Section 56
(1)
Any person who, without reasonable excuse, contravenes or fails to observe any customary prohibition during such period of time or circumstances as may be required under his or her custom to observe commits a breach of native customary law and shall be liable -
(i)
to pay to the aggrieved party sogit not exceeding 3 fowls; or
(ii)
in default thereof -
(a)
to a fine not exceeding 100 ringgit; or
(b)
to an imprisonment for a term not exceeding 1 week; or
(c)
to both fine and imprisonment.
(2)
In this rule, “customary prohibitions” means any act or activity which is prohibited to be done under native customary law as a mark or symbol of respect and reverence of any event or incident which by its nature is regarded as divinely sacred under native custom.
