Institution and conduct of prosecution

Section 126
(1)

A prosecution in respect of an offence under this Act shall not be instituted except by or with the consent in writing of the Public Prosecutor.

(2)

Notwithstanding that he has been authorized under the Criminal

Procedure Code to prosecute, a person who is the investigating officer of an offence under this Act shall not prosecute the case in respect of that offence.
