Jadual Pertama kepada Kanun Tanah Negara dipinda —

(a)

dalam Borang 12D―

(i)

dalam perenggan (1), dengan menggantikan perkataan “are shown in red” dengan perkataan “are shown in red+”;

(ii)

dalam subperenggan (2)(b), dengan menggantikan perkataan

“persons” dengan perkataan “persons+”;

(iii)

dengan memasukkan selepas perenggan (2) perenggan yang berikut:

“3.

*I/We hereby apply for the land/s (originally alienated in perpetuity) to be re-alienated to *me/us for a term of ………..

years and hereby accompany a sworn statement to that effect.”; dan

P.U. (A) 201 3

(iv)

dengan menggantikan nota huraian dengan nota huraian yang berikut:

“+EXPLANATORY NOTE―

(a)

If applicable, the adjoining State land included in the application is marked in red.

(b)

The consent in writing is required of every person—

(i)

entitled to the benefit of a lien over any of the lands or part thereof;

(ii)

having a claim protected by caveat affecting any of the lands or part thereof.”.

Kecualian 3.

Pindaan yang dibuat hendaklah tidak memberi kesan kepada dokumen yang disempurnakan sebelum berkuatkuasanya Perintah ini dan hendaklah diteruskan perserahannya seolah-olah Jadual Pertama tidak dipinda oleh Perintah ini.

NATIONAL LAND CODE

NATIONAL LAND CODE (AMENDMENT OF FIRST SCHEDULE)

ORDER 2017

IN exercise of the powers conferred by subsection 9(2)

National Land Code [Act No. 56 of 1965], the Minister, on the recommendation of

National Land Council, makes the following order:

Citation and commencement 1.

(1)

This order may be cited as the National Land Code (Amendment of

First Schedule) Order 2017.

(2)

This Order comes into operation on 21 July 2017.

Amendment of First Schedule 2.

The First Schedule to the National Land Code is amended—

(a)

in Form 12D―

(i)

in paragraph (1), by substituting for the words “are shown in red”

the words “are shown in red+”;

(ii)

in subparagraph (2)(b), by substituting for the words “persons”

the word “persons+”;

(iii)

by inserting after paragraph (2) the following paragraph:

“3.

*I/We hereby apply for the land/s (originally alienated in perpetuity) to be re-alienated to *me/us for a term of ……….

years and hereby accompany a sworn statement to that effect.”;

and

P.U. (A) 201 5

(iv)

by substituting for the explanatory note the following explanatory note:

“+EXPLANATORY NOTE―

(a)

If applicable, the adjoining State land included in the application is marked in red.

(b)

The consent in writing is required of every person―

(i)

entitled to the benefit of a lien over any of the lands or part thereof;

(ii)

having a claim protected by caveat affecting any of the lands or part thereof.”.

Saving 3.

The amendments made shall have no effect to the documents executed before the commencement of this Order and shall be continued to be presented as if the

First Schedule had not been amended by this Order.
