101. Compensation, damages and costs to be determined by court

Except as herein otherwise provided in all cases when compensation, damages, fees, costs or expenses are by this Act directed to be paid by the local authority to any person or by any person to any other person the amount and, if necessary, the apportionment of the same and any question or liability shall, in case of dispute or failure to pay, be summarily ascertained and determined by a Magistrate’s
local authority
“local authority” means any city council, municipal council, town council, town board, local council, rural board or similar local authority established by written law and in relation to the Federal Territory means the Commissioner of the City of Kuala Lumpur appointed under section 3 of the Federal Capital Act 1960;

If the amount of compensation, damages, fees, costs or expenses is not paid by the party liable to pay the same within seven days after demand, such default may be reported to a Magistrate’s
Court and such amount recovered in the same way as if it were a fine imposed by a Magistrate’s Court.

An appeal shall lie to the High Court from any decision of a
Magistrate’s Court under this section, and the provisions of the
Criminal Procedure Code [Act 593] shall mutatis mutandis apply to all such appeals.
