Section 32
(1)
Any person who in respect of any food sold by him as principal or agent gives to the purchaser a false warranty in writing commits an offence and is liable on conviction to imprisonment for a term not exceeding two years or to fine or to both:
Provided that it shall be a defence if he proves to the satisfaction of the court that when he gave the warranty he had reason to believe that the statements or descriptions contained therein were true.
(2)
The provisions of subsection 19(2) to the effect that no proceedings shall be instituted after the expiration of one hundred and fifty days from the time of purchasing or procuring any food shall not apply in relation to a false warranty.
