CONSTITUTION (AMENDMENT) (NO. 2) ACT 1984

FEDERAL TERRITORY OF LABUAN (EXTENSION AND MODIFICATION OF

LIMITATION ACT 1953) ORDER 2017

IN exercise of the powers conferred by section 7 of the Constitution (Amendment)

(No. 2) Act 1984 [Act A585], the Yang di-Pertuan Agong makes the following order:

Citation and commencement 1.

(1)

This order may be cited as the Federal Territory of Labuan

(Extension and Modification of Limitation Act 1953) Order 2017.

(2)

This Order comes into operation on 27 October 2017.

Extension of Act to the Federal Territory of Labuan 2.

The Limitation Act 1953 [Act 254], which is referred to as the “extended Act”

in this Order, is extended to the Federal Territory of Labuan.

Modification of extended Act 3.

The extended Act is modified in the manner as set out in the Schedule.

Repeal, saving and transitional 4.

(1)

The Limitation Ordinance 1952 [Sabah Cap. 72] (hereinafter referred to as the “repealed Ordinance”), in its application to the Federal Territory of Labuan, is repealed.

(2)

Any instrument executed under the repealed Ordinance before the coming into operation of this Order and affecting any dealing permitted under the repealed Ordinance shall continue to be in force under the repealed Ordinance as if this

Order had not been made.

(3)

Any suit or proceedings pending or commenced under the repealed

Ordinance before the coming into operation of this Order shall be continued and concluded under the repealed Ordinance as if this Order had not been made.
