Prohibition on registration in the same classification code

(1)

Unless with the prior approval of the Registrar, no registered person shall be registered in the same classification code.

(2)

Any person who contravenes subsection (1) commits an offence.

(3)

For the purposes of this section—

(a)

“registered person” includes—

(i)

any of its employee;

(ii)

any beneficial owner of the registered person;

(iii)

any person of interest which the registered person is obligated to disclose under subsection 37(2);

(iv)

any person or group of persons acting in concert with the registered person for the purpose of registering under this Part in the same classification code;

(b)

“classification code” means the category of the supply of goods and services or any specialization for works as determined by the Registrar.
