Preamble

PADA menjalankan kuasa yang diberikan oleh seksyen 133 Akta Jalan, Parit dan Bangunan 1974 [Akta 133], dibaca bersama Perintah Wilayah Persekutuan Labuan (Pemerluasan dan Ubah Suaian Akta Jalan, Parit dan Bangunan 1974) 2010 [P.U. (A) 394/2010], Menteri membuat undang-undang kecil yang berikut: Nama dan permulaan kuat kuasa

Seksyen 1

(1)

Undang-undang kecil ini bolehlah dinamakan Undang-Undang Kecil

Jalan, Parit dan Bangunan (Pengkompaunan Kesalahan) (Wilayah Persekutuan

Labuan) 2025.

(2)

Undang-Undang Kecil ini mula berkuat kuasa pada 2 Mei 2025.

Kesalahan yang boleh dikompaun

Seksyen 2

(1)

Kesalahan yang dinyatakan dalam Jadual Pertama ditetapkan sebagai kesalahan yang boleh dikompaun.

(2)

Kesalahan yang boleh dikompaun itu boleh dikompaun dengan keizinan

Pendakwa Raya secara bertulis dalam Borang 1 Jadual Kedua.

Tatacara mengkompaun

Seksyen 3

(1)

Apabila menerima apa-apa maklumat atau aduan bahawa suatu kesalahan yang boleh dikompaun telah dilakukan, Ketua Pegawai Eksekutif atau mana-mana pegawai yang diberi kuasa secara bertulis oleh Perbadanan Labuan boleh, dengan keizinan bertulis Pendakwa Raya, mengeluarkan suatu tawaran untuk mengkompaun kesalahan itu dalam Borang 2 Jadual Kedua.

(2)

Suatu tawaran untuk mengkompaun suatu kesalahan adalah sah bagi tempoh empat belas hari bermula dari tarikh tawaran itu diterima oleh orang yang kepadanya tawaran itu dibuat atau apa-apa tempoh lanjutan yang boleh diberikan oleh

Ketua Pegawai Eksekutif atau mana-mana pegawai yang diberi kuasa secara bertulis oleh Perbadanan Labuan, dan jika pembayaran penuh bagi jumlah yang ditawarkan itu dibuat pada atau sebelum habis tempoh empat belas hari atau apa-apa tempoh lanjutan yang diberikan itu, tiada prosiding selanjutnya boleh diambil terhadap orang yang telah melakukan kesalahan itu.

Penyetujuterimaan kompaun

Seksyen 4

Seseorang yang menyetuju terima suatu tawaran untuk mengkompaun suatu kesalahan yang boleh dikompaun hendaklah menyetuju terima tawaran itu dalam Borang 3 Jadual Kedua dan mengembalikan Borang 3 itu kepada

Ketua Pegawai Eksekutif atau mana-mana pegawai yang diberi kuasa secara bertulis oleh Perbadanan Labuan.

Seksyen 5

Pembayaran kompaun

(1)

Seseorang yang menyetuju terima suatu tawaran untuk mengkompaun suatu kesalahan yang boleh dikompaun hendaklah membayar kompaun itu sama ada secara tunai, melalui kiriman wang, wang pos, cek juruwang, draf bank, kad kredit atau apa-apa pemindahan wang secara elektronik yang lain kepada Ketua Pegawai Eksekutif atau mana-mana pegawai yang diberi kuasa secara bertulis oleh Perbadanan Labuan.

(2)

Pembayaran di bawah perenggan (1) yang dibuat—

(a)

secara tunai hendaklah diserahkan sendiri ke alamat yang dinyatakan dalam Borang 2 Jadual Kedua;

(b)

melalui kiriman wang, wang pos, cek juruwang atau draf bank dipalang dengan perkataan “Akaun Penerima Sahaja” hendaklah diserahkan sendiri atau dihantar melalui pos berdaftar ke alamat yang dinyatakan dalam Borang 2 Jadual Kedua; atau

(c)

melalui kad kredit atau apa-apa pemindahan wang secara elektronik yang lain hendaklah dibayar ke dalam akaun

Perbadanan Labuan.

Ketua Pegawai Eksekutif atau mana-mana pegawai yang diberi kuasa secara bertulis oleh Perbadanan Labuan hendaklah mengeluarkan suatu resit rasmi bagi tiap-tiap pembayaran yang diterima di bawah perenggan (2) kepada orang yang kepadanya tawaran untuk mengkompaun itu telah dibuat.

Suatu resit rasmi yang dikeluarkan di bawah perenggan (3) hendaklah termasuk apa-apa resit elektronik jika pembayaran dibuat melalui kad kredit atau apa-apa pemindahan wang secara elektronik yang lain.

Jumlah wang yang akan dipungut

Seksyen 6

Jumlah wang yang akan dipungut oleh Perbadanan Labuan bagi mengkompaun suatu kesalahan yang dinyatakan dalam Jadual Pertama hendaklah tidak melebihi amaun maksima bagi denda yang diperuntukkan dalam Akta bagi kesalahan itu.

Seksyen 7

Pendakwaan boleh dimulakan jika tiada pembayaran dibuat

Jika tiada pembayaran bagi kompaun yang ditawarkan itu dibuat dalam tempoh yang dinyatakan dalam perenggan 3(2), pendakwaan boleh dimulakan tanpa notis lanjut.

IN exercise of the powers conferred by section 133 of the Street, Drainage and

Building Act 1974 [Act 133], read together with the Federal Territory of Labuan

(Extension and Modification of Street, Drainage and Building Act 1974) Order 2010

[P.U. (A) 394/2010]), the Minister make the following by-laws:

Citation and commencement 1.

(1)

These by-laws may be cited as the Street, Drainage and Building

(Compounding of Offences) (Federal Territory of Labuan) By-Laws 2025.

(2)

These By-Laws come into operation on 2 May 2025.

Compoundable offences 2.

(1)

The offences specified in the

First

Schedule are prescribed as compoundable offences.

(2)

The compoundable offences may be compounded with the consent of the Public Prosecutor in writing in Form 1 of the Second Schedule.

Procedure for compounding 3.

(1)

Upon receipt of any information or complaint that a compoundable offence has been committed, the Chief Executive Officer or any officer authorized in writing by Perbadanan Labuan, with the written consent of the Public Prosecutor, issue an offer to compound the offence in Form 2 of the Second Schedule.

(2)

An offer to compound an offence shall be valid for a period of fourteen days starting from the date the offer is received by the person to whom offer is made or such extended period as the Chief Executive Officer or any officer authorized in writing by the Perbadanan Labuan may grant, and if full payment of the sum offered is made on or before the expiry of fourteen days or such extended

period granted, no further proceedings shall be taken against the person who committed such offence.

Acceptance of compound 4.

A person who accepts an offer to compound a compoundable offence shall accept the offer in Form 3 of the Second Schedule and return the Form 3 to the Chief Executive

Officer or any officer authorized in writing by Perbadanan Labuan.

Payment of compound 5.

(1)

A person who accepts an offer to compound a compoundable offence shall pay the compound either in cash, by money order, postal order, cashier’s cheque, bank draft, credit card or any other electronic fund transfers to the Chief Executive

Officer or any officer authorized in writing by the Perbadanan Labuan.

(2)

The payment under paragraph (1) which is made—

(a)

in cash shall be delivered personally to the address specified in Form 2 of the Second Schedule;

(b)

by money order, postal order, cashier’s cheque or bank draft crossed with the words “Account Payee Only” shall be delivered personally or sent by registered post addressed to the address specified in Form 2 of the Second Schedule; or

(c)

through credit card or any other electronic fund transfer shall be paid into the Perbadanan Labuan’s account.

(3)

The Chief Executive Officer or any officer authorized in writing by the Perbadanan Labuan shall issue an official receipt for every payment received under paragraph (2) to the person to whom the offer to compound is made.

(4)

An official receipt issued under paragraph (3) shall include any electronic receipt if the payment is made through credit card or any other electronic fund transfers.

Sum of money to be collected 6.

The sum of money to be collected by the Perbadanan Labuan for compounding an offence specified in the First Schedule shall not exceed the maximum amount of fine as provided in the Act for the offence.

Prosecution may be instituted if on payment made 7.

If no payment of the compound offered is made within the period specified in paragraph 3(2), prosecution may be instituted without further notice.
