Dalam Peraturan-Peraturan ini—
“Pengerusi”
ertinya
Pengerusi
Tribunal yang dilantik di bawah subseksyen 58(2) Akta;
“Tribunal” ertinya Tribunal Keselamatan Sosial yang ditubuhkan di bawah subseksyen 58(1) Akta.
Permohonan kepada Tribunal
Apa-apa persoalan, pertikaian, tuntutan atau rayuan yang berhubungan dengan perkara yang dinyatakan dalam subseksyen 59(1) Akta hendaklah dibuat melalui suatu permohonan dalam Borang T1 Jadual dan hendaklah disertakan dengan fi sebanyak dua ringgit.
Permohonan di bawah subperaturan (1) hendaklah difailkan dalam lima salinan di pejabat Pengerusi Tribunal yang ditubuhkan bagi kawasan yang orang berinsurans bekerja sendiri itu bekerja pada masa persoalan, pertikaian, tuntutan atau rayuan itu timbul.

Pengakuterimaan dan penyampaian permohonan
Apabila permohonan di bawah subperaturan 3(1) diterima, Pengerusi hendaklah menyebabkan supaya—
satu salinan permohonan itu dikembalikan kepada pemohon dengan pengakuterimaan penerimaan; dan
satu salinan permohonan itu disampaikan secara ke diri kepada responden berserta dengan suatu notis untuk memfailkan pernyataan pembelaan dalam Borang T2 Jadual.
Walau apa pun perenggan (1)(b), jika responden ialah Pertubuhan, penyampaian permohonan dan notis untuk memfailkan pernyataan pembelaan kepada
Pertubuhan boleh dilaksanakan dengan menghantar permohonan dan notis itu melalui pos berdaftar yang dialamatkan kepada Ketua Pengarah di alamat penyampaian bagi
Pertubuhan.
Peryataan pembelaan
Responden yang telah disampaikan dengan sewajarnya suatu notis untuk memfailkan pernyataan pembelaan dalam Borang T2 Jadual hendaklah, dalam masa tiga puluh hari dari tarikh penerimaan notis itu, memfailkan pernyataan pembelaan dengan
Tribunal dalam Borang T3 Jadual.
Apabila pernyataan pembelaan di bawah subperaturan (1) diterima,
Pengerusi hendaklah menyebabkan supaya pernyataan pembelaan itu disampaikan kepada pemohon.
Pindaan permohonan kepada Tribunal
Pemohon boleh, pada mana-mana peringkat prosiding, meminda permohonan yang dibuat di bawah peraturan 3 dengan kebenaran Tribunal tertakluk kepada apa-apa terma dan arahan sebagaimana yang difikirkan perlu oleh Tribunal.

Tribunal tidak boleh memberikan kebenaran untuk meminda permohonan yang dibuat di bawah peraturan 3 bagi maksud memasukkan persoalan, pertikaian, tuntutan atau rayuan yang baharu melainkan jika Tribunal berpuas hati bahawa—
persoalan, pertikaian, tuntutan atau rayuan yang baharu itu adalah berdasarkan apa-apa perkara fakta atau undang-undang yang diketahui oleh pemohon hanya selepas permohonan itu dibuat;
persoalan, pertikaian, tuntutan atau rayuan yang baharu itu tidak praktik untuk dimasukkan dalam permohonan itu apabila permohonan itu dibuat; atau
persoalan, pertikaian, tuntutan atau rayuan yang baharu itu dimasukkan disebabkan oleh hal keadaan yang luar biasa.
Jika kebenaran diberikan di bawah subperaturan (1), pemohon hendaklah memfailkan permohonan terpinda itu dalam lima salinan dengan Tribunal.
Pengerusi hendaklah menyebabkan supaya satu salinan permohonan terpinda itu dikembalikan kepada pemohon dengan pengakuterimaan penerimaan.
Jika pemohonan dipinda di bawah subperaturan (1) selepas pemohonan itu disampaikan kepada responden di bawah peraturan 4, Pengerusi hendaklah menyebabkan supaya permohonan terpinda itu disampaikan kepada responden dalam masa empat belas hari dari tarikh permohonan terpinda itu dikembalikan kepada pemohon di bawah subperaturan (4).
Jika permohonan terpinda itu disampaikan kepada responden selepas pernyataan pembelaan disampaikan kepada pemohon di bawah peraturan 5, responden boleh meminda pernyataan pembelaannya dan memfailkan pernyataan pembelaan terpinda itu dengan Tribunal.

Pengerusi hendaklah menyebabkan supaya pernyataan pembelaan terpinda itu disampaikan kepada pemohon dalam masa empat belas hari dari tarikh pernyataan pembelaan terpinda itu difailkan dengan Tribunal.
Pindaan pernyataan pembelaan
Responden boleh, pada mana-mana peringkat prosiding, meminda pernyataan pembelaan yang difailkan di bawah peraturan 5 dengan kebenaran Tribunal tertakluk kepada apa-apa terma dan arahan sebagaimana yang difikirkan perlu oleh
Tribunal.
Tribunal tidak boleh memberikan kebenaran untuk meminda pernyataan pembelaan yang difailkan di bawah peraturan 5 melainkan jika Tribunal berpuas hati bahawa—
pindaan itu adalah berdasarkan apa-apa perkara fakta atau undang-undang yang diketahui oleh responden hanya selepas pernyataan pembelaan itu difailkan;
pindaan itu tidak praktik untuk dimasukkan dalam atau ditinggalkan daripada pernyataan pembelaan itu apabila pernyataan pembelaan itu difailkan; atau
pindaan itu dimasukkan atau ditinggalkan disebabkan oleh hal keadaan yang luar biasa.
Jika kebenaran diberikan di bawah subperaturan (1), responden hendaklah memfailkan pernyataan pembelaan terpinda dalam lima salinan dengan Tribunal.
Jika pernyataan pembelaan dipinda di bawah subperaturan (1) selepas pernyataan pembelaan itu disampaikan kepada pemohon di bawah subperaturan 5(2),
Pengerusi hendaklah menyebabkan supaya pernyataan pembelaan terpinda itu disampaikan kepada pemohon dalam masa empat belas hari dari tarikh pernyataan pembelaan terpinda itu difailkan dengan Tribunal.

Ikatan dokumen
Pengerusi boleh mengarahkan pihak-pihak dalam permohonan itu untuk mengemukakan kepada Tribunal ikatan dokumen yang terdiri daripada yang berikut:
Pengerusi
Tribunal hendaklah menyebabkan supaya suatu notis pendengaran dikeluarkan kepada pihak-pihak dalam permohonan itu dalam Borang T4
Jadual yang menyatakan tarikh, masa dan tempat pendengaran tidak kurang daripada sepuluh hari sebelum tarikh pendengaran permohonan.
Walau apa pun subperaturan (1), notis pendengaran boleh dikeluarkan kepada pihak-pihak dalam permohonan itu kurang daripada sepuluh hari jika tiada bantahan oleh pihak-pihak dalam permohonan.
Saman untuk hadir
Saman untuk hadir di bawah subperaturan (1) hendaklah dalam Borang T5
Jadual dan hendaklah disampaikan secara ke diri kepada orang itu.

Pendengaran
Selepas pemohon membentangkan permohonannya, responden hendaklah membentangkan pembelaannya dan boleh mengemukakan keterangan, memanggil mana-mana saksi, atau mengemukakan apa-apa dokumen, rekod atau apa-apa benda lain bagi menyokong pembelaannya.
Selepas responden membentangkan pembelaannya, suatu hujahan lisan atau bertulis yang ringkas boleh dibuat oleh responden dan selepas itu oleh pemohon.
Tribunal boleh pada bila-bila masa membantu pihak-pihak dalam permohonan itu dalam menjalankan pendengaran.
Ketidakhadiran pihak-pihak
Jika responden tidak hadir pada tarikh, dan pada masa dan di tempat, yang ditetapkan untuk pendengaran tetapi pemohon hadir, Tribunal boleh, apabila berpuas hati bahawa notis pendengaran telah disampaikan dengan sewajarnya—
Jika kedua-dua pihak dalam permohonan itu tidak hadir pada tarikh, dan pada masa dan di tempat, yang ditetapkan untuk pendengaran, permohonan itu hendaklah ditolak.

Penarikan balik permohonan
Tribunal hendaklah memaklumkan responden mengenai penarikan balik permohonan di bawah subperaturan (1).
Penarikan balik permohonan di bawah subperaturan (1) tidak menjejaskan kuasa Tribunal untuk membuat suatu perintah berhubung dengan pembayaran kos yang ditanggung berkenaan dengan permohonan itu sehingga masa penarikan balik permohonan itu.
Jika suatu permohonan ditarik balik, tiada permohonan baharu boleh dibawa oleh pemohon berhubung dengan persoalan, pertikaian, tuntutan atau rayuan yang menjadi perkara bagi permohonan yang ditarik balik sedemikian.
Perintah Tribunal
Tribunal hendaklah membuat suatu perintah secara bertulis dan hendaklah disokong dengan alasan bagi perintah itu.
Rujukan kepada Mahkamah Tinggi
Tribunal hendaklah mengemukakan suatu persoalan undang-undang untuk keputusan Mahkamah Tinggi di bawah seksyen 65 Akta dalam Borang T6 Jadual.
Rayuan kepada Mahkamah Tinggi
Notis rayuan kepada Mahkamah Tinggi terhadap perintah Tribunal di bawah seksyen 66 Akta hendaklah dalam Borang T7 Jadual.
Rekod prosiding
Pengerusi hendaklah menyebabkan supaya rekod semua prosiding Tribunal disimpan dengan membuat catatan di dalam fail yang berkenaan.

SELF-EMPLOYMENT SOCIAL SECURITY ACT 2017
IN exercise of the powers conferred by paragraph 83(2)(e)
of the
Self-Employment Social Security Act 2017 [Act 789], the Minister makes the following regulations:
Citation and commencement 1.
These regulations may be cited as the Self-Employment Social Security
(Social Security Tribunal) Regulations 2018.
These Regulations come into operation on 26 December 2018.
Interpretation 2.
In these Regulations—
“Chairman”
means the
Chairman of the
Tribunal appointed under subsection 58(2) of the Act;
“Tribunal” means the Social Security Tribunal established under subsection 58(1)
of the Act.
Application to the Tribunal 3.
Any question, dispute, claim or appeal relating to the matters specified in subsection 59(1) of the Act shall be made by an application in Form T1 of the Schedule and shall be accompanied with a fee of two ringgit.
(2)
The application under subregulation (1) shall be filed in five copies at the office of the Chairman of the Tribunal established for the area in which the self-employed insured person was working at the time of the question, dispute, claim or appeal arises.

Acknowledgement and service of application 4.
(1)
Upon receipt of the application under subregulation 3(1), the Chairman shall cause—
(a)
one copy of the application to be returned to the applicant with an acknowledgement of receipt; and
(b)
one copy of the application to be served personally on the respondent together with a notice to file a statement of defence in Form T2 of the
Schedule.
Notwithstanding paragraph
(b), where the respondent is the
Organization, the service of the application and the notice to file a statement of defence on the Organization may be effected by sending the application and the notice by registered post addressed to the Director General at the address for service of the
Organization.
Statement of defence 5.
The respondent who has been duly served with a notice to file a statement of defence in Form T2 of the Schedule shall, within thirty days from the date of receipt of such notice, file a statement of defence with the Tribunal in Form T3 of the Schedule.
(2)
Upon receipt of the statement of defence under subregulation (1), the Chairman shall cause the statement of defence to be served on the applicant.
Amendment of application to the Tribunal 6.
The applicant may, at any stage of the proceedings, amend the application made under regulation 3 with the leave of the Tribunal subject to such terms and directions as the Tribunal thinks necessary.
The Tribunal shall not grant leave to amend the application made under regulation 3 for the purpose of inserting a new question, dispute, claim or appeal unless the Tribunal is satisfied that—

(a)
the new question, dispute, claim or appeal is based on any matter of fact or law which is known to the applicant only after the application is made;
(b)
the new question, dispute, claim or appeal was not practicable to be inserted in the application when the application was made; or
(c)
the new question, dispute, claim or appeal is inserted due to exceptional circumstances.
Where leave is granted under subregulation (1), the applicant shall file the amended application in five copies with the Tribunal.
The Chairman shall cause one copy of the amended application to be returned to the applicant with an acknowledgement of receipt.
Where an application is amended under subregulation (1) after the application has been served on the respondent under regulation 4, the Chairman shall cause the amended application to be served on the respondent within fourteen days from the date the amended application is returned to the applicant under subregulation (4).
Where the amended application is served on the respondent after the statement of defence has been served on the applicant under regulation 5, the respondent may amend his statement of defence and file the amended statement of defence with the Tribunal.
The Chairman shall cause the amended statement of defence to be served on the applicant within fourteen days from the date the amended statement of defence is filed with the Tribunal.

Amendment of statement of defence 7.
The respondent may, at any stage of the proceedings, amend the statement of defence filed under regulation 5 with the leave of the Tribunal subject to such terms and directions as the Tribunal thinks necessary.
The Tribunal shall not grant leave to amend the statement of defence filed under regulation 5 unless the Tribunal is satisfied that—
(a)
the amendment is based on any matter of fact or law which is known to the respondent only after the statement of defence is filed;
(b)
the amendment was not practicable to be inserted in or omitted from the statement of defence when the statement of defence was filed; or
(c)
the amendment is inserted or omitted due to exceptional circumstances.
Where leave is granted under subregulation (1), the respondent shall file the amended statement of defence in five copies with the Tribunal.
Where a statement of defence is amended under subregulation (1) after the statement of defence has been served on the applicant under subregulation 5(2), the
Chairman shall cause the amended statement of defence to be served on the applicant within fourteen days from the date the amended statement of defence is filed with the
Tribunal.
Bundle of documents 8.
The Chairman may direct the parties to the application to provide to the Tribunal a bundle of documents which consists of the following:
(a)
the application to the Tribunal in Form T1 of the Schedule;
(b)
the statement of defence in Form T3 of the Schedule;

(c)
a statement of the facts; or
(d)
other relevant documents, if any.
Notice of hearing 9.
(1)
The Chairman shall cause a notice of hearing to be issued to the parties to the applicaton in Form T4 of the Schedule specifying the date, time and place of the hearing not less than ten days before the date of hearing of the application.
Notwithstanding subregulation (1), the notice of hearing may be issued to the parties to the application less than ten days if there is no objection by the parties to the applicaton.
Summons to appear
10. (1) The Tribunal may, on its own motion or on the request of any party to the application, issue summons to appear to any person as a witness or to produce any document, record or other things in his possession before the Tribunal.
(2)
The summons to appear under subregulation (1) shall be in Form T5 of the
Schedule and shall be served personally on such person.
Hearing
11. (1)
At the hearing before the Tribunal, the applicant may adduce evidence, call any witness, or produce any document, record or other things in support of his application.
After the applicant presented his application, the respondent shall present his defence and may adduce evidence, call any witness, or produce any document, record or other things in support of his defence.
After the respondent presented his defence, a brief oral or written submission may be made by the respondent and thereafter by the applicant.

The Tribunal may at any time assist the parties to the application in conducting the hearing.
Non-appearance of parties
12. (1) Where the applicant does not appear on the date, and at the time and place, fixed for the hearing but the respondent appears, the Tribunal may dismiss the application upon being satisfied that the notice of hearing has been duly served.
Where the respondent does not appear on the date, and at the time and place, fixed for the hearing but the applicant appears, the Tribunal may, upon being satisfied that the notice of hearing has been duly served—
proceed with the hearing in the absence of the respondent; or
adjourn the hearing to another date.
If both parties to the applicaton do not appear on the date, and at the time and place, fixed for the hearing, the application shall be dismissed.
Withdrawal of application
13. (1) An applicant may withdraw the application orally or in writing at any time before the Tribunal makes any order on the application.
The Tribunal shall notify the respondent on the withdrawal of the application under subregulation (1).
The withdrawal of the application under subregulation (1) shall not affect the power of the Tribunal to make an order in relation to the payment of costs incurred in respect of the application until the time of the withdrawal of the application.
Where an application is withdrawn, no fresh application may be brought by the applicant in relation to the question, dispute, claim or appeal which was the subject of the application so withdrawn.

Order of the Tribunal
14. The Tribunal shall make an order in writing and shall be supported by grounds for the order.
Reference to High Court
15. The Tribunal shall submit the question of law for the decision of the High Court under section 65 of the Act in Form T6 of the Schedule.
Appeal to High Court
16. The notice of appeal to the High Court against an order of the Tribunal under section 66 of the Act shall be in Form T7 of the Schedule.
Records of proceedings
17. The Chairman shall cause to be kept records of all proceedings of the Tribunal by making entries in the respective files.
Forms
18. The Organization shall cause to be published all forms specified in the Schedule in its official website.
