Calculation of return or interest on protected benefit for discretionary payment

Section 89
For the purpose of calculating the payment of the Corporation in respect of any protected benefit where the Corporation makes a discretionary payment—
(a)
subject to paragraph (b), the return or interest accrued in relation to the takaful or insurance benefit shall be included only to the date of the payment by the Corporation; or
(b)
if a proceeding for the winding up of the insurer member has been commenced before the date of the payment by the
Corporation but a winding up order has not yet been made, the return or interest accrued shall be included only to the date of the filing of the petition for the winding up.
