(1)
Subject to paragraph (2), the owner and person in charge of every small ship shall cause to be kept on board at all times the appropriate safety equipment relating to the small ship specified in the Fourth Schedule.
(2)
Notwithstanding paragraph (1), a licensing authority may, if he is satisfied that it is impracticable on account of her size for a small ship to carry all the safety equipment required by paragraph (1) and the Fourth Schedule, modify the requirements for that small ship and make a note of such modifications on the small ship’s licence and in the register.
