Prohibitions as to importation and manufacture, and penalty
(a)
a misbranded pesticide;
(b)
a pesticide that is not for the time being registered on his application under this Act; or
(c)
a pesticide otherwise than in accordance with the conditions subject to which it was registered on his application.

(2)
Subject to subsection (3), a person who contravenes subsection
(1)
commits an offence and is liable, on a first conviction, to imprisonment for five years or to a fine of fifty thousand ringgit and, on a second or subsequent conviction, to imprisonment for ten years or to a fine of one hundred thousand ringgit or to both.
(3)
Notwithstanding subsections (1) and (2), it shall be a defence to a charge under paragraph (1)(a) of importing or manufacturing a pesticide that is misbranded as defined in paragraph 2(3)(g) or (h), that, in the process of manufacturing or transporting the pesticide, some extraneous substance has unavoidably become intermixed with it.
