Immunity from legal action

Section 121

No legal proceeding, prosecution or other form of litigation may be instituted or maintained against—

(a)

the Commissioner, Deputy Commissioner or Assistant

Commissioner;

(b)

any member of the Council;

(c)

any authorized officer or enforcement officer; or

(d)

any person employed in the office of the Commissioner or the Council, in his personal capacity in respect of any act, omission, decision or statement done or made for the purpose of or incidental to the implementation or proposed implementation of the provisions of this Act or any regulations made under this Act unless such act, omission, decision or statement was done or made by his wilful neglect or default.
