Offence of evasion of royalty etc.

Section 30A
(1)

Any person who –

(a)

is in any way knowingly concerned in conveying, disposal of or dealing with any forest produce in respect of which a forest offence has been committed or upon which the royalty or other

payment due in respect thereof has not been paid or made; or

(b)

is in any way knowingly concerned in any fraudulent evasion or attempt at fraudulent evasion of any royalty or other payment due to the Government, shall be guilty of an offence and on conviction be liable to imprisonment for a term not exceeding ten years and to a fine not exceeding five hundred thousand ringgit.

(2)

In addition to the penalty imposed under subsection (1) of this section, the convicting court shall order the offender to pay to the Government a sum equivalent to ten times the amount of royalty or other payment which would have been payable to the Government:

Provided that where the amount of royalty or other payment cannot be ascertained, the sum ordered to be paid shall be one hundred thousand ringgit.

(3)

In any prosecution under this section, it shall be presumed until the contrary is proved that the accused has knowledge that a forest offence has been committed in respect of the forest produce or that no royalty or other payment upon the forest produce due to the Government has been paid or made.
