Jika seseorang yang akan dilantik sebagai Pembantu Pelindung mempunyai majikan, keizinan majikan itu hendaklah diperoleh sebelum Menteri melantik orang itu di bawah seksyen 8A Akta sebagai Pembantu Pelindung.

Kewajipan Pembantu Pelindung

Jika Pembantu Pelindung yang disebut dalam peraturan 2 diarahkan oleh

Ketua Pengarah untuk melaksanakan kewajipan di bawah seksyen 18 dan 20 Akta, majikan Pembantu Pelindung itu hendaklah memberikan cuti kepada Pembantu

Pelindung itu untuk membolehkannya melaksanakan kewajipan sebagaimana yang diarahkan oleh Ketua Pengarah.

Cuti yang disebut dalam subperaturan (1) tidak boleh melebihi tiga hari berturut-turut pada satu-satu masa melainkan jika dipersetujui selainnya oleh majikan

Mana-mana Pembantu Pelindung yang melaksanakan kewajipan sebagaimana yang diarahkan oleh Ketua Pengarah boleh dibayar apa-apa elaun dan perbelanjaan lain sebagaimana yang ditentukan oleh Majlis.

Seksyen 5

Latihan bagi Pembantu Pelindung

Bagi maksud melaksanakan kewajipan yang disebut dalam peraturan 3,

Pembantu Pelindung hendaklah menjalani latihan sebagaimana yang diarahkan oleh

Ketua Pengarah dari semasa ke semasa.

Bagi maksud menjalani latihan di bawah subperaturan (1), majikan

Pembantu Pelindung itu yang disebut dalam peraturan 2 hendaklah memberikan cuti kepada Pembantu Pelindung itu untuk membolehkannya menjalani latihan itu.

hendaklah sekurang-kurangnya sekali dalam tempoh pelantikan sebagai Pembantu Pelindung dan tidak boleh melebihi lima hari berturut-turut pada satu-satu masa.

Larangan terhadap pembuangan kerja Pembantu Pelindung atas alasan melaksanakan kewajipan atau menjalani latihan 6.

Majikan Pembantu Pelindung yang disebut dalam peraturan 2 tidak boleh membuang kerja Pembantu Pelindung itu semata-mata atas alasan Pembantu Pelindung itu tidak hadir bekerja kerana melaksanakan kewajipannya sebagai Pembantu

Pelindung di bawah peraturan 3 atau menjalani latihannya di bawah peraturan 5.

Mana-mana majikan yang tidak mematuhi subperaturan (1) melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi enam ribu ringgit.

CHILD (ASSISTANT PROTECTOR) REGULATIONS 2017

  1. IN exercise of the powers conferred by section 128 of the Child Act 2001 [Act 611], the Minister makes the following regulations: Citation and commencement 1.

(1)

These regulations may be cited as the Child (Assistant Protector)

Regulations 2017.

These Regulations come into operation on 1 June 2017.

Appointment of Assistant Protector 2.

If a person to be appointed as an Assistant Protector has an employer, the consent of the employer shall be obtained before the Minister appoints such person under section 8A of the Act as an Assistant Protector.

Duties of Assistant Protector 3.

(1)

If an Assistant Protector referred to in regulation 2 is directed by the

Director General to perform the duties under sections 18 and 20 of the Act, the employer of such Assistant Protector shall grant leave to the Assistant Protector to enable him to perform the duties as directed by the Director General.

The leave referred to in subregulation (1) shall not exceed three consecutive days at a time unless otherwise agreed by the employer of the Assistant

Protector.

Allowances and other expenses 4.

Any Assistant Protector who performs the duties as directed by the Director

General may be paid such allowances and other expenses as determined by the Council.

Training for Assistant Protector 5.

(1)

For the purpose of performing the duties referred to in regulation 3, an Assistant Protector shall undergo training as directed by the Director General from time to time.

For the purpose of undergoing training under subregulation (1), the employer of the Assistant Protector referred to in regulation 2 shall grant leave to the Assistant Protector to enable him to undergo the training.

The training referred to in subregulation (1) shall be at least once during the period of appointment as an Assistant Protector and shall not exceed five consecutive days at a time.

Prohibition against dismissal of Assistant Protector by reason of performing duties or undergoing training 6.

(1)

An employer of the Assistant Protector referred to in regulation 2 shall not dissmiss the Assistant Protector solely by reason of the Assistant Protector being absent from work due to performing his duties as an Assistant Protector under regulation 3 or undergoing his training under regulation 5.

(2)

Any employer who fails to comply with subregulation (1) commits an offence and shall, on conviction, be liable to a fine not exceeding six thousand ringgit.
