Opening note
Preamble
- PADA menjalankan kuasa yang diberikan oleh seksyen 30E Akta Lembaga Perindustrian Kayu Malaysia (Pemerbadanan) 1973 [Akta 105], Menteri membuat perintah yang berikut: Nama dan permulaan kuat kuasa
Seksyen 2
Pengecualian
(1)
Menteri mengecualikan—
(a)
pengeksport daripada peruntukan tentang pendaftaran di bawah
Akta, seksyen 18A dan 20 Akta; dan
(b)
pembekal dan pengendali jeti daripada peruntukan tentang pendaftaran di bawah Akta dan seksyen 20 Akta;
bagi aktiviti pengeksport, pembekal dan pengendali jeti itu di bawah Akta yang berkaitan dengan kayu yang berasal daripada Negeri Sabah atau keluaran kayu yang dibuat di Negeri Sabah.
(2)
Menteri mengecualikan pengimport daripada peruntukan tentang pendaftaran di bawah Akta dan seksyen 18A Akta bagi aktiviti pengimport itu di bawah Akta yang dijalankan di Negeri Sabah.

Seksyen 3
Peruntukan peralihan
(1)
Jika sebaik sebelum tarikh permulaan kuat kuasa Perintah ini, pengeksport, pembekal atau pengendali jeti adalah berdaftar di bawah Akta, pendaftaran itu dan mana-mana syarat dan sekatan pendaftaran itu, setakat yang berhubungan dengan aktiviti pengeksport, pembekal atau pengendali jeti itu di bawah
Akta yang berhubung dengan kayu yang berasal daripada Negeri Sabah atau keluaran kayu yang dibuat di Negeri Sabah, hendaklah terus mempunyai kesan sehingga tamat tempoh pendaftaran itu dan mana-mana syarat dan sekatan pendaftaran itu, masing-masingnya.
(2)
Jika sebaik sebelum tarikh permulaan kuat kuasa Perintah ini, pengimport adalah berdaftar di bawah Akta, pendaftaran itu dan mana-mana syarat dan sekatan pendaftaran itu, setakat yang berhubungan dengan aktiviti pengimport itu di bawah Akta yang dijalankan di Negeri Sabah, hendaklah terus mempunyai kesan sehingga tamat tempoh pendaftaran itu dan mana-mana syarat dan sekatan pendaftaran itu, masing-masingnya.

Opening note
Preamble
- IN exercise of the powers conferred by section 30E of the Malaysian Timber Industry Board (Incorporation) Act 1973 [Act 105], the Minister makes the following order: Citation and commencement 1.
(1)
This order may be cited as the Malaysian Timber Industry Board
(Incorporation) (Exemption) Order 2017.
(1)
The Minister exempts—
(a)
an exporter from the provisions on registration under the Act, sections 18A and 20 of the Act; and
(b)
a supplier and a jetty operator from the provisions on registration under the Act and section 20 of the Act;
for the activities of such exporter, supplier and jetty operator under the Act related to timber originating from the State of Sabah or timber products manufactured in the
State of Sabah.
(2)
The Minister exempts an importer from the provisions on registration under the Act and section 18A of the Act for the activities of such importer under the
Act carried out in the State of Sabah.

Transitional provisions 3.
(1)
Where immediately before the date of coming into operation of this
Order, an exporter, a supplier or a jetty operator is registered under the Act, such registration and any conditions and restrictions of such registration, to the extent that it relates to the activities of such exporter, supplier or jetty operator under the Act relating to timber originating from the State of Sabah or timber products manufactured in the State of Sabah, shall continue to have effect until the expiry of such registration and any conditions and restrictions of such registration, respectively.
(2)
Where immediately before the date of coming into operation of this
Order, an importer is registered under the Act, such registration and any conditions and restrictions of such registration, to the extent that it relates to the activities of such importer under the Act carried out in the State of Sabah, shall continue to have effect until the expiry of such registration and any conditions and restrictions of such registration, respectively.
