Section 31

Wherever it is proved to the satisfaction of any Court having jurisdiction that a breach of any of the provisions of these rules has been committed by any person employed on the land in respect of which such breach has been committed, the employer shall be held to be liable for such breach, and to the penalty provided therefor, unless he shall prove to the satisfaction of such Court that the same was committed without his knowledge or consent and that he had taken all reasonable means to prevent the same and to enforce the observance of such provisions:

Provided that nothing contained in this rule shall be deemed to exempt such first mentioned person from liability in respect of any penalty provided by these rules for any breach proved to have been committed by him.
