Seksyen 2

Dalam Peraturan-Peraturan ini, melainkan jika konteksnya menghendaki makna yang lain—

“makmal DNA” ertinya suatu makmal yang menjalankan analisis forensik DNA ke atas sampel intim atau bukan intim yang diambil daripada tubuh badan manusia atau dari tempat kejadian jenayah, di Jabatan Kimia Malaysia atau Makmal Forensik Polis

Diraja Malaysia atau mana-mana agensi atau badan sebagaimana yang dinamakan oleh

Menteri menurut seksyen 5 Akta;

“pakej DNA” ertinya pakej atau bekas yang mengandungi sampel intim atau bukan intim yang telah dilabel dengan tanda pengenalan dan dilak seperti yang dikehendaki di bawah peraturan 8 dan 9, mengikut mana-mana yang berkenaan.

Seksyen 3

Kebenaran untuk mengambil sampel intim atau sampel bukan intim

Bagi maksud pengambilan sampel intim atau sampel bukan intim daripada mana-mana orang yang dirujuk di bawah seksyen 12 atau 13 Akta, pegawai diberi kuasa hendaklah memberikan kebenarannya secara bertulis dalam borang yang dinyatakan dalam Jadual Pertama.

Maklumat yang akan diberikan sebelum membuat suatu permintaan bagi pengambilan sampel intim 4.

Jika sesuatu sampel intim hendak diminta daripada seseorang, pegawai polis hendaklah memaklumi orang itu—

(d)

bahawa sampel intim hendaklah dianalisis dan keputusan analisis tersebut boleh digunakan sebagai keterangan di dalam penyiasatan jenayah, pendakwaan atau bagi tujuan lain.

Maklumat yang akan diberikan sebelum membuat suatu permintaan bagi pengambilan sampel bukan intim 5.

Jika sesuatu sampel bukan intim hendak diminta daripada seseorang, pegawai polis hendaklah memaklumi orang itu—

alasan dan tujuan sampel bukan intim itu diminta; dan

(c)

bahawa sampel bukan intim itu hendaklah dianalisis dan keputusan analisis tersebut boleh digunakan sebagai keterangan di dalam penyiasatan jenayah, pendakwaan atau bagi tujuan lain.

Keizinan yang berkenaan hendaklah diberi sebelum pengambilan sampel intim 6.

Bagi maksud pengambilan sampel intim daripada—

seseorang yang semunasabahnya disyaki telah melakukan suatu kesalahan;

banduan, keizinan yang berkenaan hendaklah diberi oleh orang yang daripadanya sampel intim itu diambil dalam borang yang dinyatakan dalam Jadual Kedua.

Keizinan yang berkenaan hendaklah diberi sebelum pengambilan sampel intim atau bukan intim yang diberikan secara sukarela 7.

Bagi maksud pengambilan sampel intim atau bukan intim yang diberikan secara sukarela, keizinan yang berkenaan hendaklah diberi oleh orang yang memberikan sampel intim atau bukan intim secara sukarela itu dalam borang yang dinyatakan di dalam Jadual Ketiga.

Tatacara bagi pengambilan sampel intim 8.

Seseorang pegawai perubatan kerajaan yang mengambil sampel intim daripada mana-mana orang hendaklah memastikan bahawa tatacara bagi pengambilan sampel intim itu dilaksanakan dengan suatu cara yang selaras dengan standard perubatan atau badan profesional yang berkaitan.

Pegawai perubatan kerajaan itu hendaklah memastikan bekas yang mengandungi sampel intim atau pakej yang mengandungi bekas sampel intim itu—

(c)

diserahkan kepada pegawai polis yang bertanggungjawab bagi pemungutan sampel intim tersebut.

Tanda pengenalan yang disebut dalam perenggan (2)(a) hendaklah termasuk—

(a)

nama orang yang daripadanya suatu sampel intim diambil;

nombor kad pengenalan, nombor pasport atau apa-apa pengenalan lain orang itu, mengikut mana-mana yang berkenaan;

Seseorang pegawai perubatan kerajaan, pegawai polis atau ahli kimia yang mengambil suatu sampel bukan intim daripada mana-mana orang hendaklah memastikan bahawa tatacara bagi pengambilan sampel bukan intim itu dilaksanakan dengan suatu cara yang selaras dengan standard perubatan atau badan profesional yang berkaitan.

Pegawai perubatan kerajaan, pegawai polis atau ahli kimia itu hendaklah memastikan bekas yang mengandungi sampel bukan intim atau pakej yang mengandungi bekas sampel bukan intim itu—

Tatacara bagi pengambilan sampel intim atau bukan intim di tempat kejadian jenayah 10.

Apabila suatu sampel intim atau bukan intim ditemui—

pada apa-apa benda atau di mana-mana tempat suatu kesalahan dilakukan;

pada atau di dalam tubuh mangsa suatu kesalahan;

(c)

pada apa-apa benda yang dipakai atau dibawa oleh mangsa suatu kesalahan pada masa kesalahan itu dilakukan; atau

(d)

pada atau di dalam tubuh mana-mana orang yang semunasabahnya disyaki melakukan suatu kesalahan, pegawai polis yang mengambil sampel intim atau bukan intim dari tempat kejadian jenayah hendaklah memastikan tatacara bagi pengambilan sampel intim atau bukan intim itu dilaksanakan dalam suatu cara yang selaras dengan Perintah Tetap, yang dikeluarkan oleh Ketua Polis Negara menurut seksyen 97 Akta Polis 1967 [Akta 344] .

Semua pakej DNA yang dipungut sebelum penghantaran ke makmal DNA hendaklah disimpan dengan selamat.

Pegawai polis yang bertanggungjawab bagi pemungutan sampel intim atau bukan intim yang disebut dalam perenggan 8(2)(c) dan 9(2)(c) hendaklah menghantar pakej DNA kepada makmal DNA dalam tempoh yang munasabah.

Pakej DNA yang diserahkan kepada makmal DNA untuk analisis forensik hendaklah disertakan bersama suatu surat permohonan daripada pegawai polis.

Ketua Bank Data DNA hendaklah memastikan sampel intim atau bukan intim yang diterima disimpan di lokasi selamat yang dinamakan di makmal DNA.

Ketua Bank Data DNA hendaklah mewujudkan dan menyenggara suatu daftar bagi maksud menguruskan penyimpanan sampel intim dan bukan intim.

Sampel intim dan bukan intim hendaklah dianalisis dan disenggara mengikut tatacara makmal DNA yang standard.

Apabila mendapat notis penyerahan profil DNA dan apa-apa maklumat berhubung dengannya oleh makmal DNA, pegawai Bank Data DNA hendaklah terlebih dahulu menilai profil DNA dan apa-apa maklumat berhubung dengannya.

Pegawai Bank Data DNA hendaklah kemudiannya memuat naik profil DNA dan apa-apa maklumat berhubung dengannya ke dalam indeks Bank Data masing-masing.

Suatu daftar hendaklah disenggarakan untuk merekod maklumat berhubung dengan semua profil DNA dan apa-apa maklumat berhubung dengannya yang dimuat naik ke dalam indeks Bank Data masing-masing.

Ketua Bank Data DNA hendaklah, tanpa kelengahan, memusnahkan mana-mana bahagian sampel intim atau bukan intim yang tinggal mengikut tatacara makmal yang standard.

Seseorang yang sampel intim atau bukan intim diambil, hendaklah dimaklumkan secara bertulis kepada alamat terakhirnya yang diketahui bahawa apa-apa bahagian yang tinggal daripada sampelnya telah dilupuskan sekiranya Ketua Bank

Data fikirkan wajar.

Penghapusan profil dan maklumat DNA daripada indeks orang yang disyaki

Tertakluk kepada seksyen 17 Akta, Ketua Polis Daerah hendaklah memaklumkan Ketua Bank Data DNA bagi penghapusan profil DNA dan apa-apa maklumat berhubung dengannya daripada indeks orang yang disyaki dalam borang yang dinyatakan dalam Jadual Keempat.

Orang yang disyaki itu hendaklah dimaklumkan secara bertulis di alamat terakhirnya yang diketahui bahawa sampel profil DNA dan apa-apa maklumat berhubung dengannya telah dihapuskan daripada Bank Data DNA.

Apabila mana-mana orang yang secara sukarela memberikan sampel intim atau bukan intimnya membuat permohonan secara bertulis untuk menarik balik kebenarannya, Ketua Bank Data DNA, apabila menerima permohonan itu, hendaklah menghapuskan profil DNA dan apa-apa maklumat berhubung dengannya bagi orang itu daripada indeks sukarela dalam tempoh enam bulan dari tarikh permohonan diterima.

Ketua Bank Data DNA hendaklah memaklumkan orang yang membuat permohonan di bawah subperaturan (1) dalam borang yang dinyatakan dalam Jadual

Kelima.

DEOXYRIBONUCLEIC ACID (DNA) IDENTIFICATION REGULATIONS 2012

IN exercise of the powers conferred by section 24 of the Deoxyribonucleic Acid (DNA)

Identification Act 2009 [Act 699], the Minister makes the following regulations:

Citation and commencement 1.

(1)

These regulations may be cited as the Deoxyribonucleic Acid (DNA)

Identification Regulations 2012.

(2)

These Regulations come into operation on 1 September 2012.

Interpretation 2.

In these Regulations, unless the context otherwise requires—

“DNA laboratory” means a laboratory that performs forensic DNA analysis on intimate or non-intimate sample taken from a human body or crime scene, in the

Chemistry Department of Malaysia or Forensic Laboratory of the Royal Malaysia Police or any agency or body as may be designated by the Minister pursuant to section 5 of the

Act;

“DNA package” means a package or receptacle containing intimate or non-intimate sample which has been labelled with an identifying mark and sealed as required under regulations 8 and 9, as the case may be.

Authorization for taking intimate or non-intimate sample 3.

For the purpose of taking intimate or non-intimate sample from any person referred to under section 12 or 13 of the Act, the authorized officer shall give his authorization in writing in the form specified in the First Schedule.

Information to be given before making a request for taking intimate sample 4.

Where an intimate sample shall be requested from a person, a police officer shall inform such person−

(a)

of the type of intimate sample required;

(b)

of the ground and purpose for requesting the intimate sample;

(c)

that the consent shall be in writing; and

(d)

that the intimate sample shall be analyzed and the result of the analysis may be used as evidence in criminal investigation, prosecution or for other purpose.

Information to be given before making a request for taking non-intimate sample 5.

Where a non-intimate sample shall be requested from a person, a police officer shall inform such person−

(a)

of the type of non-intimate sample required;

(b)

of the ground and purpose for requesting the non-intimate sample; and

(c)

that the non-intimate sample shall be analyzed and the result of the analysis may be used as evidence in criminal investigation, prosecution or for other purpose.

Appropriate consent to be given before taking intimate sample 6.

For the purpose of taking an intimate sample from—

(a)

a person reasonably suspected of having committed an offence;

(b)

a detainee;

a drug dependent; or

(d)

a prisoner, an appropriate consent shall be given by the person from whom the intimate sample is taken in the form specified in the Second Schedule.

Appropriate consent to be given before taking intimate or non-intimate sample given voluntarily 7.

For the purpose of taking an intimate or non-intimate sample given voluntarily, the person giving the intimate or non-intimate sample voluntarily shall give his appropriate consent in the form specified in the Third Schedule.

Procedure for taking intimate sample 8.

(1)

A government medical officer who takes an intimate sample from any person shall ensure that the procedure for obtaining the intimate sample is carried out in a manner consistent with the appropriate medical or other related professional body.

(2)

The government medical officer shall ensure that the receptacle containing the intimate sample or the package containing the receptacle of the intimate sample is—

(a)

labelled with an identifying mark;

(b)

sealed; and

(c)

handed over to the police officer who is responsible for collection of the intimate sample.

(3)

The identifying mark mentioned in paragraph (2)(a) shall include—

(a)

the name of the person from whom the intimate sample was taken;

(b)

the identification card number, passport number or any other identification of that person, as the case may be;

(c)

the date of collection of the intimate sample; and

(d)

police report number, if relevant.

Procedure for taking non-intimate sample 9.

(1)

A government medical officer, police officer or chemist who takes a non-intimate sample from any person shall ensure that the procedure for obtaining the non-intimate sample is carried out in a manner consistent with the medical or other related professional standard.

(2)

The government medical officer, police officer or chemist shall ensure that the receptacle containing the non-intimate sample or the package containing the receptacle of the non-intimate sample is—

(a)

labelled with an identifying mark;

(b)

sealed; and

(c)

handed over to the police officer who is responsible for collection of the non-intimate sample.

(3)

The identifying mark mentioned in paragraph (2)(a) shall include—

(a)

the name of the person from whom the non-intimate sample was taken;

(b)

the identification card number, passport number or any other identification of that person, as the case may be;

(c)

the date of collection of the non-intimate sample; and

(d)

police report number, if relevant.

Procedure for taking intimate or non-intimate sample at crime scene

10. When an intimate or non-intimate sample is found—

(a)

on any thing or at any place where an offence was committed;

(b)

on or within the body of a victim of an offence;

(c)

on any thing worn or carried by the victim of an offence at the time when the offence was committed; or

(d)

on or within the body of any person reasonably suspected of having committed an offence, the police officer who takes an intimate or non-intimate sample from a crime scene shall ensure that the procedure for taking the intimate or non-intimate sample is carried out in a manner consistent with the Standing Order, issued by the Inspector-General of

Police pursuant to section 97 of the Police Act 1967 [Act 344].

Storage and delivery of a DNA package 11.

(1)

Every DNA package collected prior to delivery to the DNA laboratory shall be securely stored.

(2)

The police officer who is responsible for collection of the intimate or non-intimate sample mentioned in paragraphs 8(2)(c) and 9(2)(c) shall deliver the DNA package to the DNA laboratory within a reasonable time.

(3)

The DNA package submitted to the DNA laboratory for forensic analysis shall be accompanied with a letter of request from a police officer.

Information to be recorded when a DNA package is delivered 12.

(1)

The DNA laboratory which receives the DNA package for analysis shall ensure that the DNA package is properly sealed, labeled and identifiable.

(2)

The DNA package shall be registered according to the standard operating procedure of the DNA laboratory.

Storage of intimate and non-intimate sample 13.

(1)

The Head of DNA Databank shall ensure that the intimate or non-intimate sample received is stored in a designated secured location at the DNA laboratory.

(2)

The Head of DNA Databank shall establish and maintain a register for the purpose of dealing with the storage of intimate sample and non-intimate sample.

Uploading of DNA profile and information into DNA Databank 14.

(1)

The intimate and non-intimate sample shall be analyzed and administered according to the standard laboratory procedure.

(2)

Upon obtaining notice of submission of the DNA profile and any information in relation thereto by the DNA laboratory, the DNA Databank officer shall first evaluate the DNA profile and any information in relation thereto.

(3)

The DNA Databank officer shall then up-load the DNA profile and any information in relation thereto into the respective indices of the Databank.

(4)

A register shall be maintained to record information relating to all DNA profiles and any information in relation thereto that are uploaded into the respective indices of the Databank.

Disposal of intimate and non-intimate sample 15.

(1)

The Head of DNA Databank shall, without delay, destroy any remaining portion of intimate or non-intimate sample according to the standard laboratory procedure.

(2)

The person whose intimate or non-intimate sample has been taken, shall be informed in writing to his last known address that any remaining portions of his sample has been disposed if the Head of DNA Databank considers appropriate.

Removal of the DNA profile and information from suspected person’s index 16.

(1)

Subject to section 17 of the Act, the Officer in Charge of a Police District shall notify the Head of the DNA Databank for removal of the DNA profile and any information in relation thereto from suspected person’s index in the form specified in the Fourth Schedule.

(2)

The suspected person shall be informed in writing to his last known address that his DNA profile and any information in relation thereto has been removed from the

DNA Databank.

Removal of the DNA profile and information from voluntary index 17.

(1)

When any person who voluntarily give his intimate or non-intimate sample makes an application in writing to withdraw his consent, the Head of DNA Databank upon receiving such application, shall remove the DNA profile and any information of such person from voluntary index within six months from application received.

(2)

The Head of the DNA Databank shall inform the person who makes an application under subregulation (1) in the form specified in the Fifth Schedule.

Establishment of standard procedures 18.

(1)

The Head of DNA Databank may establish the procedures —

(a)

for collection, preservation, dissemination of data related to DNA profile according to the professional standard;

(b)

to prevent unauthorized access to the DNA Databank;

to release DNA profile and any information in relation thereto from the DNA Databank;

(d)

in relation to the internal disclosure, the access or use of a sample of the DNA profile and any information in relation thereto in a DNA laboratory;

(e)

in relation to the register for the storage and the disposal of the sample; or

(f)

in relation to the register for the storage and and removal of the

DNA profile and any information in relation thereto from the DNA

Databank indices.

(2)

The Head of DNA Databank may at anytime inspect any DNA laboratory in relation to the storage and the disposal of the sample.
