Section 40
(1)
A certificate of analysis signed by an analyst shall, on production by the
Director in any trial under this Enactment, be sufficient evidence of the facts stated in the certificate unless the accused requires that the analyst be called as a witness, in which case he shall give a written notice to the Director not less than three working days before the commencement of the trial.
(2)
Where the Director intends to give in evidence any certificate referred to in subsection (1), he shall deliver a copy of such certificate to the accused not less than ten working days before the commencement of the trial.
