  1. PADA menjalankan kuasa yang diberikan oleh subseksyen 8(1) dan subseksyen 10(1) Akta Ahli Kimia 1975 [Akta 158], Institut Kimia Malaysia, dengan kelulusan Menteri, membuat kaedah-kaedah yang berikut:

Seksyen 2

Suatu permohonan untuk pendaftaran sebagai seorang anggota hendaklah dibuat dalam bentuk dan cara yang ditentukan oleh Majlis.

Setiap permohonan hendaklah disertakan dengan—

(a)

suatu salinan sijil kelayakan akademik atau profesional yang diakui sah;

suatu salinan kad pengenalan yang diakui sah; dan

(c)

tiga keping gambar terbaharu berukuran pasport.

Permohonan di bawah subkaedah (1) hendaklah disertakan dengan fi keanggotaan sebanyak satu ratus ringgit dan fi pemprosesan sebanyak satu ratus ringgit.

Apabila menerima permohonan di bawah subkaedah (2), Majlis boleh, melalui notis secara bertulis, meminta pemohon untuk memberikan butir-butir, maklumat atau dokumen lanjut, dalam tempoh empat belas hari.

Jika pemohon tidak mematuhi permintaan yang dibuat dalam tempoh sebagaimana yang dinyatakan dibawah subkaedah (4), Majlis boleh menolak permohonan itu dengan menyatakan alasan bagi penolakan itu, tanpa menjejaskan permohonan baharu yang dikemukakan oleh pemohon.

Jika permohonan itu ditolak, hanya fi keanggotaan yang akan dibayar balik kepada pemohon.

Pengeluaran sijil keanggotaan

Selepas permohonan di bawah kaedah 2 diluluskan, Majlis boleh mengeluarkan suatu sijil keanggotaan kepada pemohon.

Tandatangan Pendaftar hendaklah diendorskan di atas gambar anggota yang dilekatkan pada sijil keanggotaan itu.

Semua sijil keanggotaan yang diendors hendaklah ditandatangani oleh

Yang Dipertua dan Pendaftar dan dimeterai dengan meterai rasmi Institut.

Seksyen 4

Mana-mana anggota boleh memohon kepada Majlis untuk menaik taraf keanggotaan daripada kategori Licentiate kepada kategori Member atau daripada kategori Member kepada kategori Fellow dalam bentuk dan cara sebagaimana yang ditentukan oleh Majlis.

Tiap-tiap permohonan di bawah subkaedah (1) hendaklah disertakan dengan suatu fi pemprosesan sebanyak lima puluh ringgit.

Pengekalan keanggotaan

Tiap-tiap permohonan bagi pengekalan keanggotaan dalam daftar hendaklah dibuat kepada Majlis dalam apa-apa bentuk dan cara yang ditentukan oleh Majlis dan disertakan dengan fi pengekalan keanggotaan sebanyak satu ratus ringgit pada atau sebelum 31 Januari tahun berkenaan.

Jika permohonan bagi pengekalan keanggotaan dibuat selepas 31 Januari tahun berkenaan, fi pemprosesan tambahan sebanyak lima puluh ringgit hendaklah dikenakan.

Sijil pengekalan keanggotaan hendaklah mengikut cara dan bentuk yang ditentukan oleh Majlis.

Jika tiada permohonan bagi pengekalan keanggotaan dibuat oleh anggota sebelum 30 Jun bagi tahun berkenaan, namanya akan dikeluarkan daripada daftar anggota.

Majlis boleh, atas permintaan bertulis, mengurangkan atau mengetepikan fi pengekalan keanggotaan bagi tempoh dua belas bulan atau lebih dalam hal keadaan anggota itu melanjutkan pelajaran di dalam atau luar negara atau atas apa-apa alasan lain sebagaimana yang difikirkan patut oleh Majlis.

Majlis boleh mengetepikan fi pengekalan keanggotaan bagi mana-mana anggota yang berumur lebih daripada enam puluh tahun dan telah menjadi anggota secara berterusan selama tidak kurang daripada lima belas tahun.

Pemeriksaan pendaftaran anggota

Pendaftaran anggota yang disenggara oleh Pendaftar hendaklah tersedia untuk pemeriksaan di bawah subseksyen 15(2) Akta selepas pembayaran fi sebanyak lima puluh ringgit.

Seksyen 8

Penamatan keanggotaan

Mana-mana anggota boleh, pada bila-bila masa, ditamatkan keanggotaannya sekiranya Majlis berpuas hati bahawa anggota itu—

(a)

telah tidak membayar fi sebagaimana yang dinyatakan dalam

Kaedah-Kaedah ini; atau

telah tertakluk kepada tindakan tatatertib oleh Jawatankuasa

BAHAGIAN III

MESYUARAT MAJLIS DAN MESYUARAT AGUNG TAHUNAN

Mesyuarat Majlis

Seksyen 9

Setiausaha hendaklah mengadakan suatu mesyuarat Majlis apabila dikehendaki berbuat demikian oleh Yang Dipertua atau sekurang-kurangnya dua anggota

Majlis yang mengemukakan rekuisisi mereka secara bertulis.

Jika mesyuarat diadakan atas permintaan anggota Majlis, notis mesyuarat hendaklah menyatakan tujuan mesyuarat itu diadakan.

Setiausaha hendaklah memberikan kepada anggota

Majlis, sekurang-kurangnya tujuh hari notis panggilan mesyuarat secara bertulis, yang menyatakan tempat, tarikh, masa dan tujuan mesyuarat itu diadakan.

Apa-apa ketetapan hendaklah dicadangkan oleh mana-mana anggota

Majlis dan disokong oleh sekurang-kurangnya tiga orang anggota Majlis sebelum undian.

Undian hendaklah dilakukan dengan cara mengangkat tangan atau dengan cara undi sulit sebagaimana yang ditentukan oleh Pengerusi.

Pengerusi hendaklah mengisytiharkan keputusan undian sama ada ketetapan yang dinyatakan di bawah subkaedah (1) diterima atau ditolak oleh anggota Majlis.

Perisytiharan di bawah subkaedah (3) adalah muktamad dan catatan tentang perisytiharan itu dalam minit mesyuarat hendaklah menjadi keterangan yang konklusif.

Jika bilangan undi sama banyak, Pengerusi hendaklah mempunyai undi pemutus sebagai tambahan kepada undi biasanya.

Hanya anggota yang hadir sendiri boleh mengundi dalam mesyuarat.

Minit mesyuarat Majlis

Minit mesyuarat Majlis hendaklah dikekalkan dalam bentuk minit bertulis dan disahkan dengan tandatangan Pengerusi.

Setiausaha hendaklah menyebabkan minit mesyuarat itu disenggara dan disimpan dalam bentuk yang wajar.

Setiausaha hendaklah mengedarkan minit mesyuarat itu kepada anggota

Majlis sekurang-kurangnya tujuh hari bekerja sebelum mesyuarat seterusnya.

Mesyuarat agung tahunan

Seksyen 12

Majlis hendaklah mengadakan suatu mesyuarat agung tahunan atau mesyuarat agung luar biasa dengan memberikan notis secara bertulis kepada anggota

Institut yang menyatakan tempat, tarikh, masa dan tujuan mesyuarat itu—

(a)

sekurang-kurangnya dua puluh satu hari sebelum mesyuarat agung tahunan itu diadakan; atau

(b)

sekurang-kurangnya empat belas hari sebelum mesyuarat agung luar biasa itu diadakan.

Jika tujuan atau salah satu tujuan mesyuarat agung tahunan adalah untuk membuat kaedah-kaedah atau meminda kaedah-kaedah, Majlis hendaklah memastikan notis mesyuarat sebagaimana dalam subkaedah (1) mengandungi atau disertakan dengan butiran kaedah-kaedah yang dicadangkan atau dipinda.

Apa-apa peninggalan yang tidak disengajakan dalam memberikan notis mesyuarat seperti yang dikehendaki oleh subkaedah (1) kepada seorang anggota Institut atau lebih, tidak akan dengan apa-apa cara, menjejaskan kesahan apa-apa yang telah dilakukan atau dipersetujui dalam mesyuarat tersebut.

Kuorum bagi mesyuarat agung tahunan ialah tiga puluh orang anggota yang hadir sendiri dan berhak mengundi.

Tiada apa-apa urusan boleh dijalankan dalam mana-mana mesyuarat agung tahunan jika kuorum tidak hadir.

Jika kuorum tidak hadir selepas setengah jam dari masa yang ditetapkan untuk mesyuarat agung tahunan, jika diadakan atas permintaan ahli, mesyuarat tersebut hendaklah dibubarkan, tetapi dalam apa-apa kes lain ia akan ditangguhkan ke hari lain dalam tempoh sebulan, dan jika kuorum tidak hadir dalam mesyuarat yang ditangguhkan itu, ahli yang hadir dan berhak mengundi, walau apa pun bilangan mereka, hendaklah membentuk kuorum dan boleh mengendalikan urusan yang untuknya mesyuarat tersebut diadakan.

Agenda bagi mesyuarat agung tahunan hendaklah termasuk perkara yang berikut:

(a)

menerima dan mempertimbangkan laporan tahunan Institut;

menerima dan mempertimbangkan penyata akaun tahunan Institut dan laporan juruaudit;

(c)

mengisi kekosongan dalam Majlis melalui pemilihan;

melantik juruaudit yang berkelayakan dan menentukan saraannya;

dan

(e)

mempertimbangkan apa-apa perkara lain yang notis bertulis sedemikian telah diberikan kepada

Setiausaha oleh ahli sekurang-kurangnya empat belas hari sebelum mesyuarat.

Seksyen 13

Setiap ketetapan yang dikemukakan dalam mesyuarat agung tahunan hendaklah diputuskan oleh undian majoriti mudah.

Hanya anggota yang hadir sendiri boleh mengundi dalam mesyuarat dan undian hendaklah dilakukan dengan cara mengangkat tangan atau dengan cara undi sulit sebagaimana yang ditentukan oleh Pengerusi.

Jika bilangan undi sama banyak, Pengerusi hendaklah mempunyai undi pemutus sebagai tambahan kepada undi biasanya.

Jika undian dilakukan secara rahsia, dua pemeriksa undi hendaklah dipilih oleh ahli yang hadir dengan mengangkat tangan.

Minit mesyuarat agung tahunan

Minit mesyuarat agung tahunan hendaklah dibuat dalam bentuk minit bertulis dan disahkan oleh Majlis.

Setiausaha hendaklah menyebabkan minit mesyuarat itu disenggara dan disimpan dalam bentuk yang wajar.

Bahagian IV

BAHAGIAN IV

Seksyen 15

Majlis hendaklah melantik suatu Lembaga Peperiksaan yang terdiri daripada ahli kimia yang berkelayakan dan berpengalaman.

Kelayakan untuk menduduki peperiksaan akhir

(a)

siswazah yang mempunyai ijazah dalam bidang kimia dari universiti yang tidak diiktiraf oleh Kerajaan;

siswazah yang mempunyai ijazah dalam bidang sains dan teknologi selain ijazah dalam bidang kimia; dan

Suggest a correction

(c)

seseorang yang mempunyai High School Certificate atau Sijil Tinggi

Pelajaran Malaysia atau kelayakan yang setara dengan syarat kimia sebagai salah satu mata pelajaran dan telah menghadiri suatu kursus yang diiktiraf oleh Institut.

Permohonan bagi peperiksaan akhir

Permohonan untuk menduduki peperiksaan akhir Institut hendaklah dibuat dalam borang yang ditentukan oleh Majlis dan permohonan itu hendaklah berserta dengan fi peperiksaan akhir.

Permohonan berserta dengan fi peperiksaan akhir hendaklah dikemukakan kepada Setiausaha sekurang-kurangnya enam puluh hari sebelum tarikh yang ditetapkan untuk peperiksaan akhir.

Lembaga Peperiksaan hendaklah mengesahkan kelayakan pemohon untuk menduduki peperiksaan akhir.

Jika permohonan itu ditolak, fi peperiksaan akhir hendaklah dibayar balik tertakluk pada potongan caj pentadbiran.

Seksyen 18

Peperiksaan akhir boleh dikendalikan setiap tahun oleh Lembaga

Peperiksaan.

Setiausaha hendaklah mengumumkan tarikh peperiksaan akhir, tempat peperiksaan akhir dan tarikh tutup permohonan, sekurang-kurangnya sembilan puluh hari sebelum tarikh peperiksaan akhir.

Honorarium yang perlu dibayar kepada ahli Lembaga Peperiksaan akan ditentukan oleh Majlis.

Lembaga Peperiksaan hendaklah mengesyorkan kriteria untuk lulus peperiksaan akhir dan bertanggungjawab mengemukakan keputusan setiap peperiksaan akhir berserta ulasan kepada Majlis tidak lewat daripada enam puluh hari selepas tarikh peperiksaan akhir berakhir.

Sukatan pelajaran

Lembaga Peperiksaan hendaklah menerbitkan, mengkaji semula dan meminda sukatan pelajaran bagi peperiksaan akhir Institut dari masa ke masa.

Sukatan pelajaran bagi peperiksaan akhir dan pindaannya hendaklah diluluskan oleh Majlis.

Setiausaha hendaklah, atas permintaan bertulis daripada mana-mana orang, menyediakan salinan sukatan pelajaran bagi peperiksaan akhir.

Bagi maksud subkaedah (3), Majlis boleh mengenakan suatu fi bagi salinan sukatan pelajaran.

Bukti pengenalan diri

Calon peperiksaan akhir Institut hendaklah mengemukakan kad pengenalan atau apa-apa dokumen pengenalan diri yang selaras dengan undang-undang Malaysia bagi warganegara Malaysia, manakala passport atau apa-apa dokumen pengenalan diri yang

selaras dengan undang-undang Malaysia bagi bukan warganegara Malaysia sebagai bukti pengenalan diri sebelum dibenarkan menduduki peperiksaan akhir.

Keputusan dan sijil

Setiausaha hendaklah menyampaikan keputusan peperiksaan akhir

Institut kepada setiap calon tidak lewat daripada tiga puluh hari selepas keputusan peperiksaan akhir diluluskan oleh Majlis.

Sijil yang ditandatangani oleh Yang Dipertua dan Pengerusi Lembaga

Peperiksaan dan dimeterai dengan meterai rasmi Institut hendaklah dikemukakan kepada calon yang berjaya.

BAHAGIAN V

Seksyen 23

Majlis hendaklah melantik seorang Bendahari dalam kalangan anggotanya.

Bendahari hendaklah mempunyai kewajipan untuk—

(a)

menerima dan bertanggungjawab terhadap semua wang yang perlu dibayar oleh atau telah dibayar kepada, Institut;

(b)

menyediakan dan mengemukakan suatu penyata akaun pada setiap mesyuarat Majlis yang menunjukkan resit dan perbelanjaan seperti pada hari terakhir dalam bulan sebelumnya mesyuarat tersebut;

(c)

menyediakan dan mengemukakan penyata akaun tahunan teraudit berserta laporan juruaudit pada setiap mesyuarat agung tahunan

Institut; dan

(d)

mencadangkan suatu garis panduan bagi honorarium dan pembayaran lain untuk dibayar kepada anggota, anggota Majlis,

kakitangan bergaji Institut dan mana-mana orang yang diluluskan untuk menghadiri mana-mana majlis dan aktiviti, tertakluk kepada kelulusan Majlis.

Penolong Bendahari

Seksyen 24

Majlis hendaklah melantik seorang Penolong Bendahari dalam kalangan anggotanya untuk membantu Bendahari dalam menjalankan tugasnya.

Seksyen 25

Perbelanjaan kumpulan wang Institut

Kumpulan wang Institut hendaklah dibelanjakan bagi maksud membayar mana-mana perbelanjaan dalam mempromosikan dan mencapai matlamat Institut, termasuklah—

(a)

honorarium bagi anggota Institut, anggota Majlis atau mana-mana badan lain untuk perkhidmatan yang diberikan kepada Institut;

(b)

saraan, insentif atau bonus kakitangan bergaji Institut;

(c)

mana-mana pemerolehan peralatan, kerja atau perkhidmatan mengikut garis panduan yang diluluskan oleh Majlis;

(d)

menguntukkan dan menyediakan wang untuk cawangan mengadakan apa-apa aktiviti atau majlis, tertakluk kepada kelulusan Majlis; dan

Suggest a correction

(e)

membayar balik kepada anggota Majlis atau anggota Institut bagi perbelanjaan yang ditanggung dalam menjalankan kerja dan tanggungjawab rasmi sebagai anggota Majlis.

Walau apa pun subkaedah (1), kumpulan wang Institut tidak boleh digunakan untuk membayar denda yang dikenakan terhadap anggota oleh mana-mana mahkamah.

Pelaburan

Bagi maksud pelaburan, Majlis boleh, dengan kelulusan Menteri, dari semasa ke semasa, mempertimbangkan untuk menggunakan kumpulan wang tidak lebih daripada tiga puluh peratus daripada jumlah tunai dan kesetaraan tunai Institut.

Akaun bank

Semua bayaran yang diterima hendaklah didepositkan dalam akaun kredit

Institut dengan seberapa segera dengan suatu bank yang diluluskan oleh Majlis, dengan syarat bahawa Bendahari boleh menyimpan sebagai tunai runcit sejumlah wang yang tidak melebihi seribu ringgit.

Semua cek yang dikeluarkan atas akaun Institut hendaklah ditandatangani oleh

Yang Dipertua dan Bendahari atau, semasa ketiadaan Yang Dipertua, Naib Yang Dipertua atau Setiausaha boleh menandatangani cek itu bagi pihak Yang Dipertua.

Seksyen 29

Penyimpanan akaun dan rekod

Majlis hendaklah menyebabkan disimpan dan diselenggara akaun dan rekod yang sepatutnya berhubung dengan—

(b)

jumlah wang yang diterima dan dibelanjakan oleh atau di bawah kuasa Institut.

Akaun dan rekod hendaklah disimpan dalam jagaan Bendahari atau

Penolong Bendahari atau di suatu tempat tertentu sebagaimana yang ditentukan oleh Majlis.

Bendahari bagi setiap cawangan hendaklah menyimpan dan menyenggara akaun dan rekod yang sepatutnya berhubung dengan jumlah wang yang diterima dan dibelanjakan oleh cawangan itu.

Institut, termasuk akaun cawangan, hendaklah diaudit sekurang-kurangnya sekali setahun oleh juruaudit bertauliah yang dilantik oleh Institut.

Seksyen 32

Kecualian dan peralihan

Semua permohonan yang belum selesai bagi pendaftaran sebagai anggota Institut di hadapan Majlis yang dibuat di bawah Kaedah-Kaedah Ahli Kimia

(Am) 1977 yang dibatalkan hendaklah, pada tarikh mula berkuat kuasanya Kaedah-Kaedah ini, diuruskan mengikut Kaedah-Kaedah ini seolah-olah permohonan itu dibuat dibawah Kaedah-Kaedah ini.

Mana-mana pengekalan keanggotaan tahunan yang telah dikeluarkan di bawah Kaedah-Kaedah Ahli Kimia (Am) 1977 yang dibatalkan yang masih sah pada tarikh permulaan kuat kuasa Kaedah-Kaedah ini hendaklah terus sah sehingga tarikh habis tempohnya.

Semasa tempoh keesahan mana-mana permohonan bagi pendaftaran sebagai anggota Institut dan pengekalan keanggotaan hendaklah, setakat yang praktik, membuat permohonan bagi pengekalan keanggotaan tahunan mengikut

Mana-mana orang yang telah dilantik sebagai Bendahari di bawah

Kaedah-Kaedah Ahli Kimia (Am) 1977 yang dibatalkan hendaklah, pada atau selepas

  1. IN exercise of the powers conferred by subsection 8(1) and subsection 10(1) of the Chemists Act 1975 [Act 158], the Malaysian Institute of the Chemistry, with the approval of the Minister, makes the following rules:

PART I

PRELIMINARY

Citation 1.

These rules may be cited as the Chemists Rules 2024.

Bahagian II

PART II

(1)

An application for registration of members shall be made in form and manner as determined by the Council.

(a)

a certified true copy of the academic or professional qualification;

Upon received the application under subrule (2), the Council may, with a written notice, request the applicant to provide further particulars, informations or documents, within the period of fourteen days.

If the applicant fails to comply with the request made within the period as specified under subrule (4), the Council may refuse the application by stating the reason of the refusal, without prejudice the new application issued by the applicant.

Where the application is refused, only the membership fee will be refunded to the applicant.

Issuance of the certificate of membership 3.

(1)

After the application under rule 2 is approved, the Council may issue a certificate of membership to the applicant.

The signature of the Registrar shall be endorsed on the photograph affixed to such certificate of membership.

All endorsed certificates of membership shall be signed by the President and the Registrar and sealed with the common seal of the Institute.

Upgrading of membership 4.

(1)

Any member may apply to the Council to upgrade the membership from the category of Licentiate to the category of Member or from the category of Member to the category of Fellow in such form and manner as determined by the Council.

Every application under subrule (1) shall be accompanied by a processing fee of fifty ringgit.

Retention of membership 5.

(1)

Every application for retention of membership in the register shall be made to the Council in any manner and form determined by the Council and accompanied

by a retention of membership fee of one hundred ringgit on or before 31 January of the said year.

If the application for the retention of membership is made after 31 January of the said year, an additional processing fee of fifty ringgit shall be imposed.

The retention of membership certificate shall be in a manner and form determined by the Council.

Where no application for retention of membership is made by the member before 30 June of the said year, his name will be removed from the register.

(5)

The Council may, on a written request, reduce or waive the retention of membership fee for a period of twelve months or more under circumstances of such member is pursuing education within or outside the country or for any other reason as the Council thinks necessary.

(6)

The Council may waive a retention of membership fee for any member who is over the age of sixty and has been a member for a continuous period of not less than fifteen years.

Title of a member of the Institute 6.

The member may use the abbreviated title “ChM” before his name.

Inspection of the registration of members 7.

Registration of member maintained by the Registrar shall be available for inspection under subsection 15(2) of the Act upon payment of fee of fifty ringgit.

Termination of membership 8.

Any member of the Institute may, at anytime, be terminated its membership if the Council is satisfied that the member—

(a)

has failed to pay the fee as specified in these Rules; or

PART III

MEETING OF THE COUNCIL AND ANNUAL GENERAL MEETING

Meeting of the Council 9.

(1)

The Secretary shall convene a meeting of the Council whenever required to do so by the President or at least two members of the Council making their requisition in writing.

Where a meeting is convened on the requisition of members of the Council, the notice of meeting shall state the purpose of the meeting to be convened.

The Secretary shall give to members of the Council, at least seven days notice of a meeting in writing, specifying the place, date, time and the purpose of the meeting to be convened.

Voting in the meeting of the Council 10.

(1)

Any resolution shall be proposed by any member of the Council and supported by at least three members of the Council before voting.

(2)

Voting shall be made by show of hands or by secret ballots as may be determined by the Chairman.

The Chairman shall declare the result of the voting whether the resolution specified under subrule (1) has been allowed or refused by majority members of the Council.

The declaration under subrule (3) shall be final and the record of the declaration in the minutes of the meeting shall be conclusive evidence.

If the number of votes are equal, the Chairman shall have a casting vote in addition to his deliberative vote.

Only members who are present in person may vote in the meeting.

Minutes of the meeting of the Council 11.

(1)

The minutes of the meeting of the Council shall be preserved in the form of written minutes and certified by the signature of the Chairman.

The Secretary shall cause the minutes of meeting to be maintained and kept in the proper form.

(3)

The Secretary shall circulate the minutes of the meeting to the members of the Council at least seven working days before the next meeting.

Annual general meeting 12.

(1)

The Council shall hold an annual general meeting or extraordinary general meeting by giving a written notice to the members of the Institute specifying the place, date, time and the purpose of the meeting—

(a)

at least twenty-one days before the annual general meeting is held;

or

(b)

at least fourteen days before any extraordinary general meeting is held.

(2)

If the purposes or one of the purposes of the annual general meeting is to make rules or to amend rules, the Council shall ensure that the notice of the meeting as in subrule (1) consist of or be accompanied with particulars of the proposed rules or amendments.

Any unintentional omission to give notice of a meeting as required by subrule (1) to one or more members of the Institute, shall not in any way, affect the validity of any thing done or agreed to at the meeting.

The quorum for a general meeting shall be thirty members which personally present and entitled to vote.

(5)

No business shall be conducted in any general meeting if the quorum is not present.

(6)

If a quorum is not present after half an hour from the time appointed for a general meeting, if convened upon a requisition of members, the meeting shall be dissolved, but in any other case it shall be adjourned to another day within one month period, and if a quorum is not present at the adjourned meeting, those members who are present and entitled to vote, whatever their number, shall constitute a quorum and may conduct the business for which the meeting was convened.

The agenda for annual general meeting shall include the following matters:

(a)

to receive and consider the annual report of the Institute;

to receive and consider the annual statement of account of the Institute and the auditors’ report;

to appoint qualified auditor and to determine his remuneration; and

(e)

to consider any other matter of which such notice in writing has been given to the Secretary by a member at least fourteen days before the meeting.

(1)

Every resolution submitted in the annual general meeting shall be decided by a simple majority of votes.

Only members who are present in person may vote in the meeting and the voting shall be made by show of hands or by secret ballots as may be determined by the Chairman.

If the number of votes are equal, the Chairman shall have a casting vote in addition to his deliberative vote.

If voting made by secret ballot, two scrutineers shall be elected by the members present by show of hands.

Minutes of the annual general meeting 14.

The minutes of the annual general meeting shall be made in the form of written minutes and certified by the Council.

The Secretary shall cause the minutes of the meeting to be maintained and kept in the proper form.

PART IV

EXAMINATION

The Board of Examination 15.

The Council shall appoint a Board of Examination which consist of qualified and experienced chemist.

Qualification to sit for the final examinations 16.

The following persons are qualified to sit for the final examinations—

(a)

graduates with a chemistry degree from a university not recognized by the Government;

graduates with a degree in science and technology other than degree in chemistry; and

(c)

person who possess Higher School Certificate or Sijil Tinggi Pelajaran

Malaysia or an equivalent qualifications with the condition chemistry as one of the subject and have attended a course recognized by the Institute.

Application for the final examinations 17.

(1)

An application to sit for the final examinations of the Institute shall be made in the form determined by the Council and the application shall be accompanied with a final examinations fee.

The application accompanied with a final examinations fee shall be submitted to the Secretary at least sixty days before the date set for the final examinations.

(3)

The Board of Examination shall endorse the eligibility of the applicants to sit for the final examinations.

If the application is rejected, the final examinations fee shall be refunded subject to the administration charges.

The final examinations 18.

(1)

The final examinations may be conduct annually by the Board of

Examination.

(2)

The Secretary shall make a public announcement of the date of the final examinations, place of the examination and the closing date for applications, at least ninety days before the date of the final examinations.

The honorarium to be paid to members of the Board of Examination shall be determined by the Council.

The Board of Examination shall recommend the criteria for passing the final examinations and responsible to submit the results of each final examinations with comments to the Council not later than sixty days after the date of final examinations ended.

The final examinations fee 19.

The final examinations fee is three hundred ringgit.

Syllabus 20.

(1)

The Board of Examination shall cause to publish, review and amend the syllabus for final examinations of the Institute from time to time.

The syllabus for the final examinations and its amendment shall be approved by the Council.

The Secretary shall, on written request from any person, supply a copy of the syllabus for the final examinations.

For the purpose of subrule (3), the Council may charge a fee for the copy of the syllabus.

Proof of identity 21.

Candidates for the final examinations of the Institute shall produce identification card or any documentary proof of identity in consistent with any laws of Malaysia for citizen of Malaysia, meanwhile a passport or any documentary proof of identity in consistent with any laws of Malaysia for non-citizen of Malaysian before being allowed to sit for the final examinations.

Result and certificate 22.

The Secretary shall deliver the result of the final examinations of the Institute not later than thirty days after the result is approved by the Council.

The certificate signed by the President and the Chairman of the Board of Examination and sealed with the common seal of the Institute shall be submitted to the successful candidate.

PART V

(1)

The Council shall appoint a Treasurer from among its members.

The Treasurer shall have the duties to—

(a)

receive and be responsible for all moneys payable by or paid to, the Institute;

(b)

prepare and present a statement of account at each meeting of the Council showing receipts and expenditure as on the last day of the previous month of the meeting;

(c)

prepare and present the audited annual statement of account together with the auditors’ report at each annual general meeting of the Institute; and

(d)

recommend a guideline on honorarium and other payments to be paid to members, members of the Council, salaried staff of the Institute and any approved person attending any functions and activities, subject to approval by the Council.

Assistant Treasurer 24.

The Council shall appoint an Assistant Treasurer from among its members to assist the Treasurer in his duties.

Expenditure of the funds of Institute 25.

(1)

The funds of the Institute shall be expended for the purposes of paying any expenditure in promoting and attaining the objects of the Institute, including—

(a)

the honorarium for the members of Institute, members of Council or any other body for services rendered to the Institute;

the remuneration, incentives or bonus of the salaried staff of the Institute;

Suggest a correction

(c)

any procurement of equipment, works or services following the guidelines approved by the Council;

Suggest a correction

(d)

to allocate and provide funds for the branches to organise any activity or function, subject to the approval of the Council; and

Suggest a correction

(e)

to reimburse the member of the Council or member of the Institute for the expenses incurred in discharging the duty and responsibilities as a member of the Council.

(2)

Notwithstanding subrule (1), the funds of the Institute shall not be used to pay fines imposed on members by any court.

Investment 26.

For the purpose of investment, the Council may, with the approval of the Minister, from time to time, consider using the funds not exceeding thirty percent of the total cash and cash equivalent of the Institute.

Bank account 27.

All payments received shall be deposited in the credit account of the

Institute as soon as possible with a bank approved by the Council, provided that the Treasurer may keep as petty cash a sum not exceeding one thousand ringgit.

The petty cash shall at all times be safely kept in the office of the Institute.

Cheques 28.

All cheques on the bank account of the Institute shall be signed by the President and the Treasurer or, in the absence of the President, the Vice-President or the Secretary to sign cheques in place of the President.

Safekeeping of accounts and records 29.

The Council shall cause to be kept and maintained proper accounts and records relating to—

(a)

the assets and liabilities of the Institute; and

The books of account and records shall be kept in the custody of the Treasurer or Assistant Treasurer or at such place as the Council may determine.

The accounts of the Institute, inclusive of branches’ accounts, shall at least once a year, be audited by one or more accredited auditor appointed by the Institute.

PART VI

GENERAL

Revocation 31.

The Chemists (General) Rules 1977 [P.U. (A) 10/1978] are revoked.

Saving and transitional 32.

(1)

All pending application for registration as member of the Institute before the Council made under the revoked Chemists (General) Rules 1977 shall, on the date of coming into operation of these Rules, be dealt in accordance with these Rules as if the application has been made under these Rules.

Any annual retention of membership issued under the revoked Chemists

(General) Rules 1977 which is still valid on the date of coming into operation of these

Rules shall continue to be valid until the date of its expiry.

During the period of validity of any applications for registration as member of the Institute and the annual retention of membership shall, as soon as practicable, make an application for annual retention of membership in accordance with these Rules.

(4)

Any person who is appointed as a Treasurer under the revoked Chemists

(General) Rules 1977 shall, on or after the coming into operation of these Rules, be deemed to have been duly appointed under these Rules and shall continue to hold such office until revoke or resign his office or been terminated or until the expiry of the term of office of such person.

Any documents, decisions, directions, statements, payments or audit report which has been decided before coming into operation of these Rules shall, upon commencement of these Rules, continue to be valid and binding until it is revoke by the Council.
