JuDGES’ REMUNERATION (AMENDMENT OF SECOND SCHEDULE)

(No. 2) REGULATIONS 1980

Opening note

Preamble

In exercise of the powers conferred by section 19 of the Judges’ Remuneration Act 1971, the Yang di-Pertuan Agong, after consultation with the Lord President, makes the following regulations:

Seksyen 1

These Regulations may be cited as the Judges’ Remuneration

(Amendment of Second Schedule) (No. 2) Regulations 1980 and shall be deemed to have come into force on the Ist July 1980.

Seksyen 2

These Regulations shall apply in respect of every person who holds office as Judge on or after the Ist July 1980:

Provided that where a Judge is governed by the provisions of written laws other than the Judges’ Remuneration (Amendment of Second Schedule) Regulations 1979, he shall be governed by the provisions. of these Regulations and of such other written laws but with the addition and substitution, as appropriate, of the provisions of these Regulations in the provisions of such other written laws.

Seksyen 3

The Second Schedule to the Judges’ Remuneration Act 1971

is amended—

(@ in paragraph 1—

(i)

by substituting respectively for the figures “1,000”

and “1-8-1979” in subparagraph (q@) (ii) the figures

“1,500” and “1-7-1980”;

- Gi) by re-numbering that part of subparagraph (6)

commencing with the words “free fully furnished institutional quarters” as sub-subparagraph (i) of sub-paragraph (5);

ii)

by substituting for the full stop at the end of sub-subparagraph (i) of subparagraph (b) a semi-colon and the word “and”; and

(iv)

by inserting appropriately after sub-subparagraph (i)

of subparagraph (b) the following sub-subparagraph

(ii)

of subparagraph (6)—

“Gi) one butler and one caretaker 1-7-1980

and a provision of $1,500 per annum for house and garden upkeep. “a

(b)

by substituting respectively in paragraph 2 for the figures

“750”, “600”, “S00” and “1977” wherever they appear the figures “2,500”, “2,400”, “2,000” and “1980”;

“3A. REGIONAL ALLOWANCE FOR EMPLOYEES:

Regional allowance for Effective employee of a Judge Date

There shail be paid in respect of 1-7-1980

any employee of a Judge serving in the State of Sabah or Sarawak a monthly regional allowance at the rate of— :

(@) 25 per centum; or

(b)

224 per centum, of such employee’s monthly salary where his salary respectively is—

@ less than $360; or

Gi) between $360 and $549;

per month.

such employees of a Judge as are referred to in this Schedule such other allowances, contributions and perquisites for which no specific provision is made in this Schedule but which are paid or pro-vided by Government from time to time in respect of the employees of an officer in superscale “A” and above in the Managerial and Pro-fessional Group of the public services, engaged in an equivalent or a similar capacity as the employees of a Judge. “7, SUBSISTENCE ALLOWANCE:

“12a, PAYMENT IN LigU OF LEAVE:

service, a Judge is unable to take his annual vacation leave, he may elect to accumulate up to half of his vacation leave eligibility but subject to a maximum of fifteen days in a year and, on his retire-ment or death—

(a)

be granted a cash award equivalent to one-thirtieth of his last-drawn monthly salary for each day up to a maxi-mum of ninety days; or

(b)

to have converted such ac-cumulated leave, up to a maximum of one hundred and eighty days, as reckon-able service in computing his pension and gratuity.

Any vacation leave not taken in preceding years may be taken into account: when calculating ac-cumulated leave for the purposes of this paragraph but subject, however, to a maximum of fifteen days’ accumulation for each year. ty

PAD PASSAGE FOR OVERSEAS TRAVEL:

Once in every five years of his 1-7-1980

service, a Judge shall be eligible to have passage paid by Government for overseas travel to a destination of his choice for himself, his wife and three of his dependent children below twenty-one years of age. The fare for such travel shall not exceed the equivalent return fare for travel -
