PADA menjalankan kuasa yang diberikan oleh seksyen 10 dan perenggan 83(2)(h) Akta Keselamatan Sosial Pekerjaan Sendiri 2017 [Akta 789], Menteri membuat peraturan-peraturan yang berikut: Nama dan permulaan kuat kuasa

Peraturan-Peraturan ini hendaklah mula berkuat kuasa pada 13 Jun 2017.

Tafsiran

Seksyen 2

Dalam Peraturan-Peraturan ini, “pemandu teksi” ertinya mana-mana orang bekerja sendiri yang—

(a)

menjalankan aktiviti pekerjaan sendiri sebagaimana yang dinyatakan dalam butiran 1 Jadual Pertama kepada Akta;

(b)

mempunyai lesen memandu yang sah yang dikeluarkan di bawah seksyen 26

Akta Pengangkutan Jalan 1987 [Akta 333]; dan

(c)

bagi maksud perenggan (a), telah dikeluarkan baginya—

(i)

suatu lesen pengendali yang sah di bawah seksyen 18

Akta Pengangkutan Awam Darat 2010 [Akta 715] dan suatu kad pemandu yang sah oleh Suruhanjaya Pengangkutan Awam Darat; atau

suatu lesen yang sah oleh Lembaga Pelesenan Kenderaan Perdagangan di bawah seksyen 16

Kadar caruman

Seksyen 3

(1)

Tiap-tiap pemandu teksi hendaklah membayar suatu caruman kepada

Pertubuhan atau ejen keselamatan sosial pekerjaan sendiri pada kadar sebagaimana yang dipilih oleh pemandu teksi itu berdasarkan Pendapatan Bulanan Pilihan yang

Diinsuranskan sebagaimana yang dinyatakan dalam Jadual.

(2)

Tempoh pelindungan bagi kadar caruman yang dipilih oleh seorang pemandu teksi di bawah subperaturan (1) hendaklah selama tempoh dua belas bulan berturut-turut.

(3)

Jika dalam tempoh pelindungan yang disebut dalam subperaturan (2)

kesahan lesen pengendali dan kad pemandu yang dikeluarkan oleh Suruhanjaya

Pengangkutan Awam Darat atau lesen yang dikeluarkan oleh Lembaga Pelesenan

Kenderaan Perdagangan habis tempoh—

(a)

tempoh pelindungan itu hendaklah terus berkuat kuasa sehingga tempoh dua belas bulan berturut-turut itu habis; dan

(b)

seorang pemandu teksi hendaklah mengemukakan kepada Pertubuhan, apabila diminta oleh Pertubuhan, lesen pengendali, kad pemandu atau lesen baharunya untuk penentusahan.

SELF-EMPLOYMENT SOCIAL SECURITY

(RATES OF CONTRIBUTION FOR TAXI DRIVER) REGULATIONS 2017

IN exercise of the powers conferred by section 10 and paragraph 83(2)(h) of the

Self-Employment Social Security Act 2017 [Act 789], the Minister makes the following regulations:

Citation and commencement 1.

(1)

These regulations may be cited as the Self-Employment Social Security

(Rates of Contribution For Taxi Driver) Regulations 2017.

(2)

These Regulations come into operation on 13 June 2017.

Interpretation 2.

In these Regulations, “taxi driver” means any self-employed person who—

(a)

carries out the self-employment activity as specified in item 1 of the First Schedule to the Act;

(b)

holds a valid driving licence issued under section 26

of the Road Transport Act 1987 [Act 333]; and

(c)

for the purposes of paragraph (a), has been issued with—

(i)

a valid operator’s licence under section 18

of the Land Public Transport Act 2010 [Act 715] and a valid driver’s card by the Suruhanjaya Pengangkutan Awam Darat; or

(ii)

a valid licence by the Commercial Vehicles Licensing Board under section 16 of the Commercial Vehicles Licensing Board Act 1987

[Act 334].

Rates of contribution 3.

(1)

Every taxi driver shall pay a contribution to the Organization or any self-employment social security agent at the rates as selected by the taxi driver based on the Selected Insured Monthly Earning as specified in the Schedule.

(2)

The coverage period for the rates of contribution selected by a taxi driver under subregulation (1) shall be for a period of twelve consecutive months.

(3)

If within the coverage period referred to in subregulaton (2) the validity of an operator’s licence and a driver’s card issued by the Suruhanjaya Pengangkutan

Awam Darat or a licence issued by the Commercial Vehicles Licensing Board expires—

(a)

the coverage period shall continue to have effect until the period of twelve consecutive months expires; and

(b)

a taxi driver shall submit to the Organization, upon request by the

Organization, his new operator’s licence, driver’s card or licence for verification.
