NATIONAL LAND CODE (AMENDMENT OF SIXTEENTH SCHEDULE) ORDER 2017

IN exercise of the powers conferred by subsection 5D(4)

National Land Code [Act No. 56 of 1965], the Minister, with the approval of the National Land Council, makes the following order:

Amendment of Sixteenth Schedule 2.

The Sixteenth Schedule to the National Land Code is amended—

(a)

in paragraph 1, in the definition of “computer document of licence or permit”—

(i)

by inserting after the words “computer document of licence or permit”

the words “or lease of reserved land”; and

the words “or computer printed document of lease of reserved land”;

(b)

in paragraph 2—

(i)

in subparagraph (a), by deleting the word “and”;

a semicolon; and

“(c) cancels the previous version of the computer printed document of title;

(d)

captures image of the previous version of the computer printed document of title that has been cancelled to be virtually stored in the land database; and

(e)

destroys the previous version of the computer printed document of title.”;

(c)

in paragraph 7—

in subparagraph (2), by substituting for the words “the Code” the words “this Act”;

“(4A) In respect of an existing document of title prepared manually under this Act, the computer printed document of title shall be in Forms 5Be, 5Ce, 5De, 5Ee, 11Ae or 11Be of this Schedule, as the case may be.”;

any types of endorsement in any circumstances where an endorsement across the face of the existing register document of title is impossible, to the effect that the title in question has been converted to the computerized document of title.”;

This lease may be terminated by the State Authority immediately upon, or at any time after, the occurrence of a breach of any rule, term or condition, to which it is subject without payment of compensation.

This lease may be terminated by the State Authority at its discretion at any time before the date of expiry of the lease notwithstanding that it has not become liable to termination for breach of any rule, term or condition, upon payment of such compensation as may be agreed or determined in accordance with the provisions of section 434 of the National Land Code.
