Jika perbuatan kebankrapan ialah keingkaran yang dibuat terhadap notis kebankrapan yang 8

dikeluarkan oleh peguam cara kepada pempetisyen, caj yang terkemudian tersebut ini tidak boleh dibenarkan

Jika perbuatan kebankrapan berbangkit di bawah perenggan 3(1)(a),

Akta Insolvensi 1967 [Akta 360], kehadiran khas

(sekiranya perlu) untuk memeriksa saksi tentang fakta yang mereka boleh buktikan hendaklah dibenarkan, caj baginya dan bagi memanggil saksi, atau bagi afidavit, hendaklah menurut budi bicara dan bolehlah termasuk suatu fi pendengaran kepada peguam yang hadir untuk menyokong petisyen itu 15.

Carian bagi petisyen yang terdahulu

Nota: Jika sesuatu petisyen yang terdahulu telah terlepas perhatian tiada kos atau caj selepas tarikh carian hendaklah dibenarkan dan apa-apa jumlah yang dibayar disebabkan petisyen terdahulu yang terlepas perhatian hendaklah dibayar semula kepada pemiutang atau kepada

Ketua Pengarah Insolvensi, mengikut mana-mana yang berkenaan, melainkan jika dibuktikan bahawa carian yang teliti semunasabahnya tidak akan mendedahkan petisyen terdahulu itu 8 16.

Menyediakan petisyen kebankrapan 14 17.

Menulis - Jika petisyen melebihi 7 folio, setiap folio 1 18.

Mengaku saksi tandatangan setiap pemiutang mempetisyen, kecuali jika pempetisyen dalam perkongsian 8 19.

Jika pemiutang mempetisyen ialah sebuah syarikat atau perbadanan dengan meterai 20 20.

Menyediakan afidavit dan salinan bersih afidavit mengesahkan petisyen 6 21.

Menemui pempetisyen untuk diangkat sumpah 8 22.

Dua salinan petisyen untuk dimeterai, setiap folio 1 23.

Menyediakan sapina dan menyampaikannya kepada saksi, atau berurusan dengan saksi bagi kehadiran mereka semasa penyampaian petisyen apabila perlu 20 24.

Insolvensi memperakui bahawa kos permohonan tersebut hendaklah dibenarkan 20 65.

Kehadiran di pemeriksaan awam jika mahkamah fikirkan kehadiran itu perlu

Kos yang berikut selepas perintah kebankrapan bolehlah dibenarkan atas suatu perakuan bertulis

RM100.00 atau 5% daripada amaun bil tetapi tidak melebihi RM50.00

Tiada caj, kecuali caj yang termasuk di bawah butiran 1 hingga 69 boleh dibenarkan dalam keadaan petisyen penghutang atau petisyen pemiutang yang tidak ditentang melainkan jika dalam keadaan petisyen pemiutang yang ditentang itu

Penetapan mempertimbangkan bahawa disebabkan alasan-alasan khas butiran-butiran tambahan boleh dibenarkan

Jika petisyen itu ditentang, kos boleh dibenarkan sebagai tambahan bagi perkara-perkara yang perlu yang tidak diperuntukkan di bawah butiran 1 hingga 69; elaun berkenaan hendaklah dibuat sesuai dengan skala tersebut dengan seberapa hampir yang boleh, dengan skala kos di Mahkamah Tinggi, menurut sifat prosiding

Bagi penyenaraian dan penilaian harta catel:

Atas RM3,000.00 yang pertama 1%

RM3,001.00 hingga RM6,000.00 0.5%

RM6,001.00 dan ke atas 0.25%

Sebagai tambahan, broker hendaklah berhak kepada perbelanjaan pengangkutan yang munasabah yang sebenarnya dibayar.

Caj pelelong

Bagi jualan secara kontrak persendirian berdasarkan kepada penilaian, separuh daripada caj yang diberikan di atas bagi inventori dan penilaian.

Bagi jualan secara lelongan, termasuk kesemua perbelanjaan kecuali kos pengiklanan surat khabar, cetakan pekeliling, pengangkutan dan perbelanjaan lain sebagaimana Pendaftar fikirkan munasabah—

Mengenai harta catel —

Atas RM3,000.00 yang pertama 4%

RM3,001.00 hingga RM6,000.00 3%

RM6,001.00 dan ke atas 2%

Mengenai estet, pegangan bebas, pegangan pajak, dsb. termasuk penilaian yang terdahulu bagi menentukan amaun rizab tawaran—

Semua prosiding, tindakan atau apa-apa perkara lain yang dikehendaki untuk dibuat atau yang masih belum selesai sebaik sebelum mula berkuatkuasanya

Kaedah-Kaedah ini hendaklah tidak terkesan dengan Kaedah-Kaedah ini dan hendaklah diteruskan seolah-olah Kaedah-Kaedah ini tidak pernah dibuat.

  1. IN exercise of the powers conferred by section 123 of the Insolvency Act 1967 [Act 360], the Minister makes the following rules: Citation and commencement 1.

These rules may be cited as the Insolvency (Costs) (Amendment)

Rules 2017.

These Rules come into operation on 6 October 2017.

General amendment 2.

The Insolvency (Cost) Rules 1969 [P.U. (A) 200/1969], which are referred to as the “principal Rules” in these Rules, are amended—

Amendment of rule 1 3.

The principal Rules are amended in rule 1 by deleting subrule (b).

Amendment of rule 3 4.

The principal Rules are amended in rule 3 by substituting for the words “on the lower scale in the Second Schedule to the Rules of the Supreme Court, 1957, in the State of Malaya or to the corresponding Rules of the Supreme Court in Sabah or Sarawak as the case may be” the words “in accordance with Rules of Court 2012

[P.U. (A) 205/2012]”.

Amendment of rule 4 5.

The principal Rules are amended in rule 4 by substituting for the words “States of Malaya by Part VIII of the Advocates and Solicitors Ordinance, 1947, and Schedules III and IV thereto” the words “Legal Profession Act 1976 [Act 166]”.

Amendment of rule 8 6.

The principal Rules are amended in rule 8 by substituting for the words ‘13”X8” ' the words “approximately 297mm. (11.69 inches) long, by 210mm.

(8.27 inches) wide, having a margin, not less than 1 inch wide to be left blank on either side of the paper”.

Substitution of heading and items 7.

The principal Rules are amended by substituting the heading and items after rule 21 with the following Schedule:

Proper charges for further attendances on creditors and other work necessarily done by a solicitor in connection with the appointment of a special manager shall be allowed, but no costs shall be allowed on an unsuccessful application unless the Director General of Insolvency shall certify that the costs of the application should be allowed 20 65.

The following costs subsequent to bankruptcy order may also be allowed upon a certificate in writing of the Director General of Insolvency that the attendance was necessary in the interest of the estate and shall not be exceeded unless specially authorised by him 30 66.

In exceptional cases the Taxing Officer may, upon a certificate by the Director General of Insolvency allow charges for such services prior to the presentation of the petition
