IN exercise of the powers conferred by section 133 of the Street, Drainage and
Building Act 1974 [Act 133], read together with the Federal Territory of Labuan
(Extension and Modification of Street, Drainage and Building Act 1974) Order 2010
[P.U. (A) 394/2010]), the Minister make the following by-laws:
Citation and commencement 1.
(1)
These by-laws may be cited as the Street, Drainage and Building
(Compounding of Offences) (Federal Territory of Labuan) By-Laws 2025.
(2)
These By-Laws come into operation on 2 May 2025.
Compoundable offences 2.
(1)
The offences specified in the
First
Schedule are prescribed as compoundable offences.
(2)
The compoundable offences may be compounded with the consent of the Public Prosecutor in writing in Form 1 of the Second Schedule.
Procedure for compounding 3.
(1)
Upon receipt of any information or complaint that a compoundable offence has been committed, the Chief Executive Officer or any officer authorized in writing by Perbadanan Labuan, with the written consent of the Public Prosecutor, issue an offer to compound the offence in Form 2 of the Second Schedule.
(2)
An offer to compound an offence shall be valid for a period of fourteen days starting from the date the offer is received by the person to whom offer is made or such extended period as the Chief Executive Officer or any officer authorized in writing by the Perbadanan Labuan may grant, and if full payment of the sum offered is made on or before the expiry of fourteen days or such extended

period granted, no further proceedings shall be taken against the person who committed such offence.
Acceptance of compound 4.
A person who accepts an offer to compound a compoundable offence shall accept the offer in Form 3 of the Second Schedule and return the Form 3 to the Chief Executive
Officer or any officer authorized in writing by Perbadanan Labuan.
Payment of compound 5.
(1)
A person who accepts an offer to compound a compoundable offence shall pay the compound either in cash, by money order, postal order, cashier’s cheque, bank draft, credit card or any other electronic fund transfers to the Chief Executive
Officer or any officer authorized in writing by the Perbadanan Labuan.
(2)
The payment under paragraph (1) which is made—
(a)
in cash shall be delivered personally to the address specified in Form 2 of the Second Schedule;
(b)
by money order, postal order, cashier’s cheque or bank draft crossed with the words “Account Payee Only” shall be delivered personally or sent by registered post addressed to the address specified in Form 2 of the Second Schedule; or
(c)
through credit card or any other electronic fund transfer shall be paid into the Perbadanan Labuan’s account.
(3)
The Chief Executive Officer or any officer authorized in writing by the Perbadanan Labuan shall issue an official receipt for every payment received under paragraph (2) to the person to whom the offer to compound is made.

(4)
An official receipt issued under paragraph (3) shall include any electronic receipt if the payment is made through credit card or any other electronic fund transfers.
Sum of money to be collected 6.
The sum of money to be collected by the Perbadanan Labuan for compounding an offence specified in the First Schedule shall not exceed the maximum amount of fine as provided in the Act for the offence.
Prosecution may be instituted if on payment made 7.
If no payment of the compound offered is made within the period specified in paragraph 3(2), prosecution may be instituted without further notice.
