- PADA menjalankan kuasa yang diberikan oleh seksyen 44B Akta Bekalan Elektrik 1990 [Akta 447], Menteri, menurut syor yang dibuat oleh Suruhanjaya, membuat perintah yang berikut: Nama dan permulaan kuat kuasa
Seksyen 2
(1)
Tenaga Nasional Berhad hendaklah menguntukkan dan membayar kepada Kumpulan Wang Industri Elektrik semua wang yang terkumpul, termasuk faedah, terbitan daripada penjimatan atau penalti atau apa-apa sebab wajar yang lain, yang diperoleh daripada pelaksanaan dan penguatkuasaan perjanjian pembelian tenaga dengan pemegang lesen yang lain.
(2)
Wang itu hendaklah dibayar pada permulaan tahun kalendar atau pada mana-mana tarikh lain sebagaimana yang ditentukan oleh Suruhanjaya.
Cara bayaran
Seksyen 3
(1)
Bayaran kepada Kumpulan Wang Industri Elektrik hendaklah dibuat melalui pemindahan dana elektronik atau apa-apa cara lain sebagaimana yang ditentukan oleh Suruhanjaya.
(2)
Tenaga Nasional Berhad hendaklah mengemukakan bukti pembayaran kepada Suruhanjaya dalam tempoh empat belas hari selepas bayaran dibuat dan
Suruhanjaya hendaklah mengeluarkan suatu resit bagi bayaran yang dibuat itu.

Bayaran balik
Seksyen 4
(1)
Jika Tenaga Nasional Berhad mendapati terdapat bayaran berlebihan kepada Kumpulan Wang Industri Elektrik, Tenaga Nasional Berhad boleh membuat permohonan bertulis kepada Suruhanjaya untuk bayaran balik bayaran berlebihan itu.
(2)
Suruhanjaya hendaklah, apabila menerima permohonan itu dan berpuas hati bahawa terdapat bayaran berlebihan kepada Kumpulan Wang Industri Elektrik, membayar balik bayaran berlebihan itu kepada Tenaga Nasional Berhad tanpa bunga dalam tempoh tiga puluh hari dari tarikh penentusahan bayaran berlebihan itu oleh
Suruhanjaya.
Mendapatkan semula kekurangan
Seksyen 5
(1)
Jika terdapat sesuatu kekurangan dalam peruntukan atau pembayaran yang telah dibuat oleh Tenaga Nasional Berhad, Suruhanjaya hendaklah, dengan seberapa cepat yang dapat dilaksanakan, memberitahu Tenaga Nasional Berhad secara bertulis tentang kekurangan itu dan meminta Tenaga Nasional Berhad untuk membayar kekurangan itu.
(2)
Tenaga Nasional Berhad hendaklah membayar kekurangan itu tanpa apa-apa bunga dalam tempoh tiga puluh hari dari tarikh penerimaan pemberitahuan itu.

ELECTRICITY SUPPLY ACT 1990
ELECTRICITY SUPPLY (ELECTRICITY INDUSTRY FUND) (CONTRIBUTION BY
TENAGA NASIONAL BERHAD) ORDER 2017
Opening note
Preamble
- IN exercise of the powers conferred by section 44B of the Electricity Supply Act 1990 [Act 447], the Minister, pursuant to the recommendation made by the Commission, makes the following order: Citation and commencement 1.
(1)
This order may be cited as the Electricity Supply (Electricity Industry
Fund) (Contribution by Tenaga Nasional Berhad) Order 2017.
(2)
This Order comes into operation on 8 April 2017.
Contribution by Tenaga Nasional Berhad 2.
(1)
Tenaga Nasional Berhad shall allocate and pay to the Electricity Industry
Fund all monies accrued, including interest, due to savings or penalty or any other justified reason, derived from implementing and enforcing the power purchase agreement with other licensees.
(2)
The monies shall be paid at the beginning of the calendar year or on any other date as may be specified by the Commission.
Mode of payment 3.
(1)
A payment to the Electricity Industry Fund shall be made by electronic fund transfer or any other method as may be determined by the Commision.
(2)
Tenaga Nasional Berhad shall submit proof of payment to the Commission within fourteen days after the payment is made and the Commission shall issue a receipt for the payment made.

Refund 4.
(1)
If Tenaga Nasional Berhad discovers that there has been an over payment to the Electricity Industry Fund, Tenaga Nasional Berhad may make a written application to the Commission for the refund of the over payment.
(2)
The Commission shall, upon receiving the application and being satisfied that there has been over payment of the contribution to the Electricity Industry Fund, refund such over payment to the Tenaga Nasional Berhad without interest within thirty days from the date of the verification of the over payment by the Commission.
Recovery of shortfall 5.
(1)
If there is a shortfall in the allocation or payment made by Tenaga
Nasional Berhad, the Commission shall, as soon as practicable, notify Tenaga Nasional
Berhad in writing of the shortfall and request Tenaga Nasional Berhad to pay the shortfall.
(2)
Tenaga Nasional Berhad shall pay the shortfall without interest within thirty days from the date of receipt of the notification.
