Permohonan
Suatu permohonan bagi pengambilan mana-mana tanah di bawah perenggan 3(1)(b) atau (c) Akta hendaklah dibuat oleh pemohon kepada
Pentadbir Tanah dalam Borang 1 Jadual Pertama.
Permohonan di bawah subkaedah (1) hendaklah disertai dengan fi sebagaimana yang ditetapkan dalam Jadual Kedua Kaedah-Kaedah ini dan dokumen lain yang dinyatakan dalam perenggan 3(3)(a), (b) dan (c) Akta.

Deposit
Pemohon yang membuat permohonan di bawah subkaedah 2(1)
hendaklah membayar deposit pada kadar satu ratus dua puluh lima peratus daripada nilai pasaran yang dianggarkan tanah yang hendak diambil itu, sebagaimana yang dinyatakan dalam perenggan 3(3)(c) Akta.
Pembayaran deposit hendaklah mengikut cara yang berikut:
lima puluh peratus daripada deposit itu hendaklah dikemukakan bersama dengan permohonan; dan
tujuh puluh lima peratus baki deposit hendaklah dikemukakan semasa penyetujuterimaan terma dan syarat kelulusan yang dikenakan oleh Pihak Berkuasa Negeri sebagaimana yang dinyatakan dalam perenggan 8(2)(c) Kaedah-Kaedah ini.
Deposit di bawah subkaedah (1) hendaklah dibayar dalam bentuk draf bank.
Deposit tambahan
Deposit tambahan boleh dikenakan kepada pemohon jika pampasan yang diawardkan di bawah seksyen 14 Akta atau amaun yang dituntut oleh orang yang berkepentingan yang dibuat di hadapan Pentadbir Tanah di bawah seksyen 12 Akta lebih tinggi daripada deposit yang dibayar di bawah subkaedah 3(1).
Pentadbir Tanah boleh mengeluarkan Borang 2 Jadual Pertama yang menghendaki pemohon untuk membayar deposit tambahan dalam tempoh tiga puluh hari dari tarikh penerimaan Borang itu.
Pertimbangan Pentadbir Tanah
Jika Pentadbir Tanah berpuas hati dengan permohonan di bawah subkaedah 2(1) dan terdapat kelulusan pembangunan diberikan, Pentadbir Tanah hendaklah menghantar permohonan itu berserta dengan dokumen iringan kepada

Unit Perancangan Ekonomi Negeri atau Jawatankuasa bagi Wilayah Persekutuan
Kuala Lumpur, mengikut mana-mana yang berkenaan.
Pentadbir Tanah boleh menolak permohonan di bawah subkaedah 2(1)
jika permohonan itu tidak mematuhi kehendak subseksyen 3(3) Akta dan pengambilan tanah itu bukan bagi maksud kegunaan awam.

Unit
Perancangan
Ekonomi
Negeri atau
Jawatankuasa bagi
Wilayah Persekutuan Kuala Lumpur boleh menimbangkan permohonan yang disebut dalam subkaedah 5(1) berdasarkan perkara yang dinyatakan dalam subseksyen 3A(1)
Akta.
Jika terdapat kelulusan pembangunan diberikan kepada tuan punya berdaftar dan pengambilan tanah bagi maksud kegunaan awam, Unit Perancangan
Ekonomi Negeri atau Jawatankuasa bagi Wilayah Persekutuan Kuala Lumpur, mengikut mana-mana yang berkenaan, hendaklah menentukan kewajaran bagi tuan punya berdaftar untuk menyertai projek yang baginya tanah itu dicadangkan untuk diambil.
Jika Unit Perancangan Ekonomi Negeri atau Jawatankuasa bagi
Wilayah Persekutuan Kuala Lumpur, mengikut mana-mana yang berkenaan, berpuas hati bahawa adalah wajar bagi tuan punya berdaftar untuk menyertai projek yang baginya tanah itu dicadangkan untuk diambil, ia hendaklah mengarahkan pemohon untuk berunding dengan tuan punya berdaftar dan memberikan suatu notis bertulis dalam Borang 3 Jadual Pertama kepada pemohon dalam tempoh enam minggu dari tarikh penerimaan permohonan yang disebut dalam subkaedah 5(1).
Laporan penuh perundingan
Pemohon hendaklah memberikan suatu laporan penuh perundingan yang disebut dalam subkaedah 6(3) kepada Unit Perancangan Ekonomi Negeri atau
Jawatankuasa bagi Wilayah Persekutuan Kuala Lumpur.

Jika perundingan di bawah subkaedah 6(3) berjaya, Unit Perancangan
Ekonomi Negeri atau Jawatankuasa bagi Wilayah Persekutuan Kuala Lumpur hendaklah tidak meneruskan permohonan yang disebut dalam subkaedah 5(1).
Bagi maksud subkaedah (2), Pentadbir Tanah hendaklah membayar balik amaun deposit yang telah dibayar di bawah perenggan 3(2)(a) Kaedah-Kaedah ini tanpa pembayaran apa-apa faedah dalam tempoh tiga bulan dari tarikh permintaan untuk bayaran balik deposit penuh yang dibuat oleh pemohon.
Jika perundingan di bawah subkaedah 6(3)
tidak berjaya,
Unit Perancangan Ekonomi Negeri atau Jawatankuasa bagi Wilayah Persekutuan
Kuala Lumpur hendaklah—
tuan punya berdaftar tidak dipaksa untuk menyertai projek; dan
Pihak Berkuasa Negeri boleh mengenakan apa-apa syarat nyata dan sekatan kepentingan ke atas tanah.
Unit

Ekonomi

Wilayah Persekutuan Kuala Lumpur, setelah menimbangkan permohonan yang disebut dalam subkaedah 5(1), laporan penuh perundingan di bawah subkaedah (1) dan syor di bawah perenggan (4)(b) Kaedah-Kaedah ini, hendaklah menghantar notis dalam
Borang 4 Jadual Pertama kepada Jawatankuasa Khas Pengambilan Tanah atau
Pihak Berkuasa Negeri dalam tempoh empat belas hari dari tarikh penerimaan laporan penuh perundingan di bawah subkaedah (1).

Keputusan Pihak Berkuasa Negeri
Pihak Berkuasa Negeri boleh meluluskan atau menolak permohonan yang dibuat di bawah subkaedah 2(1).
Jika Pihak Berkuasa Negeri meluluskan permohonan yang dibuat di bawah subkaedah 2(1)—
Pihak Berkuasa Negeri hendaklah memberitahu Pentadbir Tanah tentang kelulusan itu dan apa-apa terma dan syarat sebagaimana yang difikirkannya patut;
Pentadbir Tanah hendaklah memberitahu pemohon tentang kelulusan itu dalam Borang 5 Jadual Pertama dalam tempoh empat belas hari dari tarikh penerimaan kelulusan itu; dan
pemohon hendaklah menjawab kepada Pentadbir Tanah dalam tempoh masa tiga puluh hari dari tarikh penerimaan pemberitahuan untuk mengesahkan penyetujuterimaan terma dan syarat kelulusan itu.
Jika Pihak Berkuasa Negeri menolak permohonan yang dibuat di bawah subkaedah 2(1)—
Pihak Berkuasa Negeri hendaklah memberitahu Pentadbir Tanah tentang penolakan itu;
Pentadbir Tanah hendaklah memberitahu pemohon tentang penolakan itu dalam Borang 6 Jadual Pertama dalam tempoh empat belas hari dari tarikh penerimaan penolakan itu; dan
Pentadbir Tanah hendaklah membayar balik amaun deposit yang telah dibayar di bawah perenggan 3(2)(a) Kaedah-Kaedah ini

tanpa pembayaran apa-apa faedah kepada pemohon dalam tempoh masa tiga bulan dari tarikh penerimaan penolakan itu.
Penarikan balik permohonan
Mana-mana pemohon boleh menarik balik permohonan bagi pengambilan mana-mana tanah, sepenuhnya atau sebahagiannya, di bawah subseksyen 3F(1) Akta dengan memberikan suatu notis secara bertulis kepada Pentadbir Tanah.
Permohonan pengambilan mana-mana tanah disifatkan sebagai ditarik balik, jika:
pemohon gagal untuk mengemukakan laporan penuh perundingan kepada Unit Perancangan Ekonomi Negeri atau Jawatankuasa bagi
Wilayah Persekutuan Kuala Lumpur dalam tempoh masa yang ditetapkan dalam Borang 3 Jadual Pertama; atau
pemohon gagal untuk mengesahkan penyetujuterimaan terma dan syarat kelulusan dalam tempoh masa yang ditetapkan di bawah perenggan 8(2)(c) Kaedah-Kaedah ini.
Jika penarikan balik permohonan di bawah subkaedah (1) dibuat sebelum penyiaran pemberitahuan di bawah seksyen 8 Akta atau permohonan yang disifatkan sebagai ditarik balik di bawah subkaedah (2) —
Pentadbir Tanah hendaklah mengenakan fi bagi penarikan balik permohonan bagi pengambilan tanah sebagaimana yang ditetapkan dalam Jadual Kedua;
Pentadbir Tanah hendaklah memberitahu pemohon berkenaan dengan pelucuthakan deposit melalui notis dalam Borang 7
Jadual Pertama; dan

(c)
Pentadbir Tanah boleh melucuthak deposit sebanyak lima puluh peratus atau RM10,000.00, yang mana lebih tinggi, berdasarkan peringkat yang padanya permohonan itu ditarik balik.

Walau apa pun perenggan (3)(c), Pihak Berkuasa Negeri, menurut budi bicaranya, boleh mengurangkan pelucuthakan amaun tidak kurang daripada sepuluh peratus daripada keseluruhan deposit tersebut atau RM10,000.00, yang mana lebih tinggi.

Jika pemohon menarik balik permohonan di bawah subkaedah (1) selepas penyiaran pemberitahuan di bawah seksyen 4 Akta atau permohonan yang disifatkan sebagai ditarik balik di bawah subkaedah (2), pampasan bagi kerosakan pada mana-mana tanah yang disebabkan oleh mana-mana orang yang diberi kuasa di bawah subseksyen 5(1) Akta hendaklah dibayar mengikut seksyen 6 Akta.

Tertakluk kepada subkaedah (5), pampasan hendaklah dibayar daripada pelucuthakan deposit yang dibuat di bawah perenggan (3)(c) Kaedah-Kaedah ini dan
Pihak Berkuasa Negeri boleh mengarahkan pemohon secara bertulis untuk membuat pembayaran tambahan sekiranya amaun pampasan lebih besar daripada amaun pelucuthakan deposit.
BAHAGIAN III
PENDUDUKAN ATAU PENGGUNAAN SEMENTARA TANAH
Permohonan 10.
(1)
Suatu permohonan bagi pendudukan atau penggunaan sementara tanah di bawah subseksyen 57(1) Akta hendaklah dibuat oleh pemohon kepada
Pentadbir Tanah dalam Borang 8 Jadual Pertama.
(2)
Permohonan di bawah subkaedah (1) hendaklah disertai dengan fi sebagaimana yang ditetapkan dalam Jadual Kedua.

(3)
Pentadbir Tanah atau pihak berkuasa mendaftar lain hendaklah membuat suatu nota tentang apa-apa pendudukan atau penggunaan sementara tanah sebagaimana yang dinyatakan dalam subseksyen 57(2) Akta.
Deposit 11.
Pemohon yang membuat permohonan di bawah subkaedah 10(1) hendaklah membayar deposit pada kadar seratus dua puluh lima peratus daripada nilai pasaran yang dianggarkan tanah yang hendak diambil itu sebagaimana yang dinyatakan dalam perenggan 3(3)(c) Akta, dan kena dibayar dalam bentuk draf bank dengan mengikut cara yang dinyatakan dalam subkaedah 3(2).
Pemulihan tanah 12.
(1)
Apabila tamat tempoh pendudukan dan penggunaan tanah secara sementara, tanah itu hendaklah dibaik pulih sebagaimana keadaannya sebelum permohonan di bawah subkaedah 10(1) dibuat.
(2)
Pentadbir Tanah hendaklah memberi suatu notis secara bertulis dalam
Borang 9 Jadual Pertama kepada orang yang berkepentingan dalam pendudukan atau penggunaan sementara tanah bahawa suatu siasatan akan dijalankan untuk memastikan tanah itu dibaik pulih.
(3)
Selepas penyempurnaan siasatan di bawah subkaedah (2), suatu notis serahan balik tanah dalam Borang 10 Jadual Pertama hendaklah dikeluarkan kepada orang yang berkepentingan dalam pendudukan atau penggunaan sementara tanah.
BAHAGIAN IV
PEMBATALAN DAN PERUNTUKAN PERALIHAN
Pembatalan dan peruntukan kecualian 13.
(1)
Kaedah-Kaedah Pengambilan Tanah 1998 [P.U. (A) 70/1998] dibatalkan.
(2)
Walau apa pun subkaedah (1), apa-apa permohonan atau perkara lain yang berkaitan yang sedang atau telah dibuat sebaik sebelum permulaan kuat kuasa
Kaedah-Kaedah ini hendaklah, selepas permulaan kuat kuasa Kaedah-Kaedah ini,

LAND ACQUISITION ACT 1960

IN exercise of the powers conferred by section 69
of the
Land Acquisition Act 1960 [Act 486] as modified by the Federal Territory (Modification of Land Acquisition Act, 1960) Order 1974 [P.U. (A) 81/1974], Federal Territory of
Putrajaya (Modification of Land Acquisition Act 1960) Order 2002 [P.U. (A) 200/2002]
and Federal Territory of Labuan (Extension and Modification of Land Acquisition Act)
Order 2009 [P.U. (A) 455/2009], the Minister, with the approval of the National Land
Council, makes the following rules:
PART I
PRELIMINARY
Citation and commencement 1.
(1)
These rules may be cited as the Land Acquisition Rules 2017.
(2)
These Rules come into operation on 1 December 2017.
PART II
LAND ACQUISITION
Application 2.
(1)
An application for acquisition of any land under paragraph 3(1)(b) or (c)
of the Act shall be made by the applicant to the Land Administrator in Form 1 of the
First Schedule.
(2)
The application under subrule (1) shall be accompanied with the fees as prescribed in the Second Schedule of these Rules and other documents as specified in paragraphs 3(3)(a), (b) and (c) of the Act.

Deposit 3.
(1)
The applicant who make an application under subrule 2(1) shall pay deposit at the rate of one hundred and twenty-five per centum of the estimated market value of the land to be acquired, as specified in paragraph 3(3)(c) of the Act.
(2)
The payment of deposit shall be in the following manner:
(a)
fifty per centum of the deposit shall be presented together with the application; and
(b)
the balance of seventy-five per centum of the deposit shall be presented upon acceptance of the terms and conditions of approval imposed by the State Authority as specified in paragraph 8(2)(c) of these Rules.
(3)
The deposit under subrule (1) shall be paid in the form of a bank draft.
Additional deposit 4.
(1)
The additional deposit shall be chargeable to the applicant if the compensation awarded under section 14 of the Act or the amount claimed by the person interested made before the Land Administrator under section 12 of the Act is higher than the deposit paid under subrule 3(1).
(2)
The Land Administrator may issue Form 2 of the First Schedule which require the applicant to pay an additional deposit within a period of thirty days of the receipt of the Form.
Consideration by Land Administrator 5.
(1)
Where the Land Administrator is satisfied with the application under subrule 2(1) and there is a development approval granted, the Land Administrator shall transmit the application together with the accompanying documents to the
State Economic Planning Unit or the Committee for the Federal Territory of
Kuala Lumpur, as the case may be.

(2)
The Land Administrator may reject the application under subrule 2(1)
if such application does not comply with the requirements of subsection 3(3) of the Act and the land acquisition is not for the purpose of public utility.
Deliberation by State Economic Planning Unit or the Committee for the
Federal Territory of Kuala Lumpur 6.
(1)
The State Economic Planning Unit or the Committee for the
Federal Territory of Kuala Lumpur may consider the application referred to in subrule 5(1) based on the matters specified in subsection 3A(1) of the Act.
(2)
Where there is a development approval granted to the registered proprietor and the acquisition of the land is for the purpose of public utility, the State
Economic Planning Unit or the Committee for the Federal Territory of Kuala Lumpur, as the case may be, shall determine the justification for the registered proprietor to participate in the project for which the land is intended to be acquired.
(3)
Where the State Economic Planning Unit or the Committee for the
Federal Territory of Kuala Lumpur, as the case may be, is satisfied that it is appropriate for the registered proprietor to participate in the project for which the land is intended to be acquired, it shall direct the applicant to negotiate with the registered proprietor and give a written notice in the Form 3 of the First Schedule to the applicant within a period of six weeks from the date of receipt of the application referred to in subrule 5(1).
Full report of negotiation 7.
(1)
The applicant shall furnish a full report of negotiation referred to in subrule 6(3) to the State Economic Planning Unit or the Committee for the
Federal Territory of Kuala Lumpur.
(2)
Where the negotiation under subrule 6(3) is successful, the State
Economic Planning Unit or the Committee for the Federal Territory of Kuala Lumpur shall not proceed with the application referred to in subrule 5(1).

(3)
For the purpose of subrule (2), the Land Administrator shall refund the amount of deposit paid under paragraph 3(2)(a) of these Rules without payment of any interest within a period of three months from the date of request to refund the full amount of deposit is made by the applicant.
(4)
Where the negotiation under subrule 6(3) is unsuccessful, the State
Economic Planning Unit or the Committee for the Federal Territory of Kuala Lumpur shall—
(a)
proceed the application referred to in subrule 5(1); and
(b)
make any recommendation as it deems fit that:
(i)
the registered proprietor is not compel to participate in the project; and
(ii)
the State Authority may impose any express condition and restriction in interest of the land.
(5)
The State Economic Planning Unit or the Committee for the
Federal Territory of Kuala Lumpur, after considering the application referred to in subrule 5(1), full report of negotiation under subrule (1) and recommendation under paragraph (4)(b) of these Rules, shall transmit a notice in Form 4 of the First Schedule to the Jawatankuasa Khas Pengambilan Tanah or the State Authority within a period of fourteen days from the date of receipt of the full report of negotiation under subrule (1).
Decision of State Authority 8.
(1)
The State Authority may approve or reject the application made under subrule 2(1).
(2)
Where the State Authority approves the application made under subrule 2(1)—

(a)
the State Authority shall notify the Land Administrator of the approval and such terms and conditions as he deems fit;
(b)
the Land Administrator shall notify the applicant of the approval in
Form 5 of the First Schedule within a period of fourteen days from the date of receipt of the approval; and
(c)
the applicant shall reply to the Land Administrator within thirty days of the receipt of the notification to confirm his acceptance of the terms and conditions of the approval.
(3)
Where the State Authority rejects the application made under subrule 2(1)—
(a)
the State Authority shall notify the Land Administrator of such rejection;
(b)
the Land Administrator shall notify the applicant of the rejection in
Form 6 of the First Schedule within a period of fourteen days from the date of receipt of the rejection; and
(c)
the Land Administrator shall refund the amount of deposit paid under paragraph 3(2)(a) of these Rules without payment of any interest to the applicant within a period of three months from the date of receipt of the rejection.
Withdrawal of application
9.
(1)
Any applicant may withdraw the application for acquisition of any land, in whole or in part thereof, under subsection 3F(1) of the Act by giving a notice in writing to the Land Administrator.
(2)
The application of any land acquisition is deemed to have been withdrawn, if:

(a)
the applicant fails to furnish a full report of negotiation to the State Economic Planning Unit or the Committee for the
Federal Territory of Kuala Lumpur within the stipulated time in Form 3 of the First Schedule; or
(b)
the applicant fails to confirm his acceptance of the terms and conditions of approval within the stipulated time under paragraph 8(2)(c) of these Rules.
(3)
Where the withdrawal of application under subrule (1) is made before the publication of notification under subsection 8 of the Act or the application is deemed to have been withdrawn under subrule (2)—
(a)
the Land Administrator shall impose fee for withdrawal of application for land acquisition as prescribed in the
Second Schedule;
(b)
the Land Administrator shall notify the applicant relating to the forfeiture of deposit by notice in Form 7 of the
First Schedule; and
(c)
the Land Administrator shall forfeit the deposit of fifty per centum or RM10,000.00, whichever is higher, based on the stage at which the application is withdrawn.
(4)
Notwithstanding paragraph (3)(c), the State Authority, in his discreation, may remit the forfeiture amount to not less than ten per centum of the total deposit or
RM10,000.00, whichever is higher.
(5)
Where the applicant withdraws the application under subrule (1) after the publication of notification under section 4 of the Act or the application is deemed to have been withdrawn under subrule (2), the compensation for damage to any land

caused by any person authorized under subsection 5(1) of the Act shall be paid in accordance with section 6 of the Act.
(6)
Subject to subrule (5), the compensation shall be paid from the forfeiture of deposit made under paragraph (3)(c) of these Rules and the State Authority may direct the applicant in writing to make an additional payment if the compensation amount is greater than the forfeiture amount of deposit.
PART III
TEMPORARY OCCUPATION OR USE OF LAND
Application 10.
(1)
An application for temporary occupation or use of land under subsection 57(1) of the Act shall be made by the applicant to the Land Administrator in
Form 8 of the First Schedule.
(2)
The application under subrule (1) shall be accompanied with the fees as prescribed in the Second Schedule.
(3)
The Land Administrator or other registering authority shall make a note of any temporary occupation or use of land as specified in subsection 57(2) of the Act.
Deposit 11.
The applicant who make an application under subrule 10(1) shall pay a deposit at the rate of one hundred and twenty-five per centum of the estimated market value of the land to be acquired as specified in a paragraph 3(3)(c) of the Act, and payable in the form of a bank draft by following manners specified in subrule 3(2).
Restoration of land 12.
(1)
On the expiration of the term of temporary occupation or use of land, the land shall be restored to the condition it was in before the application under subrule 10(1) is made.

(2)
The Land Administrator shall give a notice in writing in Form 9 of the
First Schedule to persons interested in the temporary occupation or use of land that an enquiry will be conducted to ensure the land is restored.
(3)
Upon completion of enquiry under subrule (2), a notice of surrender of land in Form 10 of the First Schedule shall be issued to persons interested in the temporary occupation or use of land.
PART IV
REVOCATION AND SAVING
Revocation and savings 13.
(1)
The Land Acquisition Rules 1998 [P.U. (A) 70/1998] is revoked.
(2)
Notwithstanding subrule (1), any application or other related matters which is in the course of being made or had been made immediately before the commencement of these Rules shall, after the commencement of these Rules, be continued and executed under and in accordance with the revoked Rules.
