Section 38C
Constitution of amenity forest by conversion of forest reserve, etc.

The Minister may, by notification in the Gazette, from the date specified in such notification, convert any forest reserve, protected forest or communal forest or part thereof to be an amenity forest.
Provided that all rights and privileges admitted or conceded in respect of the said forest shall not be affected by such conversion.
(2)
Sections 26, 27, 28 and 29 shall apply mutatis mutandis in relation to an amenity forest constituted under this section.
Development in amenity forests 38D.—
(1)
Notwithstanding sections 26 and 27, the Director may issue a licence under section 52 to any person to develop an amenity forest or any part thereof subject to any terms and conditions in the licence or any rules made under section 113.
(2)
Subject to the powers of the Minister under sections 2(2)
and 2(3) a licence issued under this section shall not be transferable.
