Where at the time the fugitive criminal who is apprehended on a provisional warrant is brought before any Magistrate the

Magistrate has received an order of the Minister signifying that a requisition has been made for the return of the fugitive criminal, the Magistrate shall order—

(a)

that the case be transmitted to the Sessions Court; and

(b)

that the fugitive criminal be remanded in custody until his appearance before the Sessions Court.
