Section 46

Whenever in any State law a penalty is provided for an offence against such law, such provision shall be deemed to indicate that such offence, whether by act or omission, shall be an offence against such law and punishable, upon conviction, by a penalty not exceeding

(except as may be otherwise expressly mentioned in such law) the penalty provided.
