fund.

The sums required for the payments to be made under sections 2 and 3 of this

Enactment shall be charged on the Consolidated Fund.

Payment.

5.

The amounts specified in Class I of the Schedule, and any sums payable under section 3, of this Enactment shall –

(a)

accrue from day to day; and

(b)

be payable monthly on the last day of each month or on such other day as the Minister for Finance may from time to time determine.

Appropriation.

(1)

In the application of the sums paid in respect of any year under section 2 of this Enactment the amounts specified in the Schedule to this Enactment shall be appropriated to the classes of expenditure specified in the said Schedule respectively in that year.

(2)

If it appears that the sums appropriated to any Class of expenditure specified in the Schedule to this Enactment in any financial year will not be wholly required for expenditure of that Class in that year, the Minister for Finance may direct that the amount not required may be applied as an addition to the sum available for any other

Class.

(3)

The sums paid to the Private Secretary to the Yang di-Pertua Negeri under subsection (3) of section 2 of this Enactment for any year shall be expended in that year by the Private Secretary in conformity, so far as possible, with estimates for that year submitted by him to and approved by the Minister for Finance.

Change of holder of office.

In the event of there being a change of holder of the office of Yang di-Pertua

Negeri there shall be made such adjustments and distribution of the annual payment due under subsection (2) of section 2 of this Enactment as the circumstances of the case may require.

Transitional provisions.

8.

Notwithstanding the provisions of section 4 of this Enactment, until the coming into operation of Part III of the Constitution the sums charged by the said section on the

Consolidated Fund shall be charged on and paid out of the revenues of the State.
